SAN DIEGO (KGTV) -- A classic Corvette nearly careened into a family's home Friday night, with a teenager behind the wheel. "Oh yea, we were just on the other side of the wall that she was just inches from hitting," said Tyler Churchill. El Cajon police say the 16-year-old driver was probably driving too fast down the hill."We have a lot of really nice cars that live up the street," Churchill said. "They come flying by all the time."She lost control, ending up with the car backward and on top of some cement blocks.Churchill and his family came running out when they heard the crash."We were all just hanging in the garage," he said. "I was changing a dirt bike tire, we heard a really long screech and a kind of gnarly crash, and we couldn't see anything because it was really dusty."Thankfully, the driver and everyone else made it out okay. "The first thing we did was run out and make sure she was ok," Churchill said. SAN DIEGO (KGTV) - A federal judge has ordered the San Diego Police Department to stop citing people for living in their vehicles.The decision comes after a lawsuit was filed against the city by a group of homeless people and their advocates.On Tuesday, United States District Judge Anthony Battaglia agreed with the plaintiff’s argument that the city’s municipal code was too vague in defining what constitutes habitation of a vehicle.Tristia Bauman, an attorney with the National Law Center on Homelessness & Poverty which helped work on the case told 10News, “we are very happy and pleased that the judge understood what we were arguing.”However, that was only one half of the lawsuit. The other half targeted the city’s municipal ordinance that outlaws RV parking from 2-6a.m. Known as the Nighttime RV Ordinance, or Oversized Vehicle Ordinance (OVO), the judge denied the request to enjoin it, saying the same argument did not apply.In the decision, Battaglia wrote “while the court sympathies that this Ordinance leaves Plaintiffs with nowhere to park between these hours and is decidedly unfair, the law is not ambiguous, unclear or vague in any way.”A spokesperson for city attorney Mara Elliot declined to comment beyond saying they “will review the ruling and advise our client.”An early neutral evaluation conference had been scheduled for Thursday with all the parties. SAN DIEGO (KGTV) — A grieving son is speaking out after COVID-19 claimed its first local VA employee.John Martinez started feeling symptoms in early June. First, it was fatigue. Then came a fever and breathing troubles. His son Josh bought him a device to measure his oxygen levels. In mid-June, Josh's heart dropped when he read the device."His oxygen levels were below 80 and then dropped to 70. We got in our truck, took him straight to the hospital," said Martinez.John, an Army and Navy veteran, was taken to the VA Medical Center in La Jolla where he worked. For more than 15 years, he's maintained biomedical equipment like ventilators.When the pandemic started, he wanted to keep working."It was one of those things. The country needs him, so let's step up," said Martinez.A day after John was admitted, he found himself on one of the ventilators he knew so well. Soon after, his kidneys started to fail. His condition deteriorated quickly. More than a week ago, doctors allowed Martinez to visit."Just told him to fight, to keep fighting. I was crying. Just put my hand to the glass, trying to scream through the glass," said Martinez.Less than 2 days later, his father would pass away. John was set to retire after his birthday in late July, at the age of 63. Martinez isn't sure where his father contracted COVID-19 but other family members believe he got it while working."He wanted that benchmark of 63 to retire. He worked for so long and was looking forward to relaxation," said Martinez.Josh says he can only shake his head at the ongoing mask debate, and those who refuse to wear one."It's all good. Just put on your mask. SAN DIEGO (KGTV) -- A 63-year-old man was shot several times during an argument in San Diego’s Jamacha-Lomita neighborhood Friday afternoon.Police say the shooting happened on the 7900 block of Gribble Street just before 4 p.m.According to police, the victim and suspect got into an argument when the 63-year-old was shot three times. The man was taken to the hospital with non-life threatening injuries. SAN DIEGO (KGTV) -- A family’s trip to the pumpkin patch goes sour when thieves went picking through their car while they were picking out their pumpkins.Fay Feltman, her daughter, her granddaughter and great grandson went to the pumpkin patch located off Mission Gorge in Grantville.Because of how busy the lot was, they struggled to find an open space. She tells 10 News her daughter ran to the car to find the window smashed and the purse stolen right from the trunk of the car.Feltman says her and her family were only in the patch for about 30 minutes.
