"But rather than doing a streamed live performance which would necessarily have a lot of the artists congregate in person with one another, they brought them to a film studio so that people could be recorded separately and distanced and then drawn together into a film iteration.”For now, Trottman-Huiet says he’ll continue writing songs and plans to eventually be back onstage with his beloved tuba.“I mean there’s certain things that happen onstage with a large group of people that’s just magic," Trottman-Huiet said. "And I’m sure I can get some feelings playing guitar and singing my own songs, but I don’t know I would be fulfilled doing one or the other. CARLSBAD (CNS) - Attorneys for the alleged victims of a former Carlsbad military boarding school headmaster whose molestation conviction was overturned last week by a state appellate panel asked the San Diego County District Attorney's Office Wednesday to appeal the ruling or retry the case against him.Jeffrey Barton, 62, was convicted in 2017 of five felony counts of forcible oral copulation and one felony count of forcible sodomy for allegedly molesting a cadet at the Army and Navy Academy beginning in 1999, when the alleged victim was 14 years old.Barton was sentenced to 48 years in state prison.A three-justice panel from the Fourth District Court of Appeal agreed with Barton's contentions that the trial judge should not have dismissed one of the jurors during the trial and reversed the conviction on Friday.RELATED: Appeals court reverses molestation conviction for former Carlsbad boarding school headAttorney John Manly, whose firm represents four alleged victims in civil suits filed against Barton and the academy, said, "We disagree with the ruling of the court of appeal. At this time, we are exploring our appellate options, which include retrial."The convictions came in Barton's second trial.In his first trial, almost two years before, a different jury deadlocked on the charges involving the alleged victim.Two other former Army and Navy Academy students testified in the first trial that they were molested by Barton, but the defendant was acquitted on all but one of the counts involving those victims.The appellate panel ruled that Barton's second trial could have concluded differently had one juror not been excused, allegedly for refusing to deliberate with her fellow panelists.The justices wrote in their ruling that the other jurors appeared to disagree with Juror No. 12, but did not provide enough of a showing that she was actively stalling deliberations.The ruling indicates the juror did not appear to find the alleged victim credible."The trial court's error in discharging Juror No. 12 warrants reversal," the panel wrote. "She was the lone holdout juror who consistently held to her belief Barton was not guilty and, had she remained on the jury, it is reasonably probable the case would have ended in a mistrial, a more favorable result for Barton than conviction."The panel wrote that Barton was convicted "within hours" of the juror being discharged. 2921

(KGTV) — Prosecutors Wednesday say two transients accused of a deadly home invasion robbery this week stabbed the victim 50 times in the face, neck, and back.Ian Bushee, 37, and Malissa James, 26, are both accused of breaking into a home in the 1800 block of Outrigger Lane just after midnight Monday. During the break-in the victim, identified as 63-year-old Marjorie Gawitt, was stabbed multiple times.Gawitt was still able to call 911 to report the incident and was conscious and breathing when police arrived. She was taken to Scripps La Jolla Hospital, where she died of her injuries.RELATED: Police identify suspects in deadly Carlsbad stabbing, burglaryBushee and James fled the scene in Gawitt's vehicle, according to police. The vehicle was found in San Marcos and the two were arrested in the 4800 block of Park Drive later Monday.Each has been charged with homicide, burglary, conspiracy, and auto theft. Bushee was also charged with accessory after the fact. James also also charged with torture. The pair was already on probation in San Bernardino for residential burglary.Both defendants pleaded not guilty of all charges.Bail was not set for Bushee or James, as they were determined to be a threat to the community.Both face the death penalty. A readiness hearing is scheduled for March 21, and a preliminary hearing is set for March 27. 1377

CAMP PENDLETON (CNS) - The commander of I Marine Expeditionary Force today relieved from duty the commander of a landing team involved in a training accident that killed nine young servicemen in the ocean near San Clemente Island last summer, the Marine Corps announced. USMC Lt. Gen. Karsten Heckl removed Lt. Col. Michael Regner from his post as commanding officer of Battalion Landing Team, 1st Battalion, 4th Marine Regiment, 15th Marine Expeditionary Unit ``due to a loss in trust and confidence in his ability to command'' following the sinking of an assault amphibious vehicle about 80 miles west of Encinitas.``Although the command investigation (into the accident) has compiled a substantial amount of information and data which formed the basis for Heckl's decision, it is still ongoing as the Marine Corps continues to investigate, assess all relevant information and take appropriate actions,'' I MEF public affairs advised in a prepared statement.The amphibious troop-transport vehicle carrying the Camp Pendleton- based personnel -- seven Marines and a Navy sailor, ranging in age from 18 to 22 -- foundered for unknown reasons about 5:45 p.m. July 30 during a maritime training mission and went down in water nearly 400 feet deep.
