SAN DIEGO (AP and CNS) — A white Christmas was in store for parts of California with wet weather elsewhere in the state that could mean dangerous driving conditions and possible power outages."A storm system is coming and after about 10 p.m. tonight, we'll begin having scattered showers that will continue through the day on Christmas," NWS forecaster Samantha Connolly said of the San Diego impact. "The storm system will bring cooler temperatures through tomorrow, and snow above 5,000 feet."Connolly said temperatures will drop into the high 50s to 60s in most of San Diego on Christmas day. SAN DIEGO (AP) — A military judge on Monday took the rare step of removing a prosecutor accused of misconduct from the war crimes case of a decorated Navy SEAL.Capt. Aaron Rugh ordered Cmdr. Christopher Czaplak removed from the case of Operations Chief Edward Gallagher after defense lawyers accused the prosecution of spying on their emails, according to the ruling.The defense asked Rugh to dismiss the case or remove prosecutors because of a surreptitious effort to track defense emails without court approval in an effort to find the source of news leaks.Rugh said it was not in his power to determine prosecutorial misconduct, but there was the possibility of a conflict of interest that required Czaplak to be removed, the ruling said.Rugh has not yet ruled on whether to dismiss murder and attempted murder counts against Gallagher.Last week, Rugh unexpectedly released Gallagher from custody as a remedy for interference by prosecutors.The removal could delay the trial scheduled to start June 10.Republicans in Congress have rallied in support of Gallagher, saying he has been mistreated. SAN DIEGO — A growing number of restaurants in San Diego want to wall off the parking spots outside their front doors and replace them with tables.The concept is called a Parklet, and the city of San Diego appears to be ready to embrace it - at least until social distancing mandates lift. "It's San Diego. We're getting the most beautiful weather of the year. Let us have some seats out there. Let us have some tables," said Merritte Powell, who owns La Puerta restaurant on 4th Avenue. Powell is readying an application to the city that would allow him to build on a curbside section of the street in front of his restaurant and put more seating. He says it's key to survive amid social distancing restrictions, which have limited his capacity. In fact, La Puerta even with hourlong waits still only pulls in 50 percent of the revenue it would have made before the Coronavirus outbreak. On bad days, revenue drops by as much as 70 percent. "Because of the way the seating is, because of the social distancing, stuff like that, I'm nowhere near where I need to be," Powell said. On July 7, the City Council will consider an urgency ordinance that would waive some fees for Parklets and help streamline their construction. Restaurants from downtown, Little Italy and North Park are all readying applications. Gavin Newsom ordered that flags at the state Capitol be flown at half-staff Tuesday in honor of the eight Marines and one Navy sailor who died when an amphibious assault vehicle sank during a training mission last week near San Clemente Island."Jennifer and I were heartbroken to learn of the loss of nine service members in an accident off San Clemente Island," Newsom said in a statement. "It is a painful reminder of the sacrifice of members of our armed forces, who put their lives on the line for us. We stand united in mourning with their families and fellow Marines and sailors."The amphibious troop-transport vehicle was en route to a waiting ship about 80 miles off the coast of Encinitas about 5:45 p.m. last Thursday when it started taking on water for unknown reasons, according to Lt. Gen. Joseph Osterman, commanding general of 1st MEF.Seven members of the Camp Pendleton-based crew survived the accident. Medics took two of them to Scripps Memorial Hospital La Jolla, where both were admitted in critical status.
