It's been a brutal week for many big American retailers.JCPenney announced Friday that it will cut 360 jobs at its stores and corporate headquarters. That's on top of the more than 5,000 layoffs in 2017 after JCPenney decided to close nearly 140 stores.The struggling retailer also said that its earnings and sales for this year will be worse than what Wall Street analysts were expecting. Shares of JCPenney plunged nearly 10% in early trading.JCPenney wasn't the only prominent bricks and mortar chain to report poor results this week.Barnes & Noble posted a quarterly loss and a drop in sales Thursday morning, sending the bookstore's shares to an all-time low.Victoria apparently needs a new Secret too. L Brands, the owner of the lingerie seller and Bath & Body Works, plunged 14% Thursday after its outlook turned out to be more devilish than angelic.Nordstrom, which is trying to go private, failed to impress investors with its latest results after the closing bell Thursday. Its stock fell 6% Friday morning.And the other shoe dropped at Foot Locker. The sneaker and athletic apparel company's sales missed forecasts and its outlook was weak as well. In it, the former Subway pitchman – now serving more than 15 years on charges of child porn and sexual conduct with a minor – alleges federal Judge Tanya Walton-Pratt, who sentenced him to prison, two members of the 7th Circuit Court of Appeals, an Illinois U.S. district court judge and both of his lawyers undertook a “scheme to defraud” Fogle by tricking him into pleading guilty to a false charge.READ | Full?Fogle?plea agreementIn addition to his wrongful imprisonment, Fogle claims he suffered at least million in damages. The suit asks the government to grant him threefold damages as remuneration in the sum of million.The claim – which purports to outline a sprawling RICO case involving fraudulent search warrants, bogus charges and ill-gotten advice from attorneys to agree to pay .4 million in restitution to Fogle’s juvenile victims (at least million of which Fogle had already paid prior to his sentencing) – is the latest attempt by Fogle to get out of the plea he entered in November 2015.Previous such attempts – an apparent “sovereign citizen” defense rejected in November, the demonstrably false claim that Judge Pratt was “biased” because of her two teenage daughters at the time of the sentencing (she had none), and the argument that he pleaded guilty to an “unconstitutional” charge of conspiracy –  have so far been unsuccessful. In response to a growing trend on social media, the Food and Drug Administration published a public warning this week about the dangers of taking too much of an allergy medication, diphenhydramine, commonly known as Benadryl.“We are aware of news reports of teenagers ending up in emergency rooms or dying after participating in the “Benadryl Challenge” encouraged in videos posted on the social media application TikTok,” the statement reads.When a teen girl died in August in Oklahoma City, her family blamed the 15-year-old’s death on a Benadryl overdose. The family blamed a “challenge” on TikTok where participants take a dozen or so doses of the allergy medication to experience hallucinations.Earlier this year, there were reports out of Fort Worth, Texas that three teens became sick and had to be rushed to the hospital after taking large amounts of the medication. According to Newsweek, when they recovered, the teens told officers they had taken the allergy medication as part of the TikTok challenge.Taking more than the recommended dose of Benadryl “can lead to serious heart problems, seizures, coma, or even death,” the FDA states.“We are investigating these reports and conducting a review to determine if additional cases have been reported,” the FDA stated. “We also contacted TikTok and strongly urged them to remove the videos from their platform and to be vigilant to remove additional videos that may be posted.”Johnson & Johnson, who manufacture Benadryl, released a statement to media outlets stating, in part, “The health and safety of people who use our products is our top priority. The BENADRYL TikTok trend is extremely concerning, dangerous and should be stopped immediately.”The FDA reminds parents and caregivers to lock up medicines to prevent accidental overdoses. They warn that with more children at home during the coronavirus pandemic, teens may be more likely to experiment. 1926
