(KGTV) — California voters have rejected a measure that would reinstate affirmative action based on race and gender.Proposition 16 would have ended the ban on affirmative action, allowing state and local entities to consider race, sex, color, ethnicity, and national origin in public education, public employment, and public contracting — to the extent allowed under federal and state law.Californians voted against the measure 56% to 44%, with 72% of precincts reporting.Critics of the proposition pointed to a previous prop, Prop 209, as to why Californians should vote against it.“The state shall not discriminate against, or grant preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin, in the operation of public employment, public education, and public contracting,” opposition stated in reference to a passage from Prop 209. 899

(KGTV) - A North County lawyer, once charged with possessing child pornography and secretly filming women at a local tanning salon, is allowed to practice law again.A woman who contacted Team 10 said several North County residents are concerned he could be back in the community working as an attorney. David Kaye faced two felonies and nine misdemeanors in early 2011. Investigators say he filmed women without their knowledge at an Escondido tanning salon. After a customer saw the recording device, police set up a sting operation and Kaye was arrested after an investigation that lasted several months.Kaye entered a plea deal and pleaded guilty to two counts of secretly filming a person and two counts of peeking through a hole or private area. He received three years of formal probation. His law license was suspended in 2014.In the last few months, he got his license back. In documents filed with the state bar court, it said Kaye petitioned five times for his suspension to be lifted. It cited a list of community service and other charitable work with no further arrests. When questioned about his license being reinstated, Kaye wrote to Team 10: “… I don’t practice at all and I am retired with no intention of practicing again.” He said he fought to get his law license reinstated because he “did not want to spend the rest of [his] life wearing the scarlet letter of being a suspended or disbarred attorney after 20 years of practice.” He added that he did everything he could to “follow the state bar requirements to resume [his] status as an attorney in good standing.” Kaye said he wants to move on with his life and spends most of his free time doing volunteer work. (CNN) - The maker of Taytulla birth-control treatment issued a nationwide recall in the United States on Tuesday over concerns that misplaced capsules in pill packs could cause unintended pregnancies.A physician reported that four placebo capsules were packaged in the wrong order where active capsules should have been, drugmaker Allergan said in a statement.The physician sample pack should have 24 pink capsules with hormones followed by four maroon capsules without hormones, Allergan said. Instead, the faulty pack had four maroon placebos at the start of the treatment."As a result of this packaging error, oral contraceptive capsules that are taken out of sequence may place the user at risk for contraceptive failure and unintended pregnancy," the statement said."The reversing of the order may not be apparent to either new users or previous users of the product, increasing the likelihood of taking the capsules out of order."Allergan said it is arranging for return of all sample pack products with the lot #5620706 Exp. May 2019. The drug maker urged patients to consult their physicians if they think they are affected by the recall. 1159
