I would ask that you reserve judgment or comment on this case until you actually see the evidence presented by the parties.In the event that you will not, I understand that a person unfamiliar with most of the facts in this case, and a person unfamiliar with the obligations that individuals are under when they give deposition testimony, might perceive Mr. Ryan’s statement as noteworthy. It is not. First, as I doubt you’re aware, Mr. Evans himself has testified – unequivocally and under oath – that Mr. Ryan is not racist and was his friend; so whatever point Mr. Evans is trying to make by leaking deposition testimony to you is undone by his own words. Second, this testimony is not Founders’ defense in this case as you allege. Founders evaluated and decided to terminate Mr. Evans based only on his job performance. Mr. Evans’ poor job performance will be apparent when Founders files its upcoming motion. Third, through this testimony, Mr. Ryan was simply saying that he does not assume anything about individuals’ race or ethnicity unless they tell him that information. While it might be acceptable to speculate about this type of thing in casual conversation, Mr. Ryan was not having a casual conversation. He was under oath when he made these statements. As all deponents are instructed, Mr. Ryan was directed not to guess, assume or speculate in his deposition. This is the reason for his answer.The fact that Mr. Evans is selectively leaking this type of information to you indicates that, unlike Founders, he has no evidence to support his position in this case. PHOENIX, Arizona — A Phoenix-based American Airlines flight attendant was sentenced to five years of probation for taking videos of men and boys using public restrooms. Special Agents with ICE’s Homeland Security Investigations (HSI) say that on December 30, 2017, they detained Gordon Harold Nobriga, 50, as he was trying to leave the country through El Paso, Texas. Officials searched Nobriga's cell phone and found "numerous videos of men and boys using a public restroom." Investigators say the videos appeared they were produced through a 'peephole' in a bathroom stall. When questioned about the videos, Nobriga reportedly told HSI that the videos were produced in a store, but he refused to give the store's location. Since Nobriga is from Phoenix, the phone was sent to the Homeland Security Office in Phoenix where investigators were able to determine that the videos came from a Walmart store in Phoenix. They say surveillance video from the store shows Nobriga entering the bathroom several times over a two-month period and spending hours in the bathroom each time he went in. Investigators were able to identify two victims, a man, and a 14-year-old boy, both who do not know Nobriga. Nobriga was arrested on May 25 at Sky Harbor Airport as he exited a flight. On August 16 of this year, Nobriga pleaded guilty to two counts of attempted voyeurism and was sentenced to five years of supervised probation. Nobriga said he's been a flight attendant with American Airlines for sixteen years. Nobriga allegedly admitted to taking the videos, but he denies any distribution of them. He's was initially charged with 11 counts of voyeurism. American Airlines sent this statement at the time of Nobriga’s arrest: “We take this matter very seriously and have been cooperating with law enforcement throughout their investigation. Since this case is a pending criminal matter, we must refer all questions to Homeland Security Investigations (HSI) and the U.S. Attorney’s Office in Phoenix.” 2070

PINE VALLEY, Calif. (KGTV) - A man suspected of smuggling drugs along Interstate 8 with his teenage son in the car was arrested Friday by U.S. Border Patrol agents in Pine Valley. The 62-year-old unidentified man drove a Honda Accord through the I-8 immigration checkpoint and triggered a Border Patrol canine response, agents said. A secondary inspection turned up anomalies with the car’s battery.Agents said they found four vaccuum-sealed bags that tested positive for characteristics of cocaine. The packages weighed 10 pounds and had a street value of more than 0,000, according to the Border Patrol. The man, a U.S. citizen, was taken into the custody of the Drug Enforcement Administration. His 15-year-old son was turned over to the custody of his aunt. 773

PALA, Calif. (KGTV) -- A family dog missing after a deadly crash in Pauma Valley Friday was reunited with its family after being located by firefighters Sunday.Cal fire said firefighters and the San Diego County Department of Animal Services returned to the scene after the crash in an effort to locate the dog.“After lots of hiking through thick brush, the mission was a success and the family was reunited with their pet,” Cal Fire said.“We're with our community members on some of their worst days...and we'll always be there, doing everything we can help make things better,” the agency continued.The crash happened early Friday morning, killing a mother and injuring her 11-year-old son and his father.Crews responded to the scene of the crash after the vehicle was found overturned on an embankment near State Route 76 between Palomar Mountain and Oceanside.The man and child are expected to recover. 914
