"It's unsanitary, the elements are uncontrollable, people will be sweating under cutting capes, and it is just unfathomable."In a statement, the California Department of Consumer affairs stood by the new rules."The situation is fluid and the environment is constantly changing, but for now, personal care facilities that are on the statewide monitoring list must follow the Governor's directive not to operate services indoors," spokeswoman Cheri Gyuro said. (AP) — A jury on Monday recommended the death penalty for a Southern California man convicted of killing a family of four with a sledgehammer and burying their bodies in shallow desert graves.Jurors in San Bernardino made the recommendation for Charles "Chase" Merritt, 62, in a case that puzzled investigators for years after a couple and their two young sons vanished from their home in 2010. Their bodies were found three years later.Merritt supported his head on his fists and closed his eyes as the verdicts were read. Smith set a Sept. 27 hearing to formally sentence Merritt. He thanked the jurors after the verdicts were read, saying he knew the decision was "extremely difficult."Authorities said they believed Merritt killed the family as McStay was cutting him out of his business making and selling custom water fountains. When the family disappeared, there were no signs of forced entry at their San Diego County home and their car was found parked at a strip mall near the Mexico border.For years, no one could figure out what happened to them. In 2013, their bodies were found in shallow graves in the desert after an off-road motorcyclist discovered skeletal remains in the area. Authorities also unearthed a rusty sledgehammer that they said was used to kill the family.Merritt was arrested the following year. Authorities said they traced his cellphone to the area of the desert graves in the days after the family disappeared and to a call seeking to close McStay's online bookkeeping account. Merritt also had referred to McStay in the past tense during an interview with investigators.Authorities concede the case against Merritt largely focused on circumstantial evidence and that questions remain about what happened at the McStay home.During the trial's penalty phase, prosecutor Britt Imes asked jurors to consider any possible motive for the killing of two young boys, whether they could have been witnesses to the murder of their parents or simply victims of callous killings."There is no motive that can be ascribed to the killer of a 4-year-old and a 3-year-old that passes muster," he said.Merritt's attorneys didn't call any witnesses during the penalty phase, instead appealing to any lingering doubts jurors may have had about killings they say their client didn't commit."From the very beginning, this case screamed doubt," defense attorney Raj Maline told jurors. "This case is filled with unanswered questions."California has not executed anyone since 2006. Voters approved a ballot measure to speed up executions in 2016, but Gov. (AP) — Two federal judges have ordered the United States Postal Service to continue to implement "extraordinary measures" to make sure ballots are delivered on-time before the presidential election.A federal judge has ordered the U.S. Postal Service to take "extraordinary measures" to deliver ballots in time to be counted in Wisconsin and around Detroit, including using a priority mail service.Chief U.S. District Judge Stanley Bastian in Yakima, Washington, issued the order on Friday after being presented with data showing on-time delivery of ballots sent by voters were too slow in the battleground states of Michigan and Wisconsin.Washington state Attorney General Bob Ferguson's office says delivery of ballots in the USPS Detroit district, for example, has dipped as low as 57% over the past week. National on-time delivery has been at 93% or higher.This comes on the same day that U.S. District Judge Emmet Sullivan signed an order, which requires the USPS to use the Express Mail network to make sure ballots are "entered close to or on Election Day to their intended destination," CNN reported.In a statement on Friday, the USPS outlined its "extraordinary measures" local post offices would take to accelerate ballots' delivery.CNN reported that processing plant managers send ballots and all local ballots to the provincial election or post office by 10 a.m. Monday and Tuesday by using Express Mail.Reuters reported that local ballots must be processed and delivered to regional post offices the day they arrive or the next morning until Nov. 7. 1581

  

SAN DIEGO — The race between two Democrats vying to become San Diego's next mayor is neck and neck, according to a new scientific poll.The ABC-10News Union-Tribune poll shows State Assemblyman Todd Gloria leading City Councilwoman Barbara Bry 39 percent to 38 percent, with 24 percent undecided. The results are well within the SurveyUSA poll's 5.3 percent margin of error. The race is even closer now than it was a month ago, when a similar poll showed Bry leading Gloria 37 percent to 34 percent, also within the margin of error. While both are Democrats, the poll showed Bry getting a majority of her support from Republicans and Independents, while Todd Gloria retained a lead among Democrats. "Barbara Bry is talking about neighborhood issues and slowing down the growth of San Diego, whereas Todd Gloria is talking about addressing housing and doing some growth," said Thad Kousser, a political scientist at UC San Diego. "That finds a political divide over growth that often separates moderates from liberals, or Democrats from Republicans even though both of these candidates Barbara Bry and Todd Gloria are both strong Democrats."Gloria took home 41 percent of the vote in the March primary, with Bry coming in second with 23 percent. She beat out Republican Scott Sherman by 1,189 to get into the top-two runoff, and his voters appear to be supporting her. SurveyUSA's poll shows 46 percent of Republicans voting in the mayor's race are supporting Bry, while 46 percent of independents voting in the race also plan to support Bry. Meanwhile, 24 percent of Republicans and 27 percent of independents voting in the race are supporting Gloria. Gloria's support is coming mostly from Democrats, with 53 percent of members of his own party planning to vote for him, compared to 27 percent for Bry. The remainder are undecided."There are different shades of blue within this city and this mayoral race is all about deciding what kind of Democrat San Diego will be governed by," Kousser said. In a statement, a spokesman for Gloria said they were focused on November 3. “The only poll that matters is Election Day," he said. "Our campaign will continue working hard to reach every San Diegan in every community and to earn every vote.”Bry's campaign also released a statement, saying the results were in line with their internal polling, showing the race in a dead heat. "We’re confident once voters understand the very real differences between the candidates – on issues ranging from protecting residential neighborhoods to re-starting our local economy and being independent from City Hall special interests – that we will prevail on November 3," the statement said.
