AUSTIN, Texas — A Texas sheriff has been indicted on charges accusing him of destroying or concealing video in an investigation into the death in custody of a Black man, Javier Ambler, that was filmed by the police reality TV series “Live PD.”Williamson County Sheriff Robert Chody was booked into his jail Monday on a ,000 bond and released a short time later. The sheriff’s charge is a third-degree felony that is punishable by up to 10 years in prison.Williamson County prosecutors have been investigating possible evidence tampering following Ambler’s death in March 2019.The county's sheriff’s deputies repeatedly used stun guns on the 40-year-old man, despite his pleas that he was sick and couldn’t breathe.A report obtained by The Associated Press shows Ambler’s death was ruled a homicide and noted it could have been “justifiable.” An autopsy showed the man died of congestive heart failure and hypertensive cardiovascular disease associated with morbid obesity “in combination with forcible restraint."Body-cam video of the deadly incident has surfaced, but another that was shot by “Live PD” crews has been destroyed.A&E, which aired the now-canceled show, has said it didn’t keep the footage after it was informed that the initial investigation into Ambler’s death had closed. The network also has said it wasn’t “asked for the footage or an interview by investigators from law enforcement or the District Attorney’s office.”Court records obtained by The AP show Chody is accused of destroying or concealing recordings “with intent to impair their ability as evidence in the investigation” of Ambler’s death.Chody denies ever tampering with evidence and has accused prosecutors of bringing the case to a grand jury for political reasons. 1765

The board recently called on DOT to issue new safety rules after its investigation of a May 2016 fatal crash of a Tesla Model S operating on autopilot near Williston, Fla. The Tesla slammed into a tractor-trailer, its cameras and automatic emergency braking system failing to spot the blank side of the truck against the white sky.It was the first known deadly wreck of a car driving with that level of automated sophistication. The NTSB said the driver relied too heavily on the car’s traffic-aware cruise control system and autosteering feature, but also blamed Tesla’s autopilot for allowing the driver to not interact with the car for prolonged periods of time.Investigators found the driver had his hands on the wheel for only 25 seconds during the 37 minutes the car was on autopilot. After the crash, Tesla updated its software that requires drivers touch the wheel every so often when the car is driving itself to ensure a human is paying attention to the road. Now if a driver repeatedly fails to touch the wheel, he or she will “strike out” and cause the car to slow down and stop in its lane with its hazard lights on, disabling autopilot for the remainder of the trip. 2378

As the holiday shopping season kicks off this week, the Better Business Bureau is warning consumers about a new scam surrounding pricey gaming consoles.According to a news release, with the PlayStation 5 and other gaming devices in high demand, fake deals are appearing on the internet showing the systems at a reduced price.The scam reportedly works by showing a deal on a lesser-known website that has positive reviews, convincing customers to make a purchase via Paypal or another form of payment.According to the BBB, if you receive a package at all from the website or company, it won't be that coveted PS5 or Xbox Series X, but instead will be an item of little value."Since you technically received a shipment, you will be unable to contest the purchase with the third-party who processed the payment," the BBB said.One consumer who fell for a scam said they were unable to get in touch with the website they purchased their item from.“I attempted to reach out to the email address on their website, however I received an email informing me that it was not a valid email address. I then attempted to call the phone number listed on the website, [which gave me] an automatic message informing me that the number was not valid.”The BBB says to do these three things before buying a pricey console:Research the company you plan to purchase from thoroughly. It’s best to purchase items from sellers you already know and trust, but if you decide to purchase from an unfamiliar online store, do your homework first. Read as many customer reviews as you can find, look up the business on org, and do an online search with the company’s name followed by the word “scam” to see if you find any complaints. Make sure the company has legitimate customer service contact information (not just a form you have to fill out and hope for a response) and clear return and refund policies as well.Avoid impulse buying. Scammers like to draw people in with “flash sales” and “limited time offers” in hopes you will hand over your money on impulse. Resist the urge.Don’t believe prices that are too good to be true. Before you start shopping, find out the price of the gaming console at a major retailer. You can check prices online to get a general idea of what the console is selling for. Keep that price in mind as you shop and be wary of sellers who offer the product at a steeply discounted price. As new wildfires force tens of thousands of people out of their homes, reports are emerging of flaws in emergency alert systems throughout the west."Where I think the false sense of security was, if something really bad is going to happen, we'll get alerted well beforehand," said Vacaville resident, Will Carlson.Carlson and several of his neighbors say they received no warnings as the Hennessey Fire inched closer to their homes. At around midnight, Carlson saw the flames moving quickly down a hill in the distance. Carlson was one of the last to leave, working frantically to help save animals on the property."What I remember is this sinking feeling in my stomach, and this helplessness that this barn is going to go up in flames, and the horses will be burned alive," said Carlson.After making it out safely, Carlson was left wondering how this could have happened. "Every neighbor that we talked to it was the same story, we knew there was a fire in the area, we thought that we would get alerted, and nothing was said to us," said Carlson. Le'Ron Cummings, public information officer for the Solano County Sheriff's Office, says alerts went out to these areas. However, they cannot guarantee the targeted population will get the message if cell service, internet, or landline signals are impacted. He says it was determined that cellular services and power were affected by the fire.Solano County uses the Everbridge platform to alert residents via the AlertSolano program, delivering Amber Alert-style messages. Cummings says during an evacuation, the Solano County Sheriff's Office and allied law agencies do door-to-door notifications in addition to AlertSolano messaging. The Sheriff's office also uses the High-Low Siren system familiar in Europe to advise residents to evacuate immediately.Carlson says he is frustrated with the response because he believes he had full cellular service throughout the night, texting and posting to social media as he evacuated. "So I think that's where the frustration came in from that night. How many animals could have been saved? Could there have been less loss of life? And could structures have been defended better if we had more warning?" said Carlson. Carlson says two people in his neighborhood died in the fire; however, county officials say they have no reason to believe the alert system was associated with fire-related deaths.Napa County also experienced some kinks with its alert system, when a coding error prevented an alert from going out. Emergency officials say it was an error on the part of its vendor and that the message was not urgent. Staff realized the problem, and they were able to use a different platform to send out the alert. "It happens over and over again," said Art Botterell, who is now retired from the State of California's Office of Emergency Services.Botterell led the effort to develop the Common Alerting Protocol, which he says led to the creation of the FEMA Integrated Public Warning System and some products from the National Weather Service."We've got a pretty good penetration of cellphones, sirens, and telephone dialer systems, that's not usually what breaks down. What usually breaks down is that alert is not sent in time or not sent at all," said Botterell. He says during a 2017 wildfire in Sonoma County, that would prove deadly and destructive, officials failed to send an alert, fearing it would cause panic and clog roadways. Botterell says another reason alerts are often not sent is because officials believe they don't have enough information."It is fair to say that in a lot of cases, we have not given our public safety people the tools to issue public safety warnings effectively," said Botterell. Botterell says more training is needed and believes state and federal governments should provide more guidance to ensure effective responses.With the vulnerabilities in cellular towers and alert systems as a whole, Botterell says counties must utilize several tools to try and reach everyone."We've got a lot of technology. As we focus on getting kids safely back to school this year, Nashville-area builders are trying to figure out how to limit the impact of potential future pandemic years down the road, which may require permanently changing the look of new schools, offices, and hospitals."Yes, we are definitely seeing clients ask questions," said Matthew Griffith, an architect with Gould Turner Group."Things like the materials we specify, how cleanable they are, rounded corners in rooms and antimicrobial surfaces," Griffith said.Griffith says with the thought of a future pandemic in mind — segmented spaces could be the norm for new schools."I think you will see a big focus on true flexible space, have demountable partitions and movable walls to where it can be segmented or more individualized on an as-needed basis," Griffith said.And that idea extends beyond school buildings. Griffith says the same can apply to hospitals and other office spaces."I think it's going to be common in a lot of designs to have dedicated spaces for temperature checks and things of that nature," Griffith said.A large building's heating and cooling system will likely be a large focus, according to Griffith. Rather than circulating air throughout the whole building, individual units may be able to keep the air within smaller areas in case of an outbreak.Schools have been through similar kinds of building trends before. In the early 2000s, it was all about security and hindering active shooters.
