A New York appellate court ruled Thursday that a defamation lawsuit brought against President Donald Trump by a former "Apprentice" contestant can move forward.A lawyer for Trump said he plans to appeal the decision.Trump had appealed a lower court's ruling last year that allowed the case to proceed, arguing that the Constitution's Supremacy Clause bars a lawsuit against a sitting president in state court because it would interfere with his duties.Mariann Wang, the lawyer for the plaintiff, Summer Zervos, argued that a president is not above the law and said the US Supreme Court's ruling in Clinton v. Jones backs up her argument that Trump can be sued in state court.Judges in the appellate division of the first judicial department agreed with Zervos, saying the Supreme Court's decision "did not encroach upon the exercise of the executive powers of the President" and that the Supremacy Clause was "never intended to deprive a state court of its authority to decide cases and controversies under the state's constitution."Zervos is suing Trump for defamation after he publicly called her a liar following her claims in October 2016 that Trump sexually assaulted her a decade earlier."We are very pleased that the First Department has affirmed once again that (Trump) 'is not above the law,'" Wang said in a statement Thursday. "The case has proceeded in the trial court and discovery continues. We look forward to proving to a jury that Ms. Zervos told the truth about Defendant's unwanted sexual groping and holding him accountable for his malicious lies."Two of the five judges dissented to part of the ruling, and cited the majority's interpretation of the constitutional issues at hand as a reason.In a statement, Trump's attorney Marc Kasowitz laid out his plan to appeal the latest decision."We believe that the well-reasoned dissenting opinion by two of the five justices, citing the US Supreme Court decision in the Clinton v. Jones case, is correct in concluding that the Supremacy Clause of the US Constitution bars state courts from hearing cases against the President while he or she is in office," Kasowitz said. This week, on the familiar set of the popular game show, Alex Trebek delivered somber news: he was diagnosed with pancreatic cancer. "Just like 50,000 others each year, this week I was diagnosed with stage 4 pancreatic cancer,” Trebek said in the video. “Now, normally the prognosis for this is not very encouraging, but I’m going to fight this, and I’m going to keep working." The sad reality is Trebek is right. Pancreatic cancer is one of the deadliest types of the disease. “The 5-year survival rate is just 9 percent,” says Julie Fleshman with the Pancreatic Cancer Action Network. Fleshman says it’s also not an easy disease to diagnose early, because symptoms like back pain and stomach aches can be benign. Therefore, pancreatic cancer is often only diagnosed when it's reached stage 4, meaning it has spread to other parts of the body. But Fleshman says Trebek's video message may be a breath of fresh air for anyone battling the disease. "I think having hope and empowerment when diagnosed with a difficult disease like pancreatic cancer is extremely important, and Alex’s message yesterday was courageous and inspiring to all of us," she says.In his announcement, Trebek inserted a bit of his trademark humor, saying he was going to fight this because “truth told, I have to, because under the terms of my contract I have to host Jeopardy for three more years!"Trebek asked for prayers from his fans. Airlines are prohibited from banning specific breeds of dogs on board flights as service or emotional support animals, the US Transportation Department said Thursday, amid controversy over safety and passengers abusing the policies for emotional support animals.The guidelines outlined by department officials appear to invalidate a recently-announced Delta Air Lines policy barring "pit bull type dogs" from traveling as service or emotional support animals.Airlines are allowed a case-by-case determination of whether an animal is safe to travel, and airlines can also require people traveling with emotional support animals to check in at the airport lobby, rather than online, to allow an airline official to review the animal."The airline does have the authority to do an individualized assessment of any dog, every breed of dog, and if any dog -- no matter the breed -- is determined to pose, or deemed to pose a risk to the health or safety of other passengers, the airline is free to deny boarding," a department official, who spoke on the condition of anonymity, told reporters on a conference call explaining the change.The Transportation Department is developing new long-term rules for passengers with service animals.The department will not seek to invalidate any airline policies prohibiting animals other than dogs, cats and miniature horses -- the most common species of service animals -- from traveling as emotional support animals, the officials said.Airlines will have one month to change any policies that do not comply with the interpretation. They did not specify which policies or airlines they believe are not in compliance.The airline industry said it supports the DOT guidelines because of its concerns about passengers abusing the allowances for emotional support animals, or ESAs."The availability of fraudulent ESA credentials online has enabled people who are not truly in need of animal assistance to abuse the rules and evade airline policies regarding animals in the cabin," said Airlines for America, an industry group.
