VISTA, Calif. (KGTV) - Kellen Winslow Jr. affirmed his innocence to 10News Thursday as he appeared in court to face a third charge of rape.The son of a Chargers legend, Winslow pleaded not guilty to the alleged rape a 17-year old girl in 2003.  10News was able to capture a few words with Winslow as he walked to his car in the parking lot outside court. When reporter Jim Patton asked about the new rape charge, Winslow responded it would all come out in court. Then asked if he was innocent of the other allegations of raping two women in Encinitas, Winslow said, "I'm advised by my lawyer to not speak on much. But yes, I am innocent." The new charge involves a woman who was 17 years old at the time. Winslow was 19. She claims he raped her while she was unconscious. Winslow Jr.'s attorney has previously said their relationship was consensual.  Thursday, the defense repeated a request for the woman's psychological history.Thursday's court hearing lasted no more than 15 minutes as attorneys debated whether this new case should be tried along with the other two rape allegations. Winslow Jr.'s attorneys argued the new charge could prejudice the other two.The judge allowed the cases to remain joined for now for efficiency but said the trial judge would make the ultimate decision.  Winslow is currently free on a million bond, while required to wear a GPS monitoring bracelet. His trial date was set for March 19th, 2019. 1507

VISTA, Calif. (KGTV) - Several North County residents want their money back from a failed Tiny Home community.  Vista resident Greg Dutton said he and a handful of others simply want their ,000 investments back from Janet Ashforth, the brains behind Habitats Tiny Homes, which was planned for a plot of land between Escondido and Poway.“Sounded like a great idea,” said Dutton.  “A whole bunch of tiny homes.  Community garden.  Community clubhouse.”His excitement turned to frustration when he didn’t like the property Ashforth secured.“Really hard to get to.  Hardly any access roads,” he said.Dutton said Ashforth promised to refund his money if he didn’t like the property. However, Dutton requested the refund after Ashforth went into escrow for the property. He showed an email apparently from Ashforth saying he was too late to ask for the refund but she’d return the money anyway.Dutton still hasn’t received his refund. He and several other investors have filed claims at the Courthouse in Vista.10News spoke with Ashforth by phone. She said the project failed “when 30 people didn’t follow through and now they’re expecting their money back.”  She explained none of her investors ordered their tiny homes or took the next steps to keep the project alive.She argued, “The receipt clearly says you can get your deposit back until we open escrow on the property.”  Ashforth said Dutton requested after escrow opened.“I apologize,” she continued. “However, you should take responsibility for the receipt. I don’t have the money to give back because it was invested in the 0,000 property we’re now trying to sell.”Ashforth said she’ll gladly appear in court but admits the money is wrapped up in an empty plot of land. 1826

WASHINGTON — The Trump campaign says it has filed lawsuits Wednesday in Georgia, Pennsylvania and Michigan, and will ask for a recount in Wisconsin.Democratic challenger Joe Biden is projected to win Wisconsin with a roughly 20,000 vote lead. No presidential race winner has been projected for either Pennsylvania, Michigan or Georgia at this time.The lawsuits in Michigan and Pennsylvania both demand better access for campaign observers to locations where ballots are being processed and counted, the campaign says.“In Philadelphia and elsewhere, Democrat officials forced our observers to stay 25 feet or more from the counting process, leaving no meaningful way whatsoever for our observers to do their jobs,” the statement from Justin Clark, Trump’s deputy campaign manager, reads.At a press conference Wednesday afternoon, Trump's personal attorney, Rudy Giuliani, elaborated on the campaign's legal action in Pennsylvania. "Not a single Republican has been able to observe these (absentee) ballots,” Giuliani said, adding speculatively, "Joe Biden could have been able to vote 5,000 times, we don’t know."With about 84 percent of the ballots counted in Pennsylvania, Trump leads Biden by almost 300,000 votes.The Trump campaign said Wednesday they are also seeking to intervene in a state case at the Supreme Court that deals with whether ballots received up to three days after the election can be counted, deputy campaign manager Justin Clark says.In the Michigan suit, election officials are asked to stop absent voter counting boards from counting because they are allegedly not complying with a state statute that 1 election inspector from each major political party be present during counting, according to the lawsuit.It also asks that observers be allowed to view surveillance video of ballot boxes that were in "remote and unattended" locations.In response to news of the lawsuit, demonstrators went to a building in downtown Detroit trying to get inside to challenge votes being counted. Hundreds of challengers are already inside the TCF Center, according to WXYZ in Detroit, and those outside are not being let in. The Detroit Health Department says the building is at capacity, and police are enforcing those capacity rules. Giuliani hinted the Trump campaign may bring a larger lawsuit about issues with observing ballot counting. "We're going to consider a federal lawsuit. Quite possibly we'll do a national lawsuit and reveal the corruption of the Democratic party," he said. Trump tweeted Wednesday afternoon, without supporting data, that he claimed victory in Pennsylvania, Georgia and other states. He also made unsubstantiated claims about "secretly dumped ballots."Michigan Attorney General Dana Nessel's office released a statement asserting the state's elections were "conducted transparently, with access provided for both political parties and the public, and using a robust system of checks and balances to ensure that all ballots are counted fairly and accurately."In Wisconsin, candidates are allowed to ask for a recount if the margin is less than 1 percent. The current margin is roughly .6 percent.The Trump campaign said they would seek a recount. No word on when that will begin.In Georgia, as of Wednesday night, Trump had a slight lead over Biden by 33,000 votes. There are roughly 100,000 votes left to count. The Biden campaign released a statement responding to the lawsuits:"When Donald Trump won Wisconsin in 2016 by roughly the same amount of votes that Joe Biden just did, or won Michigan with fewer votes than Joe Biden is winning it now, he bragged about a 'landslide,' and called recount efforts 'sad.' What makes these charades especially pathetic is that while Trump is demanding recounts in places he has already lost, he's simultaneously engaged in fruitless attempts to halt the counting of votes in other states in which he's on the road to defeat. This is not the behavior of a winning campaign. Plain and simple, Donald Trump has lost Wisconsin, he is losing Michigan, and he is losing the presidency. Video shows a woman being severely injured after she pursued a man who snatched her purse at a McDonald's restaurant in Okeechobee.The incident happened Thursday at about 8:30 p.m.Police say the suspect entered the restaurant, approached the booth in which the elderly woman was sitting, reached over the backrest and grabbed her tan Coach purse. Surveillance video shows the woman chasing the man to his car. He backed out, knocking the woman to the ground and leaving the scene.The woman was injured and is currently hospitalized. Her condition is unknown. Authorities issued a "be on the lookout" for the suspect and his vehicle.Okeechobee police said tips from Facebook helped them identify the suspect, Charles Alton Stratton Jr., 50, of Okeechobee. 797

VISTA, Calif. (KGTV) - The mother of a 14-year-old girl sexually assaulted by a San Diego Deputy filed a civil lawsuit citing negligence and invasion of privacy.Deputy Timothy Wilson pleaded guilty to lewd acts on a minor and two counts of unlawfully taking computer data. He’s serving jail time. The victim’s mother, Jennifer Tanis, says Wilson accessed her daughter’s police file 44 times. He was able to get her home address, videos, and pictures of her daughter. She tells 10News she’s suing the county, not for money, but change. Currently, all deputies are allowed to access police files, but she thinks the only person who should have access to them is the lead investigator.She says the county failed her.“There was no system in place to protect my daughter, her story or the pictures they took of her during the investigation," Tanis said.Tanis is pushing for change not only in the county but the entire country. She reached out to Congressman Mike Levin’s office for help. San Diego County has said they have the capability of making police reports private, but only in some cases. Deputy Wilson’s case wasn’t reportedly one of them. 1152
