San Diego (KGTV) - Thousands of kids across California approved for in-home nursing care are struggling to get the help they desperately need.On Thursday two children filed a class-action lawsuit against the California Department of Health Care Services and its director claiming the state has failed to fulfill its commitment to provide them with sufficient Medi-Cal in-home nursing services.It says, “this class action lawsuit asks the Court to order Defendants to take all steps necessary to arrange for previously-approved, medically necessary in-home shift nursing services for Plaintiffs and Class members.”According to the lawsuit plaintiff, Ivory N. is a seven-year-old and a Medi-Cal beneficiary. It says the child needs 63 hours per week of skilled nursing at home but only receives about 56 hours per week.The non-profit group, Disability Rights California, says more than 4,000 Medi-Cal eligible children have been approved by the state to receive Medi-Cal in-home nursing care, but the state lacks an effective system for arranging for needed nursing."It’s too bad that a lawsuit had to be filed, but they are right to file it because right now that need is not being met,” said California State Assemblyman Brian Maienschein.In 2017 Maienschein tried to get the problem fixed through legislation. He believes the state is not following through on its promises to the kids.“It was a significant victory last year that we were able to get money in the budget, but they are still not following through on the promises they made,” he said.According to a news release from Disability Rights California, “29 percent of authorized Medi-Cal nursing hours go unstaffed.” 1693

SAN DIEGO (KGTV)— A Point Loma boy must now walk to and from school after a thief stole his custom BMX bike. San Diego Police need the public's help to find the man who took the boy's prized possession. BMX riding is 9-year-old Bradley Ramos' favorite pastime. It's a passion that runs in the family. His father, Aaron, dabbled it in as a child. So did Bradley's cousin, Tyler."This bike was actually his cousin's bike when his cousin was his age. Now his cousin is 21 years old, so the bike has been in the family for a while," Ramos said. That was, until Memorial Day morning. Bradley's mother noticed the bike was missing from their front porch."My bike and my helmet got stolen," Bradley said. The family's security camera captured a man walking away with Bradley's bike. The video shows the young man with arm tattoos wearing a hat and backpack. He looks to be wearing glasses and a distinctive white watch."It kind of sucks because I have to get rides to school now when usually, I'd ride my bike and it's way quicker," Bradley said. The bike theft is the second in as many weeks for the Ramos family. Last Monday, thieves made off with at least ,500 worth of tools from Ramos' work truck. "Since that's been happening, we've been bringing the bike in, and we didn't do it just that one night, and it was gone," Ramos said. The BMX bike has thin red wheels with a racing number plate in the front handlebars. It's not a common model, so the Ramos family is asking people to keep an eye out, and alert authorities if they spot it. To the man who made off with the Ramos' family heirloom, Bradley and his father have a stern message. "Give it back, and never come back to this neighborhood again," Bradley said. SAN DIEGO (KGTV) -- Morrissey was attacked Saturday night while performing at a concert in San Diego, TMZ reports.The incident happened at San Diego Symphony Hall as the singer prepared for an encore. A concertgoer who rushed onto the stage hit Morrissey, according to TMZ.Seconds later, the singer was ushered off the stage by security at the concert.Video posted on Twitter appears to show more attendees rush onto the stage to fight after the incident.Watch the video below: 490

  

SAN DIEGO (KGTV) - Uber has filed paperwork with the FAA to start testing drones in San Diego for food delivery.The petition seeks a series of exemptions that would allow Uber to use drones to transport food in the city of San Diego.The FAA recently granted its first air carrier certification to a drone company, Wing Aviation, which will begin testing in Blacksburg, Virginia.In Uber’s application, it said it would be using the AirRobot 200 drone, a hexa-copter which is larger than typical drones used by videographers.It says the drones would not fly higher than 400 feet and have a range of 3.5 miles.There is currently a public comment period on the FAA’s website.An FAA spokesperson told 10News, “we will thoroughly evaluate all comments we receive, as well as the petitioner’s proposal and associated safety measures, before making a decision.”Uber declined to comment for this story. 901
