San Diego (KGTV) - Thousands of kids across California approved for in-home nursing care are struggling to get the help they desperately need.On Thursday two children filed a class-action lawsuit against the California Department of Health Care Services and its director claiming the state has failed to fulfill its commitment to provide them with sufficient Medi-Cal in-home nursing services.It says, “this class action lawsuit asks the Court to order Defendants to take all steps necessary to arrange for previously-approved, medically necessary in-home shift nursing services for Plaintiffs and Class members.”According to the lawsuit plaintiff, Ivory N. is a seven-year-old and a Medi-Cal beneficiary. It says the child needs 63 hours per week of skilled nursing at home but only receives about 56 hours per week.The non-profit group, Disability Rights California, says more than 4,000 Medi-Cal eligible children have been approved by the state to receive Medi-Cal in-home nursing care, but the state lacks an effective system for arranging for needed nursing."It’s too bad that a lawsuit had to be filed, but they are right to file it because right now that need is not being met,” said California State Assemblyman Brian Maienschein.In 2017 Maienschein tried to get the problem fixed through legislation. He believes the state is not following through on its promises to the kids.“It was a significant victory last year that we were able to get money in the budget, but they are still not following through on the promises they made,” he said.According to a news release from Disability Rights California, “29 percent of authorized Medi-Cal nursing hours go unstaffed.” 1693

SAN DIEGO (KGTV) - With the cost of living going up in San Diego, a lot of people are looking for ways to make extra cash. A new startup in San Diego called Bounce wants to help drivers maximize their income. "The drivers are the most important element," said CEO Mark Potter. Potter transformed the front of his law office into the startup space. He is a longtime fan of rideshare. "Before there was rideshare, I was hiring people off craigslist to give me rides," Potter said.His model for this new company is to focus on the driver and give them more incentives to want to stay and work for the company. "Our drivers are owners. They earn ownership in our company through stock options," said Potter. This stake in the company is one of the main reasons Pamela Bernier signed on to be a driver. Bernier said, "Working my own hours, calling my own shots, still enjoying the income and the people at the same time."Bounce also has a repeat customer option. Riders have the freedom to create a list and request their favorite drivers. They also have the luxury to arrange future rides in advance.  According to the company, this provides a safer environment for both the rider and driver and also gives the driver a more consistent cash flow. "I could bounce you here, I can bounce you there, I bounce you home, where you wanna bounce let's go," said Bernier. Uber and Lyft are two other companies dominating the rideshare space. According to Lyft, 68% of drivers are primary earners of their household, and so far in 2018, Lyft passengers also spent an additional million on local businesses in town. According to Uber, rideshare and delivery drivers in California took home more than .97 billion in gross revenue for 2017. Bounce is set for a September launch, and the company is currently interviewing drivers. They require in-person interviews and background checks for each driver. They are also in the process of putting in a panic button option in the app for riders to feel safer during their ride. "We envision is that our company will be very successful with loyal drivers that put Bounce first. That will make us win," Potter said.  2247

San Diego (KGTV)- Another section of the bluff has collapsed in Encinitas. This comes almost exactly one year after the deadly collapse that killed three women on the beach.Large mounds of rock sit at the foot of the cliffs on Stonesteps Beach, in Encinitas, after the bluffs gave way early Sunday morning. Lifeguard Captain Larry Giles tells ABC 10News the collapse stretches 40 feet along the beach.The block failure sits just over a mile and a half from Grandview Beach in Encinitas. Julie Davis, her daughter Annie Clave and sister Elizabeth Charles were tragically killed at the site a year ago after the bluffs came crashing down.10News spoke with Davis' husband, Dr. Pat Davis, last week on the anniversary of the collapse. He says more needs to be done to keep Encinitas beach-goers safe."There's very few new signs warning people about these cliffs," says Davis. "There's very little coordination by the lifeguard service to warn people about how dangerous these cliffs are."Lifeguard Captain Larry Giles says no one was hurt in this weekend's collapse. The block failure was caused by natural erosion.Giles says there is a small area on the cliff that is still causing some concern. Lifeguards and the City of Encinitas are monitoring the area.Dr. Pat Davis says that as his family mourns the loss of their loved ones, he can't help but think about beach-goers."I think we're looking at a situation where what happened to my family could easily happen again."Davis has been working with local and state leaders to stabilize the bluffs. He hopes a new bill will help. It offers solutions like sand replenishment. That bill is currently moving through the state Senate. 1685

  

SAN DIEGO (KGTV) — Whether or not the Padres head to the World Series, Petco Park may still see playoff baseball this season.Under a plan by the MLB, a neutral-site playoff format with teams living in a "bubble" may be finalized next week, though it is awaiting approval by the Players Association, according to ESPN.The plan states that playoffs would start with the top four seeds in the AL and NL hosting all the games in a best-of-three wild-card series: the AL games between Sept. 29 and Oct. 1 and the NL games between Sept. 30 and Oct. 2.The highest AL seed would be the home team for the division series at Petco Park in San Diego, while the other series heads to Dodger Stadium in Los Angeles. The AL championship series would then be played at Petco Park.On the NL side, the top seed into the division series would play at Globe Life Field in Arlington, Texas, and the next-highest seed would play at Minute Maid Park in Houston. The NL championship series would be hosted in Arlington.The MLB's reported plan would begin the World Series on Oct. 20 at Arlington and end no later than Oct. 28.ESPN reports that the Players Association is considering concerns from players who have lived outside of the bubble format, similar to how the NBA has operated this season, with the ability to be around family and friends. SAN DIEGO (KGTV) — While San Diego's Big Bay Boom and other popular fireworks shows are canceled this year, there are a handful of drive-in style events happening this weekend.In Vista, Poway, El Cajon, and Santee, fireworks displays are being hosted with social distancing in mind. Some of the shows require a ticket purchase to get prime viewing in a physical distancing atmosphere, or viewers can find street parking where allowed.Those who live nearby only need to look out their window!Fireworks displays have been canceled throughout much of California to limit gatherings and curb the spread of COVID-19. At any shows still being held, officials urge viewers to wear facial coverings and social distance around non-household members. Consumer fireworks are illegal in San Diego County and anyone caught using them could face fines or jail time.North CountyVista: Fireworks will be hosted at Brengle Terrace Park starting at 9 p.m. on Saturday. While the park is closed to pedestrians, drivers can purchase tickets to enter and socially distance with lawn chairs and blankets. Music will accompany the show on Star 94.1. More infoPoway: Two simultaneous fireworks shows will be held in Poway on Saturday starting at 9 p.m. One display will be hosts at Poway High School while the other will be held at Sportsplex in the South Poway Business Park.
