SAN DIEGO (KGTV) -- San Diego City Attorney Mara W. Elliott has heard complaints from neighbors and has filed a civil enforcement action to shut down a short-term vacation rental property in La Jolla that has been dubbed a "COVID party mansion."The complaint alleges that defendants are maintaining a public nuisance and engaging in unfair competition, including false advertising at the La Jolla Farms rental property located at 9660 Black Gold Rd. According to city officials, the rental property continues to operate in violation of state and county COVID-19 public health orders.According to a press release, Elliott is seeking civil penalties and a permanent injunction against property owners Mousa Hussain Mushkor and Zahra Ali Kasim, property manager Nital Meshkoor, and Steven S. Barbarich, who leased the property from Mushkor and subleased it as a short-term rental.City officials said the oceanfront mansion has been the subject of at least 30 calls to the San Diego Police Department. Officers have spent more than 173 hours at the property to investigate nuisance activity. Most of the incidents involved raucous parties, some of which had up to 300 attendees.Elliott said about a dozen of the party complaints came during the COVID-19 pandemic, while public health orders prohibited large gatherings.According to the press release, concerns about the property were brought to the City Attorney’s Office by San Diego police and by neighbors who reported that the situation was "becoming more pronounced as the COVID-19 pandemic progressed." “Shutting down dangerous party houses protects the public health by preventing COVID super-spreader events and other illegal behavior,” Elliott said. “It’s unfortunate that San Diego does not have short term rental regulations in place. Relief for this neighborhood would have come much sooner. Instead we must rely on time-intensive prosecutions at significant taxpayer expense.”According to the press release, gunfire was reported to police during a party in May of 2019. Officers arrived and found a large party in progress. Partygoers questioned by police admitted gunshots were fired during a fight that had occurred earlier. Police found shell casings outside the property and a neighbor found an additional casing the next day and turned it over to police. The City Attorney's Office assembled evidence from investigations by SDPD, the Code Enforcement Division of the City’s Development Services Department, the County Health & Human Services Department, and the City Fire Marshal. SAN DIEGO (KGTV) -- San Diego Police made six DUI arrests during a downtown checkpoint Saturday night. The checkpoint was conducted on the 1400 block of G Street between 11 p.m. Saturday and 3 a.m. Sunday. In total, 1,765 vehicles drove through the checkpoint and 526 were screened. Six drivers were arrested on suspicion of driving under the influence of alcohol. Meanwhile, two drivers were cited or arrested for operating a vehicle without a license. Two citations were also issued for unspecified reasons at the checkpoint. “The San Diego Police Department will be conducting another DUI/Drivers License Checkpoint or DUI saturation patrol on March 15, 2020, in our ongoing commitment to lowering deaths and injuries upon our streets and highways,” police said in a news release. 792

SAN DIEGO (KGTV) — Restaurants up and down 5th Avenue in the Gaslamp District are gearing up for yet another three days of crowded on-street dining.This upcoming weekend will see 24 eateries offering service on the asphalt, up from the original eight that participating during the launch on June 18. But as they bask in the opportunity, restaurants on surrounding streets are asking - what about them?"It's a ghost town, especially at night," said Patrizia Bronchi, who owns Operacaffe on Fourth Avenue. "I'm really scared to have to close the restaurant because it's not possible to go on like this."Bronchi says revenue at Operacaffe is down more than 70 percent. She depends on crowds from the Balboa Theater across the street and visitors to hotels and conventions. All of that is nonexistent amid the Coronavirus outbreak.Bronchi says she is happy that 5th Avenue restaurants are seeing the increased business, but that the crowds are not spilling over onto 4th Avenue. Michael Trimble, who heads the Gaslamp Quarter Association, says the group cannot also close 4th and 6th Avenues due to traffic concerns.However, he said the association wants to help with new marketing, decorative lighting and parklets - such as replacing some parking spaces with permanent outdoor dining areas. "We really are trying to do what we can to support all of the merchants in the Gaslamp Quarter," he said. SAN DIEGO (KGTV) - San Diego Police announced Tuesday the arrest of a man suspected of sexually assaulting an elderly woman in a nursing home in Hillcrest. Detectives took Lusean Arline, 48, into custody Monday for the crime which occurred Oct. 27. Police did not release the name of the nursing home, but administrators with Balboa Nursing and Rehabilitation Center confirmed with 10News the attack happened in their facility.Police said the 88-year-old victim was inside the nursing home when Arline illegally entered the facility. He sexually assaulted the woman, who was in her bed, officers said. San Diego Police Sex Crimes Unit investigators collected evidence at the scene, including male DNA which was processed by the Crime Lab and loaded into the Combined DNA Index System (CODIS).
