SAN DIEGO (KGTV)- One month after the deadly bluff collapse in Encinitas, the husband of one of the victims is speaking out for the very first time. Dr. Pat Davis is a well-known dentist in the community. He lost his wife, daughter, and sister-in-law in that tragic collapse. Davis says he’s still in a state of healing. But despite the pain of losing his family members, he is now urging local leaders to come up with a plan, so no family has to go through this again. “It’s a terrible thing to experience,” says Davis. “I can’t think of a worse situation that could of happened to me as a family man.”The Davis family was out for a day at the beach back on August 2nd. Davis’ wife Julie, daughter Annie Clave and Sister-in-law Elizabeth Davis were sitting under the cliff when it gave out, killing all three women. “People in my family have been down to Grandview beach a thousand times, over the last 25 years,” says Davis. “We’ve never looked at it as being a place that was really dangerous.”Annie Clave’s friend, Tiffany Rogers, was also at the beach that day. She held back tears describing her three friends. ““Three extraordinary women who had just everything, just beautiful, so beautiful on the inside,” says Rogers. As part of healing, Dr. Davis says his new purpose in life is to find a solution to stabilize the bluffs. He supports options like cutting off some access to the beach, sand replenishment, or putting a barrier wall along the cliffs. Just this past weekend, there have been two more bluff collapses, in Encinitas and Torrey Pines State Beach. A couple of weeks ago, Davis made a passionate plea before the Encinitas City Council to take action. Thursday afternoon, he shared his concerns with Congressman Mike Levin who is fighting to get federal funding to shore up the bluffs. “It’s not a question of if this is going to happen. It’s when it’s going to happen again,” says Davis. “All you have to do is go walk along our beaches up here; you see cliffs that look like they could fall at any time.” 2034

SAN DIEGO (KGTV)-- The special needs teacher accused of having a sexual relationship with a student, pleaded not guilty to 20 felony counts. He also declared he would represent himself in the case. Against the advice of the judge, 49-year-old Juan Carlos Herrera told the courtroom, he will fight this alone. "I would like to represent myself," Herrera said. Relinquishing rights to counsel, the San Diego High school special needs teacher read the 20 felonies for the first time inside the defendant's box. Those charges include having sex, performing other sex acts, and physically and emotionally abusing one student between February 2018 and this March, when she was 15 and 16 years old."They occurred on an almost daily basis," Deputy District Attorney, Jessica Coto said. "They took place in hotels, in his car, and in his classroom." Coto said his ongoing manipulation extended to making threats."The defendant also routinely threatened the victim, that if she told anybody about what was happening, that she would cut off her arms and legs," Coto said. This all came to light on May 5, 2019, when police arrested Herrera at the US-Mexico border. Days prior, the girl's mother found inappropriate messages from Herrera on her daughter's phone.Because of the nature of the charges, and Herrera's second home in Mexico, the prosecution requested million bail. As his own attorney, Herrera fought back, saying he is a Navy veteran with a 25-year clean record with the district."It's not conceivable for someone with my earnings to make million, nor would I flee," Herrera pleaded. "I have been a person of honor and honesty since the beginning."The judge disagreed and kept the bail at million, handing Herrera his first loss, leaving him in utter disbelief.The judge also put a criminal protection order for the now-17-year-old victim. If convicted, Herrera could face a maximum of 16 years eight months in prison. But the prosecution mentioned, more time could be added if they find more evidence of sexual abuse. 2037

San Diego (KGTV)- As Westin Hotel workers fight for better wages, local business owners are fighting to keep business.Hotel workers have been on strike for the past few weeks. Business owners say customers are now avoiding the area and its costing them money.Joey Aiello owns a shoe shine stand that sits outside of The Westin Hotel. He says he’s seen fewer customers this month because of the strike. “People don’t think its a big business but it supports my family,” says Aiello.He says since the workers hit the picket line, he’s lost 00 in business. “The first week they were here I made less than 0 a day. We have to make 0 a day to stay a float.” Other business also say they are concerned about the noise.The San Diego Police Department says they have received six complaints since October 9th. A spokesperson with Marriott International sent us this statement that says in part:“We are disappointed with some of the tactics the union has deployed including the noise levels. We continue to work with local police to address these issues and we are grateful to our guests for their patience during this time.”The Unite Here Union President, Bridgette Browning, says employees are now in negotiations with the hotel. She also sent us a statement that says:“While we are sympathetic to neighboring businesses - we believe the Marriott has the power to fix this strike and the businesses should be demanding that Marriott do the right thing. The workers are not to blame for the low standards that Marriott has created at the Westin San Diego Gaslamp. The workers are prepared to settle as soon as Marriott decides to do the right thing and sign a contract that provides living wages.”For business owner Joey Aiello, he says he won’t be able to make back the money he’s lost. “I just have to work harder and keep everything a float the best I can.” 1869

SAN DIEGO (KGTV)-- Three healthcare-related offices were burglaries early Thursday morning, where criminals got away with cash and prescription pills. At 2:00 am, San Diego Police Officers arrived at the Cos-medic Inc. Plastic Surgery Clinic in Bankers Hill, to find a smashed glass window. They said burglars got away with an unknown amount of money. At 4:15 am, dispatchers sent officers to the Kaiser Permanente Pharmacy in Clairemont Mesa, after the front door was broken in. Nothing was taken. Just 20 minutes later, police said criminals shattered the back glass window at the Carmel Valley Pharmacy. The owners immediately contacted the local Drug Enforcement Administration (DEA) to notify that the burglars took 600 tablets of Adderall, worth up to ,000 in street value. "This is one of the drugs we see that are highly abused by high school and college students...What they perceive to be a study-aid," DEA Special Agent in Charge, Colin Ruane said. The Schedule-2 narcotic often lands in the hands of our youth, which can have deadly consequences. "In this country, we lose 70,000 people who die of drug overdoses every year," Special Agent Ruane said. "This is just another symptom of the major problem and the major addiction issue we have in the country. They wouldn't be stealing these drugs if there wasn't somebody willing to buy them."San Diego police said there appeared to be no connection between the burglary at the plastic surgery office and the others. However, after our inquiry, the Department said they are working with the DEA to look for a possible connection between the two pharmacy burglaries. They are also helping the owners get back on their feet."We will give them suggestions on additional security measures, make sure they are in compliance," Special Agent Ruane said. "Then, use any additional information from this case and others, in working with the San Diego Police Department to try and find these people who committed this burglary and put them in jail."The DEA reminds the community that they can help keep drugs out of the wrong hands by participating in "National Drug Take-Back Day" on October 26, 2019. SAN DIEGO (KGTV)-- Parents, trying to balance working at home, and becoming their children's teachers, are turning to outside help. Many are desperately looking for qualified tutors as families safely go back to school. But we found that the demand for tutors is not matching up with what is currently available.As the start of the distance-learning school year approaches, parents are beginning to feel the pressure."Desperate," parent, Cortney Lemos-Crawford laughed. "Desperate because of my own sanity!"Lemos-Crawford says she and her husband are fortunate to still have their jobs during the pandemic. But it is demanding. Distance learning for their 8-year-old daughter in March was not easy."It's very difficult, as you can imagine, to work full-time and have your child present, let alone present and needing your interaction," she said.She says it was hard for her daughter to concentrate at home, in a relaxing environment, with toys all around. She also does not want her daughter's formative years to suffer because of her own work schedule. So for weeks, she has been searching for a personal tutor.Jamie Evans and her partner Hannah Obradovich are former teachers who now run Ignite Learning Center in La Jolla. They provide K through 12 and Special education support around the county."We have been inundated with parents wanting us to form 'Pandemic pods,' garage groups, working outside, working with small groups with different age children to hire us to be their teachers," Evans said.But Evans says the supply of accredited teachers and tutors are not even close to the recent demand from desperate parents."We are in a rush to hire more teachers," Evans said. "I already talked to three people this morning, and I'm going to an interview right now."Lemos-Crawford says her tutor search so far has come up empty."I've had a couple of leads, but those people have been snatched up," she said.But she is not giving up.
