SAN DIEGO (KGTV) - Inside an MCAS Miramar courtroom Thursday, the military held a preliminary hearing for a Navy corpsman who's charged in connection with the death of a fellow Navy corpsman, HM3 Michael Vincent De Leon. A corpsman is a type of medic.ABC 10News' cameras were not allowed inside, where accused corpsman HM1 Ryan Dini appeared in his military fatigues alongside his private counsel."A cover-up is what I felt [happened] from the get-go," Jose De Leon told ABC 10News just after the hearing. He has suspected a possible cover-up since his 30-year-old son died on the Twentynine Palms military base last year.At Thursday's hearing, the prosecution argued that HM1 Dini should face additional charges related to negligence. He's already charged in part with dereliction of duty resulting in death and drunk and disorderly conduct. HM1 Dini has 19 years of service with the military.The prosecution stated that HM1 Dini and a handful of others service members including Michael were at a house party on-base where alcohol was flowing, and guns were being dry-fired the night of the death.HM1 Dini's defense denied any wrongdoing."[HM1 Dini] being the most senior individual at this going-away party failed to protect not just Michael but everyone there because they were in danger when these firearms came out," said Jose De Leon. He told us in September, "We know that the firearm was dry-fired at Michael. The firearm was put away and it came out again and according to some statements they were horsing around, and the firearm came out again and that's when Michael was killed."He said that the shooting was first called in as a suicide but ABC 10News then learned from a source with close military ties that the death was being investigated as a homicide.A prosecutor named three other service members in the hearing. Their involvement remains unknown.The prosecution told ABC 10News that in about three weeks a judge will determine whether HM1 Dini's charges will be sustained and whether he'll face additional charges.Naval Criminal Investigative Service wrote to ABC 10News on Thursday that the investigation is still open. 2149

SAN DIEGO (KGTV) – Just days into California's new stay-at-home order, many businesses say this time around they won’t comply with restrictions.Some restaurant owners tell ABC 10News they’re not doing it out of defiance, but as a way to survive.“We have to stand up for ourselves. We have to open or else we lose the risk of losing our business entirely,” said Annie Rammel, the owner of Oak + Elixir restaurant in Carlsbad.Rammel said she spent ,000 to have a deck built outside of Oak + Elixir on State Street to provide a safe dining option for patrons.It was going well until she had to shut things down once again this week as COVID-19 cases surged and the state put restrictions on in-person dining were put back in place.“Closed, open, closed, open,” she said. “A lot of us are not doing well; we’re not doing well, the take out and to-go we’re losing money on that.”Rammel and a group of small business owners in Carlsbad and Oceanside decided to reopen for in-person dining Friday and take their chances, including several restaurants in the Carlsbad Village.She said if she stayed closed, her 15 employees would be laid off during an already rough year.“It’s for our employees to put food on their tables; some of them have children that they have to provide for, the holidays are coming, and I’m just not going to do that,” she said.Her patio and additional outdoor sidewalk tables were ready for customers on Friday at 4 p.m. Rammel said she expected to seat approximately 100 customers.Just next door at Caldo Pomodoro, customers were seated outside for lunch Friday.“We’re basically fighting for our lives, and we’ve been here for 29 years, it’s a family-owned and operated restaurant, it’s not that we’re doing anything wrong, we just want to survive,” said Justin Davis, who works as a server at the restaurant. “If we shut down, we’re pretty much not going to open again. SAN DIEGO (KGTV) — Mayor Kevin Faulconer and Jewish leaders celebrated the second night of Hanukkah Monday, lighting the second candle of a massive Menorah outside City Hall.As the second night of the Jewish Festival of Lights got underway, Rabbi Zalman Carlebach said it was important for leaders to show their support and celebrate in light of recent anti-Semetic incidents around the U.S. "In light of the current events that are happening around the country, this world could use some more light.
