SAN DIEGO (KGTV) -- First responders late Sunday morning rescued a man from sunset cliffs they say was intoxicated and naked. San Diego Fire-Rescue was called to No Surf Beach near Hill Street just before 11 to perform the rescue. According to the department, the man was exploring down by the water when waves picked up. Onlookers could be heard cheering as the man was lifted to safety atop the cliffs. Onlookers cheer as first responders rescue a naked man from Sunset Cliffs. SAN DIEGO (KGTV) -- Five locations of the San Diego County YMCA reopened today. They include Dan McKinney, Jackie Robinson, Magdalena Ecke, McGrath Family, and the Mission Valley branches.But with ever-changing rules by the State and County, staff and members of the YMCA understand that this reopening may be short-lived.Twice a day, Doug Harrigan would come to the Mission Valley YMCA. But since the COVID-19 quarantine began, he switched to working out at home."It's been rough," Harrigan said.Now he's back."I had a chance to talk to the members that I used to see on a regular basis, and it just felt good to do a real workout in a gym rather than my living room."Starting July 1, 2020, Mission Valley, Dan McKinney (La Jolla), Jackie Robinson (Mt. Hope), Magdalena Ecke (Encinitas), and McGrath Family (Spring Valley) YMCA branches are open, at a modified capacity."Masks required, health check stations, signage everywhere, and we've separated the fitness equipment to the 6-foot social distancing requirements," Assistant Executive Director of the Mission Valley YMCA, Jason Milosh said.At this point, group exercise classes and pools remain closed.Last week, some branches, including Mission Valley, opened up its Kids Day Camps. This year, space is extremely limited due to social distancing rules, and there will not be any field trips. But parents are happy that they are keeping busy."Summer learning loss has been aggravated by the challenges that our school system has had in the last few months of school," Molish said. "So, we have incorporated some more academic components to our summer camps to help kids bridge that summer learning loss."But with the State and County coming out with new rules, seemingly every week, gyms and community centers like the YMCA, must be flexible."Re-closing is a possibility, and we are prepared for that," Milosh said. "We feel good about the precautions that we have taken, but if things worsen and it is determined that we need to close, then we are going to be prepared to do that."But for Harrigan, he hopes it does not come down to that, because with the YMCA, he says he would look and feel much different."It is essential. SAN DIEGO (KGTV) - Hundreds of criminal cases are being examined and reviewed to make sure prosecutors got the right result. That mission is part of the San Diego County District Attorney’s Conviction Review Unit. The unit has been around for about two and a half years, but there are new visible results of its work.Investigators say Donnell Fulcher shot and killed Roberto Rodriguez shortly after midnight on September 10, 2006.Rodriguez’s pregnant girlfriend was wounded but survived. According to court records, investigators connected Fulcher to the scene in part through DNA evidence found on a glove. Fulcher has always maintained his innocence. “We argued that he was not involved at all,” said his defense attorney, Knut Johnson. “There was also in my view, evidence of some other people who are very likely candidates for people who might have committed this crime.”Because of changes in the way DNA is now analyzed, Fulcher got what most defendants will never see—a chance at a new trial.“The prosecutor’s role is to ensure justice before, during, and after trial. This unit is just another way we can fulfill that mission,” said Bryn Kirvin, the deputy district attorney who leads the conviction review unit. Part of their efforts went into looking at all cases where there could be DNA mixtures, meaning more than one DNA profile in a sample.That’s because guidelines by SWGDAM (Scientific Working Group on DNA Analysis Methods) changed the way they interpreted DNA. “They decided [they wanted] to take a more conservative, a more cautious view when analyzing low-level mixtures,” Kirvin said.According to the District Attorney’s office, approximately 1,525 defendants were tried to jury verdict between 2003 to 2016 for serious or violent crimes. Most did not involve DNA, but in 351 cases, DNA was used at trial.Of those, 254 defendants’ cases involved mixtures. That included Fulcher’s case. Team 10 was in court on October 29th when Fulcher chose to plead guilty to voluntary manslaughter and assault with a firearm, instead of going through another trial.The judge sentence Fulcher to 14 years, but he received credit for time already served. He has since been released.Prosecutors with the unit did not talk specifically about Fulcher, but emphasized their mission of finding justice. “Anything about the case that gives us doubt that we lose our confidence in the conviction, we shouldn’t be afraid to act. We should be running to the courthouse to act,” said Deputy DA Brent Neck who also works with the conviction review unit.In Fulcher’s case, prosecutor Hector Jimenez still believes they got the right individual. “We still believe that we have the right guy, but we lost confidence in the conviction, so we wanted to give the defendant a chance to have a new trial if he wanted,” he told Team 10 on October 29.“He chose to plead guilty instead, so at the end of the day, I believe justice was done.” Anyone can apply to get a conviction reviewed, but there are guidelines.The conviction must have happened in San Diego County Superior Court, the person must still be in custody, and the conviction must be for a violent or serious felony.There must also be some type of credible evidence of innocence. “It doesn’t matter how old the case is. We’re going to be willing to go back and look and make sure that we got it right,” Kirvin said.  3412

SAN DIEGO (KGTV) -- Despite carefully measured protocols for distance learning and on-campus housing, San Diego State University is continuing to see new cases of coronavirus among students.SDSU ended its first week of the fall semester Friday announcing three new cases of COVID-19. Since the start of the 2020-21 school year, SDSU has reported seven positive cases.The unidentified students all live off-campus and were only on campus to seek testing at the Student Health Services Outdoor COVID-19 Test Collection Booth, university officials said. The three students did not interact with any SDSU employees or spaces outside of the SHS, according to officials."We have quickly identified and are speaking with the individuals known to have been in direct contact with these students. All are following established public health protocols for isolation and quarantine, and exposure risk to others on campus is deemed low," said Libby Skiles, Ed.D., SDSU Student Health Services Director.RELATED: SDSU begins 2020-21 school year with mostly virtual classesOfficials said that two of the three students are connected to one of the student cases confirmed Thursday. The third new case is linked to another case confirmed Wednesday."It is important to clarify that the three cases [confirmed Friday], together, are not all connected," said Skiles. "Further, due to their connection to previously reported positive cases, all of these individuals were already quarantining in compliance with public health guidelines."The campus opened this week to strict safety guidelines and almost all online classes in their effort to prevent the spread of coronavirus. The campus slashed available on-campus dorms to less than 50%, fraternities imposed their own bans on social events, and fall sports were postponed.San Diego State: Two students test positive for COVID-19; Risk to campus 'low'However, the campus isn't completely closed to students. In addition to the 2,600 students living on-campus, hundreds more students are likely to visit the campus for certain matters over the course of the semester.According to a university spokesperson, officials have administered 171 COVID-19 tests between Aug. 11 and Aug. 27, and have confirmed 7 positive tests.Since the start of fall 2020 classes, on August 24, the average number of tests administered per day is 36, according to the spokesperson. 2395
