SAN DIEGO (KGTV) - A man says his car was stolen while he was picking up a delivery order from a Subway in Clairemont. Luis Riveramerced said he was working for Postmates, a food delivery app, on Tuesday when he stopped at the Subway in Clairemont Town Square.“All I had to do is grab the bag and take off,” he said.So he felt comfortable leaving his car running, expecting to be in and out in a few seconds.“If I know it’s pick-up only, then I'll let my car run. I’ll just grab it,” he said.But while he was inside, he noticed part of the order was missing. As he was waiting for the order to be fixed, surveillance video captured a man peeking into the store, getting in his car and driving away.“I was like wow,” he remembered thinking when he went back outside. “I wasn’t expecting somebody to jump in my car right in front of me and take off like that.”He called the police but by the time they got there, the driver was long gone.“You put a little bit of trust and now I will never do that again,” said Riveramerced.A Navy veteran, he said he’d been working for Postmates for a few weeks. SAN DIEGO (KGTV) -- A restaurant destroyed by a fatal fire last October reopened just in time for the holiday crowds. Kojack's Greek American fusion restaurant has been a Mission Beach staple for more than three decades. But last October, a fire started near the roof of the building and destroyed the ice cream shop and Kojack's on the bottom floor, as well as the apartment rooms on the second floor. San Diego Fire-Rescue Department said 36-year-old apartment tenant, Aaron Porter died in the fire. Since the tragedy, the building and restaurant owner, Mike Soltan says he has worked tirelessly to get back onto his feet to reopen on his favorite holiday. "I never miss the Fourth of July on this beach for 33 years. So we tried so hard to make it, and finally, we did it." Soltan said. Longtime customer, Steve Grebing said he could not miss the grand reopening. "He [Soltan] kept saying in two weeks, two weeks. He was getting there, but now he is back here, so it's great," Grebing said. While the building itself is rebuilt, the renovations for the second floor are on hold. So no apartment tenants are able to live upstairs. Soltan also owns the ice cream shop next to Kojack's. Both shops reopened on July 4. 1226

SAN DIEGO (KGTV) - A man from El Salvador has been granted asylum in the United States after having been sent back to Mexico to await his trial.According to his attorney, Narciso Cruz, the man is only the second person to receive asylum who had been sent back to Mexico due to the Trump administration’s Migrant Protection Protocol (MPP.)“This individual is a bit of a rarity,” said Cruz, referring to his client’s success in court.But his story is not a rarity.Marcos fled violence in El Salvador and did no want to use his full name for this story, still fearing the gang he fled in El Salvador.“They’re a terrorist group,” said Marcos.He became targeted earlier this year after he tried to help his cousin who was being recruited by the gang. After he interfered, he started receiving death threats.“They will kill you and your entire family,” he said.He traveled to the United States, crossing the border on June 25 somewhere near Tecate.He said he wandered in the desert for five days before he was eventually picked up by Border Patrol agents and taken to a holding facility. Within a day he said he was sent back across the border to Mexico where he would wait for his case to be heard.The Trump Administration implemented the MPP in January. Despite some pushback from the courts, the policy, also called “remain in Mexico,” was allowed to go forward.As of September 1, the U.S government has sent 42,000 asylum seekers to Mexico, according to the Department of Homeland Security.As for Marcos, his case is not officially done yet. The government reserved its right to appeal the court’s decision. They have until October 25 to file an appeal. 1659

SAN DIEGO (KGTV) - A San Diego man has been sentenced to more than six years in prison after pleading guilty to multiple gun charges in a Tucson, Arizona federal court.Joshua Pratchard came to the FBI's attention after a short-lived attempt to join what prosecutors call a border militia group in Arizona in January 2018. The group kicked Pratchard out after just a few days, saying he did not want to follow their rules, including repeatedly asking to get physical with detainees and demanding to put a silencer on his weapon. He was also deemed eager for confrontations with criminal bandits known as "rip crews" who seek to steal drug loads in the desert.Pratchard continued to be involved in activity in Arizona, leading to contact with a member of the group who was a FBI informant. Pratchard revealed that he manufactured and sold weapons. The informant reported this to the FBI, which led to an investigation. Eventually, Pratchard was arrested after selling firearms to the informant. A search of Pratchard's apartment in Pacific Beach led to the discovery of a "gun factory." Along with the machinery to build firearms and bullets, agents found four homemade guns and enough gunpowder for 9,000 rounds of ammunition.The FBI investigation also discovered Pratchard's criminal history, which includes a conviction for having ecstasy when he was serving in the Marine Corps, and a 2007 felony assault conviction.Although he has been sentenced on the gun charges, Pratchard's legal trouble may not be over. During the sentencing hearing, prosecutors made multiple references to a non-profit organization Pratchard ran in San Diego which could see fraud charges filed in the future. 10News uncovered Pratchard's involvement leading a charity known as "Second Chance Fields," which is dedicated to rebuilding or refurbishing athletic fields at San Diego schools. His website touts to significant projects, including renovation of the baseball field at Mission Bay High School and a large-scale renovation of football and lacrosse facilities at Del Norte High School. For the latter project, Pratchard recruited former San Diego Padres star Adrian Gonzalez, who appeared at a press conference with Pratchard at the school and whose foundation donated ,000, according to the Second Chance Fields website.10News asked the FBI if there was an investigation underway into Pratchard and Second Chance Fields.
