CARLSBAD (CNS) - Attorneys for the alleged victims of a former Carlsbad military boarding school headmaster whose molestation conviction was overturned last week by a state appellate panel asked the San Diego County District Attorney's Office Wednesday to appeal the ruling or retry the case against him.Jeffrey Barton, 62, was convicted in 2017 of five felony counts of forcible oral copulation and one felony count of forcible sodomy for allegedly molesting a cadet at the Army and Navy Academy beginning in 1999, when the alleged victim was 14 years old.Barton was sentenced to 48 years in state prison.A three-justice panel from the Fourth District Court of Appeal agreed with Barton's contentions that the trial judge should not have dismissed one of the jurors during the trial and reversed the conviction on Friday.RELATED: Appeals court reverses molestation conviction for former Carlsbad boarding school headAttorney John Manly, whose firm represents four alleged victims in civil suits filed against Barton and the academy, said, "We disagree with the ruling of the court of appeal. The evidence against him is overwhelming and we ask District Attorney Stephan to appeal this decision and, if necessary, retry this case in the interest of justice and public safety."So far, two of those civil suits have been settled and two are pending.A District Attorney's Office spokeswoman said, "We have contacted the victims who testified in the case and are working to provide them support. At this time, we are exploring our appellate options, which include retrial."The convictions came in Barton's second trial.In his first trial, almost two years before, a different jury deadlocked on the charges involving the alleged victim.Two other former Army and Navy Academy students testified in the first trial that they were molested by Barton, but the defendant was acquitted on all but one of the counts involving those victims.The appellate panel ruled that Barton's second trial could have concluded differently had one juror not been excused, allegedly for refusing to deliberate with her fellow panelists.The justices wrote in their ruling that the other jurors appeared to disagree with Juror No. 12, but did not provide enough of a showing that she was actively stalling deliberations.The ruling indicates the juror did not appear to find the alleged victim credible."The trial court's error in discharging Juror No. 12 warrants reversal," the panel wrote. "She was the lone holdout juror who consistently held to her belief Barton was not guilty and, had she remained on the jury, it is reasonably probable the case would have ended in a mistrial, a more favorable result for Barton than conviction."The panel wrote that Barton was convicted "within hours" of the juror being discharged. 2921

I think analytics is going to take the game to the next level," said Roger Weingarth, President and CEO of Blast Motion.The company's technology uses a sensor that attaches to the end bat, as high-powered cameras record everything measurable, from bat speed to body rotation. That is a big edge in training athletes and a boon for coaches in search of data for recruiting.Among the company's customers: thousands of high school baseball programs and hundreds of college baseball and softball programs, along with nearly all Major League Baseball teams. For the last decade, Blast Motion has called Carlsbad home. The company has some 80 employees, most of them in Carlsbad. "Having this wonderful combination of education, engineering talent - as well as authentic athletes - is relevant and very important for our success here in Carlsbad. People are very active here, active in sports," said Weingarth.About five years ago, Chris Crawford was one of those athletes. He was a surfer who was tired of getting his car dirty. He invented a pressurized portable shower in his garage in Carlsbad, showed it off at the city's street fairs, before a Kickstarter campaign, viral video, and an appearance on the show Shark Tank helped lead his company Rinsekit to success. CARLSBAD, Calif. (KGTV) -- As a way to deal with San Diego’s growing roadway congestion, more communities are installing mini-roundabouts to slow speeding drivers. Yet some neighbors in North County are calling them death traps.If you take a drive down Cassia Road in Carlsbad, you’ll see mini-roundabouts, also known as mini-circles, that are causing a big fuss. Fire Captain Nick Valenzuela lives in the neighboring community. “I've come down [to the road] because I’ve heard traffic accidents from my house and come down and helped people,” he tells us.“I've seen the aftermath of at least two accidents,” adds neighbor Mark Bua, who is also a police officer. Bua says the mini-circles are so small that drivers blow right past them without yielding for oncoming traffic. He shared photos of debris from some of the collisions.The mini-circles on Cassia Road were installed at the end of 2016 as a way to slow traffic in bustling North County.Mini-circles have had great success in other booming cities like Seattle, which now has more than 1,000 of them with a 90% reduction in collisions.Dan Burden is a renowned traffic expert. He was once named one of the most important civic innovators in the world, according to TIME Magazine. We asked Burden to review photos of the Carlsbad mini-circles. “[They’ve] got some design issues,” he told us. “In this case the circle is so small and there's no consequence in getting close to it. They're designed in a way that a motorist could go much too fast,” he adds.Burden is a fan of mini-circles, if they're done right. He says they're easier on cars than speed bumps and create better flow than stop signs. "They slow traffic down to 15 to 20 miles per hour upon entry,” he adds.However, Carlsbad neighbors claim they’re playing chicken with speeding drivers and lives are at risk.10News submitted a request with the City of Carlsbad to review the number of recent collisions Cassia Road. According to reported incidents, collisions actually appear to have dropped since the mini-circles were installed.Nearby Leucadia is hoping to soon install mini-circles along the congested North Coast Highway 101. A few years ago, the mini-circles were installed in the Bird Rock community of La Jolla, where motorists are now driving half as fast as they used to. On Harbinson Avenue in La Mesa, the circles were removed a few years after neighbors complained about safety concerns.The City of Carlsbad is reportedly monitoring and making refinements to the mini-circles on Cassia Road, but is aware of residents’ concerns and will consider making more changes in the upcoming months.“This is Carlsbad. Around 15% of them are bullied online or by text.A former victim of cyberbullying, Prabhu says reading about a 12-year-old in Florida who died by suicide after being cyberbullied forced her to act.“It just absolutely devastated me, and I knew as a young person who had grown up in a world with technology and phones, that I was uniquely positioned to do something about this, that I could make a change.”At just 13 years old, she created ReThink, a patented technology that can detect hurtful or offensive messages by a user and force them to pause and think.“What if we're able to quite literally intervene in the decision-making process? And before someone hits send go ‘whoa hold on. What you're about to say could be offensive. Are you sure you want to post that?’”The custom-built ReThink keyboard replaces the mobile device’s default keyboard and can spot and flag aggressive messages. It really broke our heart, " said homeowner Gavin Dooley.A check of the surveillance video revealed the culprit. Just before 3 a.m., a black SUV pulls up next to their home, as someone emerges from the passenger side and climbs over their four-foot gate. Moments later, the person throws himself onto a large inflatable of a Santa and his fish taco truck.The scrooge tore through their yard, destroying all of their giant Christmas inflatables."Must have had a good pop on the first one. Second one, he jumps on it twice," said Dooley.That inflatable was a 9-foot tall television, reflecting the images of a projector from the movie "A Christmas Story." The vandal then tackles the final inflatable, which sported North Pole penguins.The end result: 0 dollars worth of inflatables destroyed."Pretty unrepairable. Just like a balloon, they’re popped. There's a huge tear in them," said Dooley.Dooley, who has three children, says his youngest -- his 9-year-old son -- was the most distraught.Also dismayed, some neighbors who bring their toddler girl to see the inflatables every day.
