He succeeds Rocky Long, who retired on Jan. 8, then on Jan. 27 was hired as New Mexico's defensive coordinator on his 70th birthday.Hoke coached San Diego State to a 13-12 record in 2009 and 2010, including a 35-14 victory over Navy in the 2010 Poinsettia Bowl, the Aztecs' first bowl game since 1998.Hoke then coached Michigan from 2011-14, getting fired in 2014 after the Wolverines were 7-6 and 5-7 in his final two seasons. They were 11-2 and 8- 5 in his first two.Hoke returned to San Diego State in 2019 as the defensive line coach. (KGTV) - Community members gathered outside Carlsbad Police Department on Friday, demanding change following a controversial encounter last week between an African American man and Carlsbad officers.“There was zero attempt for de-escalation,” said Yusef Miller with North County Civil Liberties Coalition. “We're asking that all citizens stand with us in solidarity to fight this police brutality," another activist told reporters.The Carlsbad Police Department previously released video which juxtaposed three camera angles of the confrontation with the Marcel Cox-Harshaw -- two from officer body cameras and one from a witness. The footage can be viewed here.The witness' phone shows officers using a Taser on Harshaw and pressing his head into the pavement. The two other videos from police body cameras show officers meeting medics who were called out to a report of a man face down on the side walk. Police say that while medics were evaluating him, he became agitated, yelled profanities and began walking quickly toward them.The department says that officers feared for the medics' safety, so they reached out and told him to stop, but he continued to yell as they tried to cuff him.Officers report that they then used a Taser to try to subdue him after he continued to yell, struggle, turn and pull away.Police report that they then restrained him by holding his head and body to the ground and asking him to calm down while cuffing him, but they say that he refused. The department goes on to say that they put a porous, breathable spit mask bag over his head to protect themselves from coming into contact with droplets from his nose and mouth.Activists dispute the department's account of the night.“They approached him from behind. They grabbed his wrist. They didn't introduce themselves. He wasn't harming anyone. He wasn't armed to our knowledge,” added Miller.Harshaw was taken to the hospital and later released and then cited for resisting arrest. Police believe that drugs or alcohol may have played a role.Police report that a number of factors were considered by officers to use force, including, in part, "The apparent immediacy and severity of the threat to officers or others - Mr. Harshaw charged unarmed fire personnel while yelling profanities."Police also reveal that a Taser can be used, in part, when, "The subject is violent or is physically resisting. (KGTV) - More than two and a half years after Team 10 first reported about a North County property management company accused of stealing money from clients, the victims are finally getting their money back.Kelley Zaun owned Carousel Properties, a Carlsbad property management company. Victims first told Team 10 in 2016, they hired her to pay fees associated with their rentals. They said she did not pay those fees. She was accused of taking roughly 0,000 from victims, according to investigators.In 2018, Zaun faced 29 felonies for embezzlement, according to Deputy District Attorney Anna Winn. Zaun entered into a plea deal and agreed to a year in custody. With the help of the DA’s office, Zaun’s former clients were able to get their money back through the Department of Real Estate’s Consumer Recovery Account. RELATED: Team 10: Police investigating Carlsbad companyStephen Lerner, the Assistant Commissioner for Legal Affairs for the department, said so far, 23 victims have been reimbursed through the account. Other victims’ payments are still processing. They have been able to reimburse 2,084.68 thus far.The Consumer Recover Account is an option for fraud victims when trying to recoup money from the person who took it from them. In order to utilize the fund, Lerner said there must be a criminal or civil court order for the defendant to pay back money he or she took. If victims cannot get refunded from the person who stole it, they can apply through the Department of Real Estate (DRE).Winn said she volunteered to be the victims’ liaison with the DRE, as the process for reimbursement is lengthy and many of the victims were elderly. One of Zaun’s victims told Team 10 he is “extremely grateful” for the DA’s office work on this case.
