SAN DIEGO (KGTV) - Court services are being drastically reduced due to the Covid-19 pandemic, which affects both civil and criminal proceedings. The closure will last until April 3rd.“My fear is that we’re going to have situations where individuals are going to stay in custody longer than what the law permits,” said David P. Shapiro, a criminal defense attorney. “What happens to the individuals who are in custody who have a future court date?”By law, you should have your first court appearance within 48 hours after your arrest. That excludes weekends and holidays, according to a spokesperson with the District Attorney’s Office.“We are in constant meetings with the court and the Public Defender and the Sheriff, our law enforcement partners,” said District Attorney Summer Stephan.Stephan said they have dealt with closures, such as during our past major wildfires. They are working on a system to review criminal cases to see who is suitable for community release.“This is an evolving process, but what we’re trying to do is to maintain due process in the time of crisis,” Stephan said.A Sheriff’s Department spokesperson told 10News they are “working with the District Attorney’s Office and evaluating the impact” the court closures might have.“I was personally hoping they would have an emergency department available through all this just for arraignments, just for in-custody arraignments. SAN DIEGO (KGTV) -- Chula Vista City Councilman Steve Padilla says he's tested positive for COVID-19.Padilla, who represents Chula Vista's District 3, made the announcement in video Saturday that was published on his Facebook page."After recently experiencing symptoms, I was diagnosed as being positive for the COVID-19 virus, also known as the coronavirus," he said.Padilla appeared in good spirits as he told viewers that he was doing "very well" and "feeling well."In a follow up statement, he described having a fever, body aches, headaches, chills, that "came on very rapidly." He noted he had come into contact with friends, colleagues, and the public over the last week."I’m in close coordination with County Public Health officials who are taking all precautions to ensure the health of people I’ve been in contact with," he said.He was recently in Santa Cruz County where he was conducting a hearing as California Coastal Commissioner."I want to remind everyone to keep a safe distance, wash hands, and look out for the elderly most at risk," he said.Padilla has previously served as Mayor of Chula Vista from 2002-2006, and is a former officer and detective with the Chula Vista Police Department. SAN DIEGO (KGTV) — Border Patrol agents arrested five people in connection with a human smuggling incident, including one man convicted of being a sexual predator.A vehicle traveling through a temporary immigration checkpoint in Potrero failed to stop at about 6:30 a.m. Wednesday, according to U.S. Customs and Border Protection, before agents stopped the vehicle several yards past the checkpoint.Agents say five males in the vehicle were questioned. Three passengers in the vehicle's backseat said they were from Mexico but had no U.S. documentation, according to CBP. The driver and front seat passenger claimed to be from the U.S.The driver and front passenger were arrested on suspicion of smuggling and the three other passengers were arrested for being in the U.S. illegally, CBP said. During a records check at a nearby station, agents learned one passenger, a 39-year-old Mexican national, was convicted in 2012 of kidnapping and rape of a minor in San Diego. He was sentenced to a seven-year prison term and removed from the U.S.“I am proud of the great work agents demonstrated in arresting this known child predator,” said Chief Patrol Agent Douglas Harrison. “Their actions help keep our communities safer.”Both U.S. citizens face human smuggling charges and the previously deported Mexican man faces federal charges. SAN DIEGO (KGTV) — Arson investigators Saturday were looking into multiple fires set within a three-mile radius of each other in Ocean Beach and Point Loma.The first fire was set at about 1 a.m. on Muir Ave. in Ocean Beach. Three more fires were set on Piedmont Dr. and Catalina Pl. in the Point Loma area, San Diego Fire-Resuce Department said.No structures were damaged and no injuries were reported. Each fire was set in rubbish behind homes, according to SDFD. Due to the proximity and similarities between the small fires, fire officials said the fires were "suspicious" and arson investigators were looking at whether they were connected.
