SAN DIEGO (KGTV) -- On January 1, it will be legal for businesses to sell pot in California. With that, the questions and concerns about what that means for drivers out on the roads.“I think we will see an increase in DUI marijuana’s,” said Officer John Perdue, a San Diego Police officer in the traffic division.Perdue is an expert at DUI and drug recognition. Since November 8, 2016, when California voters approved Prop. 64, or the adult use of marijuana act, he’s been hearing the same thing when he comes across drivers he suspects are driving high.“Their first reaction is one of two, either A. ‘I have a medical marijuana card’, or B. ‘marijuana is legal.’ And I have to remind them, so is alcohol, but you still can’t drive under the influence of it,” Perdue said.How exactly will police be able to tell if someone is driving high?One tool that officers will use to help is the Drager Drugtest 5000, a presumptive drug screening test that can detect seven types of drugs in a person’s system.Like an alcohol breathalyzer, Perdue said, “the person has every right to refuse this.” But unlike alcohol, it doesn’t have a percent limit.If the Drager reads positive, Perdue said, “it doesn’t necessarily mean they’re impaired or under the influence, it just says that chemical or drug is in their body.”  So to be arrested for DUI, it’s still up to the officer to decide if the driver shows impairment.But that can be tough. Look at the Drager as an extra tool that’s used along with field sobriety tests, what an officer smells, sees or finds in the car, to formulate that officer’s opinion of whether a driver is high.“The hardest thing will be, because there is no per se limit right now, the officers are really going to have to be aware of the signs and symptoms,” Perdue said. 1808

SAN DIEGO (KGTV) – One person is dead following a shooting at a Midway-area adult store, according to police.The shooting happened around 1:45 p.m. on the 3600 block of Midway Drive at Kemper Street, near the back of the Home Depot.When they arrived, authorities found the body of a 65-year-old woman inside the store. The woman had trauma to her upper body, according to police. Police say a preliminary investigation revealed that the woman was reportedly assaulted while inside the business.The possible suspect was described as a white man last seen wearing a navy blue shirt and navy blue pants. SAN DIEGO (KGTV) - Police body-worn cameras captured the parents of Trevor Heitmann pleading with officers to hospitalize their son just hours before he killed himself and two others in a high-speed car crash.In August 2018, Trevor Heitmann, known on his popular YouTube channel as McSkillet, ultimately drove the wrong way down the 805 at speeds over 100 miles per hour before the fatal accident.A lawsuit filed against the City of San Diego claims, police officers failed “to act in accordance with the statute and carry out their mandatory duty,” and as a result, Heitmann, “subsequently and predictably endangered the lives of others and himself and drove his vehicle at speeds in excess of 100 mph, striking Aileen and Aryana Pizarro's vehicle and endangering other members of the public.”The lawsuit goes on to say, “Because he was not evaluated by defendants to determine if he was a danger to himself or others, he was able to carry on with his erratic and mentally unstable behavior, and ultimately colliding head-on with Aileen Lydia Pizarro's vehicle, and thereby, causing fatal injuries to Aileen and Aryana Pizarro." 1137

SAN DIEGO (KGTV) -- Police are searching for a suspect they say choked a clerk before robbing a Mira Mesa 7-Eleven.The robbery happened around 2:10 a.m. Tuesday on the 11000 block of Camino Ruiz near Sandburg Elementary School.Police say the suspect walked into the store and asked the clerk for cigarettes. When the clerk went to get the cigarettes, the suspect choked the clerk unconscious from behind.When the man regained consciousness, he discovered that the suspect stole money and cigarettes from the convenience store.The clerk was uninjured during the robbery.  588

SAN DIEGO (KGTV) -- Neighbors in Scripps Ranch are on edge after a series of break-ins over the course of a week at the beginning of March.Residents in the area reported five break-ins or attempted break-ins to the Scripps Ranch Civic Association's Neighborhood Watch from March 9 to March 16.During one of the burglaries on the 11800 block of Charmaine Way, suspects shattered a sliding glass door and were able to take jewelry and electronics.RELATED: Burglar squeezes past security system, raids homeDuring another break-in, it appears the suspect was unable to get into the home, according to the neighborhood watch.
