SAN DIEGO (KGTV) -- San Diego City Attorney Mara W. Elliott has heard complaints from neighbors and has filed a civil enforcement action to shut down a short-term vacation rental property in La Jolla that has been dubbed a "COVID party mansion."The complaint alleges that defendants are maintaining a public nuisance and engaging in unfair competition, including false advertising at the La Jolla Farms rental property located at 9660 Black Gold Rd. According to city officials, the rental property continues to operate in violation of state and county COVID-19 public health orders.According to a press release, Elliott is seeking civil penalties and a permanent injunction against property owners Mousa Hussain Mushkor and Zahra Ali Kasim, property manager Nital Meshkoor, and Steven S. Barbarich, who leased the property from Mushkor and subleased it as a short-term rental.City officials said the oceanfront mansion has been the subject of at least 30 calls to the San Diego Police Department. Officers have spent more than 173 hours at the property to investigate nuisance activity. Most of the incidents involved raucous parties, some of which had up to 300 attendees.Elliott said about a dozen of the party complaints came during the COVID-19 pandemic, while public health orders prohibited large gatherings.According to the press release, concerns about the property were brought to the City Attorney’s Office by San Diego police and by neighbors who reported that the situation was "becoming more pronounced as the COVID-19 pandemic progressed." “Shutting down dangerous party houses protects the public health by preventing COVID super-spreader events and other illegal behavior,” Elliott said. “It’s unfortunate that San Diego does not have short term rental regulations in place. Relief for this neighborhood would have come much sooner. Instead we must rely on time-intensive prosecutions at significant taxpayer expense.”According to the press release, gunfire was reported to police during a party in May of 2019. Officers arrived and found a large party in progress. Partygoers questioned by police admitted gunshots were fired during a fight that had occurred earlier. Police found shell casings outside the property and a neighbor found an additional casing the next day and turned it over to police. The City Attorney's Office assembled evidence from investigations by SDPD, the Code Enforcement Division of the City’s Development Services Department, the County Health & Human Services Department, and the City Fire Marshal. Elliott hopes the action makes the owners clean up the property and relieves neighbors. 2644

SAN DIEGO (KGTV) - San Diegans are signing up to build accessory dwelling units, or granny flats, in numbers that haven’t been seen in years. According to the city’s development services department people, more than 200 people went through the permitting process in 2018. “It fits for us to build an additional unit, the ADU since the council changed their ordinances,” said San Diego resident Efrain Conrique. Efrain Conrique has been in the same house since the 1960s but is now planning to build a 1,100 square foot accessory dwelling unit in his backyard. The house is for his granddaughter. "Now this way she can not pay for the rental of an apartment and live here,” Conrique said. “So that's a personal thing, but it would work no matter what.” RELATED: Woman builds granny flat to finance retirementThe ease in regulations is having an impact on the building community. "When you build a custom ADU it ads on to the square footage,” said Gregg Cantor of Murray Lampert Design, Build, Remodel. “The resale value is much higher.” Gregg Cantor says he’s working on several projects that wouldn’t have been possible without the recent regulation changes. He says since the City of San Diego streamlined the ADU process, nearly half calls he gets are people looking to build. SAN DIEGO (KGTV) — San Diego Police have released video footage of an officer-involved shooting involving a man who was arrested and reportedly stole a gun out of an officer's backpack Sunday.The footage includes bodycam video from officers inside the police station's sally port, as well as surveillance footage of the parking area.Police say a 25-year-old Hispanic man, later identified as Keith Bergman, was arrested shortly after 6:20 p.m. after an incident at a downtown San Diego hotel on Sunday. A hotel security guard reported the man was “acting strange” and threatening others.Bergman was evaluated for being under the influence and arrested, according to SDPD. Police say they found methamphetamine and five credit cards that didn't belong to him in his pockets.See the video in the player above (If the video doesn't appear below, click here)Officers brought Bergman to SDPD headquarters. Just after 8 p.m., police said the suspect somehow freed one hand from his handcuffs while inside the patrol SUV, and then broke a divider that separates the prisoner seat area from the cargo area.Police said Bergman found an officer’s backpack that contained a backup handgun. When officers returned to check on the suspect, he was still in the vehicle but armed with a gun, according to SDPD.Officers drew their weapons and gave Bergman verbal commands to drop the weapon, but he refused and fired at least one round from the gun, police said.The officers felt threatened, police said, and at least one round was fired at Bergman, hitting him in the torso.Bergman reached out of the vehicle's window and opened the door to exit while he was still armed, police said, adding that he tried to open the rear cargo compartment of the SUV and the driver's door, refusing orders to stop in the process.RELATED: San Diego Police: Suspect shot by officers after finding officer's gun in patrol SUVPolice eventually released a service dog to subdue Bergman, and police moved in to arrest him.Officers provided first aid at the scene and Bergman was taken to the hospital with non-life threatening injuries, according to SDPD.San Diego Police also identified the three officers involved in the shooting as Paul Yi, a six-year veteran of the department, Michael Rodriguez, who has been with the department for 10 months, and Timothy Arreola, an eight-year veteran of the department. After the department's Homicide Unit completes its investigation, the San Diego County District Attorney’s Office will look at the incident to determine if the officers bear any criminal liability for their actions. The Internal Affairs Unit will also conduct an investigation, and the Shooting Review Board will evaluate the tactics used by the officers. The Community Review Board on Police Practices will conduct a review of the incident and provide any appropriate recommendations. The Federal Bureau of Investigations and the United States Attorney’s Office will also monitor the investigation. 2982
