GENEVA -- China on Tuesday got its first judge on the World Trade Organization (WTO)'s highest court, six years after the country joined the Geneva-based body.Zhang YuejiaoChinese lawyer Zhang Yuejiao was formally appointed by the WTO Dispute Settlement Body (DSB) as a member of the seven-person Appellate Body, which issues final rulings in trade disputes, WTO sources said.Jennifer Hillman of the United States, Lilia Bautista of the Philippines and Shotaro Oshima of Japan were also appointed as new members of the top court at a DSB meeting on Tuesday.The appointments were made according to the Dispute Settlement Understanding which stipulates that the Appellate Body shall " comprise persons of recognized authority, with demonstrated expertise in law, international trade and the subject matter of the WTO agreements generally," a WTO statement said.The WTO said Hillman and Bautista would formally join the top court next month, while Zhang and Oshima would join in June. They can serve up to two four-year terms.Zhang, 63, is professor of law at Shantou University in China. She is also an arbitrator on China's International Trade and Economic Arbitration Commission and practises law as a private attorney.Zhang once held positions at the Chinese Ministry of Commerce as well as at the Asian Development Bank.
The newly approved Labor Contract Law will not undermine the investment environment although it will better protect workers' interests and rights, China's top trade union body said yesterday. Liu Jichen, director of the law department at the All-China Federation of Trade Unions, denied that the law - which goes into force from January 1 next year - is biased toward employees. "It not only protects workers' interests and rights, but also equally protects employers'," he told a press conference. The law, passed on Friday by the Standing Committee of the National People's Congress, the top legislature, had raised concerns that stricter contract requirements could raise business costs and give companies less flexibility to hire and fire employees. Liu, however, said that the law takes into account employers' interests. For example, he said, employers can sign non-competition contracts with workers, with a non-competition period of not more than two years to encourage innovation and ensure fair competition. So an employer can rest assured that an employee does not walk out at the end of the contract period and join a direct competitor. It also softens the terms under which employers can cut staff - if an enterprise switches to other production, adopts a major technological innovation or changes its mode of business. Liu stressed that the law will help create a harmonious labor relationship. "Labor protection is a worldwide trend," he said. "With working conditions improved and rights protected, employees will feel more secure, which leads to a higher productivity." Liu pointed out most labor disputes result from violations of workers' rights. Because of the huge supply of labor force, workers are in a disadvantaged position, he said. Liu said the federation has succeeded in keeping most of the items on protecting workers' rights and interests in the law. For example, the law makes mandatory the use of written contracts and strongly discourages fixed- or short-term contracts. It also stipulates severance be paid if a fixed-term contract expires but is not renewed without an appropriate reason. The law requires all employers to submit proposed workplace rules or changes for discussion to the workers' congress - concerning pay, work allotment, hours, insurance, safety, holidays and training. Employers and trade unions will then jointly decide on workplace agreements. It stipulates trade unions have the right to sign collective contracts with employers on behalf of workers. In a position paper released yesterday, the European Chamber of Commerce in China said it welcomes the law and its aim of improving labor conditions and creating workplace harmony. "A more mature legal environment should be considered as an advantage in attracting foreign investment," the statement said. However, the chamber said the key challenge remains compliance by employers and the enforcement by authorities of the existing laws.

China gold futures trading was launched in January, but domestic banks were barred from trading by the China Banking Regulatory Commission. According to the notice, domestic banks that meet certain requirements, such as having capital adequacy ratio of more than 8percent, can apply for a trading permit. "That's great news for the gold futures market, which is not operating that well," said Hu Yuyue, an expert with Beijing Technology and Business University. "Commercial banks can provide more liquidity and stability to the market, after all, they hold huge capital," said Hu. "Gold futures trading can also help domestic banks to improve competitiveness against overseas banks as financial derivatives are supposed to be the largest revenue sources for leading banks," he said. Non-interest income usually accounts for at least 50 percent of bank revenues in developed countries and the proportion can reach 80 percent for some banks. China has sent rescue ships to search for a cargo vessel missing in the East China Sea with 17 Russian crew on board.The China Maritime Search and Rescue Center said on Friday it launched a search and rescue emergency plan soon after a rescue center in Russia's far east informed it of the missing boat on Thursday.The Cambodia-registered ship went missing on its way from Japan to Hong Kong.The vessel failed to arrive in Hong Kong on Thursday as scheduled, and the last radio contact was made with the ship on Sunday, when it was 212 sea miles (391 km) east of Shanghai.Russian rescue officials then informed rescue centers in China, Japan and South Korea of the Captain Uskov's disappearance."Our rescue ships have started searching," Zhai Jiugang, a senior official with China's search and rescue center, said.Vessels sailing in the East China Sea have also been informed by the center's branches in Shandong and Shanghai of the disappearance of the ship, and were asked to assist in the search, he said.The center is also using maritime satellites to help search for the vessel.
