SAN DIEGO (KGTV) — San Diego's District Attorney's Office Wednesday says the officer who fatally shot a man who had attacked another person with a machete in Southcrest acted in self defense.After review the case and officer's actions, DA Summer Stephen's office says Officer Corey Pitts, who fired upon Vaughn Denham on Aug. 8, 2018, is not criminally liable for the shooting.Denham, 48, has reportedly attacked another person with a machete during an argument over a dog chain. Pitts eventually fired two rounds, striking Denham.Denham later died at the hospital. The Stephen's office says a toxicology report showed phencyclidine (PCP), cannabinoids, and methamphetamine in his system."Based on these circumstances, Pitts fired at Denham in his own defense," the office's review states. "He therefore bears no state criminal liability for his actions."In addition to clearing Pitts of any criminal wrongdoing, the DA's office released nearly two minutes of body camera footage from the incident. 1751

SAN DIEGO (KGTV) — San Diego State's coronavirus cases among students continued to rise over the weekend, spiking more than 100 cases in two days.On Sunday, the college reported 286 confirmed or probable COVID-19 cases among on- and off-campus students. SAN DIEGO (KGTV) — Several changes are being introduced to how Assembly Bill 5 applies to freelance writers and photographers.Assemblywoman Lorena Gonzalez announced the changes Thursday to address feedback from freelance writers and journalists over the effects of AB 5.“Having heard additional feedback from a variety of freelance writers, photographers and journalists, we are making changes to Assembly Bill 5 that accommodate their needs and still provide protections from misclassification,” Assemblywoman Gonzalez said.RELATED: Proposed bill would exempt musicians from AB 5The changes will remove the cap on the number of submissions that a freelancer writer, photographer, or editor can submit to one hiring entity before they must be classified as an employee. Hiring entities must not use a contractor to replace an employee position as well.When contractors provide services, their contract must specify the rate of their pay, when they receive payment, and the individual's intellectual property rights to the work submitted. SAN DIEGO (KGTV) - Saturday night, the Padres will welcome back one of the most iconic characters in franchise history.The Famous San Diego Chicken will return to Petco Park as part of the team's 50th anniversary celebration."It's like coming back and seeing family again," says Ted Giannoulas, the man behind the mascot. "It's great. These fans put me on the map. It was their laughter, their good faith over the decades that launched my unique career."The Chicken started in 1974 as a radio station mascot. Over the years, his popularity grew, turning the San Diego favorite in a national phenomenon.But it's been 10 years since the Chicken ruled the roost at a Padres game. The team decided their anniversary season was the right time to welcome him home."As you look back through our 50 year history, it was a piece of our story that we thought really needed to be told this year," says Marketing Director Wayne Partello.As part of the Chicken's return, the team will give away a San Diego Chicken bobble head to every fan at Saturday's game."It's the spitting image of me," says the Chicken, who partnered with the team to make sure they got every detail right, down to the coloring on individual feathers.The Chicken will also sign autographs and take pictures with fans throughout the game. SAN DIEGO (KGTV) -- Several men tried to scale the border fence at Border Field State Park Thursday evening.Video shows the men sitting on top of the wall attempting to get over. Border Patrol responded and agents were able to break up the crowd on the Mexico side of the border. Following the incident, the agency said it is willing to add agents in the area as needed. According to Border Patrol officials, about 167 arrests are made per day at the San Diego sector of the border. VIDEO: Migrants climb over border fence at Border Field State ParkEarlier in the week, dozens of migrants were caught on video climbing over the same section of the border fence. During that incident, several people successfully made it over the fence and onto the beach on the U.S. side of the border before being apprehended by agents. According to Border Patrol, 23 of the people who crossed the border illegally were from Honduras while the 24th person was from Guatemala. 1036
