SAN DIEGO (KGTV)- A local family contacted Team 10, concerned about the recent marriage of their elderly father to his new caregiver.  In a petition filed in probate court through an attorney, the family of James Donald Hess accused his new wife and former caregiver of "physically and verbally abusing him, and asserting undue influence over him." "It's just heartbreaking," said Dede Hess about her father-in-law. "I was just like, this isn't real." Dede Hess said her father-in-law, known to many as Don, is not in the best health. In the petition, it said his "health steadily declined" after Don's second wife passed away in February 2016 and that he suffered from "depression and loneliness" and became dependent on in-home caregivers. In the petition, it claimed that a caregiver named Nicky convinced Hess to marry her after just a few months. Hess and Nicky Shepard -- now Nicky Hess -- were married on October 14, 2017. Hess was 86-years-old. Nicky was 64.  "I think of her as a shark that smelled the blood in the water," Dede Hess said. RELATED: Resource guide for elderly San Diegans and families Dede Hess also learned more about the past of her father-in-law's new bride.  "When she met dad, she was married, but she was a newlywed," Dede Hess said. "Two weeks after her divorce was final, she married dad." Team 10 found Nicky was divorced at least five times.  The family alleged Nicky convinced her new elderly husband to "withdraw large sums of money from his investment accounts" and that she "forged [ his] name on documents," according to the petition. It also said she placed his health "in extreme danger" by keeping medication from him or giving him too much.  "I would love to see some justice on behalf of my father-in-law, especially if he's ill," Dede Hess said.  Team 10 learned that Don Hess is now hospitalized. His family said his heart stopped for several minutes and he also suffered from renal failure and pneumonia. The conflict brought both sides to probate court in mid-March where the judge acknowledged the difference of opinion regarding Mr. Hess's marriage.  "I know that you have very different views about whether this is on one hand, a recent marriage of an elderly person to his caregiver and the vulnerability that that can present and the possibility of financial abuse versus, on the other hand, a person who is engaging in his right in his older years to find love and get married," said Judge Julia Kelety. The petition is to remove Don Hess from the new trust made late last year. Hess's children claimed he was not competent at the time.  The petition said the new trust "largely disinherits his natural children... in favor of Nicky."  "The document was done in December so we have issues about its validity," said attorney Todd Stevens. However, the attorney present for Don's side said that is not the case.  "It appears to be a validly, executed trust by Mr. Hess," said attorney Lisa Frisella. Frisella said in court Mr. Hess went to a lawyer on his own and amended the trust.  Team 10 visited the Hess home to get Nicky Hess's side of the story.  She was home and did not want to talk in person. However, less than an hour later, Nicky called Team 10 and said over the phone: "All I need is love. I don't even think about his money. His kids did not approve our marriage."  Team 10 asked about allegations of elder and financial abuse. Nicky Hess said, "No, no way. I never elderly abuse my husband. I love him so much." In the petition response filed by Don's lawyer, it also denied any abuse and said the "children were more concerned about their inheritance than his happiness." In court, Judge Kelety temporarily "suspended" Mrs. Nicky Hess as successor trustee until another court appearance scheduled for April 5th.  It was a small victory for Dede Hess and the other Hess children, as they pray for their father's recovery. "I don't want this to happen to anybody else," Dede Hess said.  According to the National Council on Aging, elder financial abuse is likely underreported. SAN DIEGO (KGTV) — When you are out in public, it is virtually impossible to tell who has immunity to the coronavirus and who is susceptible.A San Diego-based company is trying to change that by developing two new COVID-19 monitoring systems that are as easy as checking someone’s forearm.Diomics is developing a device that looks like a nicotine patch that the company says can reveal the presence of SARS-CoV-2 antibodies in 24 to 36 hours. The patch is intended to be worn for one to two weeks, offering people a way to monitor -- and potentially display -- their infection status, according to CEO Anthony Zolezzi.When the patch, named Diocheck, detects antibodies circulating in the blood, it turns red.“We think this is an integral piece of getting things back to normal,” Zolezzi said. “This can get the country back operating and get us comfortable that the people around us aren’t infected.”A second device, made from thousands of tiny polymer beads, can be injected into the skin and offer COVID monitoring for six months to a year, Zolezzi said. The company is still testing how long the test can stay active before it’s safely absorbed by the body.The company plans to launch clinical trials at UC Irvine next month.Zolezzi envisions the tests would be useful for employees in numerous sectors, including the airline industry, the cruise industry, the gambling industry and the military, offering a new way to detect and rapidly quarantine infected individuals.Once a coronavirus vaccine is released, the tests could be a useful companion, he said, since it will likely take several weeks to develop protective antibodies after inoculation. An individual wearing the patch, for example, could find out when they have antibodies circulating in the blood.The tests could also show when a person begins to lose antibodies. Studies have show individuals with a mild coronavirus infection lose antibodies after a few months, and it’s common for vaccines to require multiple doses.“This patch will show you, when the color dissipates, it’s because your antibodies have dissipated,” Zolezzi said. “That’s the time when you need to get a boost, or some type of prophylaxis.”The small biotech firm with less than 20 employees is leveraging technology that’s more than 100 years old.In 1907, a French physician named Charles Mantoux developed an injection test for tuberculosis that produces a raised, red dot on the skin when the bacteria is detected. This is the standard test given today.“All we’re doing is modernizing it,” Zolezzi said. The company’s patented slow-release material allows for much longer monitoring, he added.Diomics was making skin care, wound care and diabetes products before the pandemic shifted the company’s focus. Their components are FDA approved individually, but will need new approval for this use, Zolezzi said.Zolezzi said production is underway, but the company is hoping to partner with a large drugmaker to rapidly scale up manufacturing. SAN DIEGO (KGTV) — Two people working on scaffolding on the side of a downtown high-rise were rescued Tuesday after their equipment became stuck.The two workers were stuck 42 stories in the air after their equipment failed just before 10 a.m., leaving their mobile scaffolding stuck, according to San Diego Fire-Rescue.Fire crews climbed to the top floor 46 stories up and were lowered down to the trapped pair. Glass on the 43rd floor of the building was then removed and the workers were hoisted into the building. View this post on Instagram SD Fire-Rescue crews are on scene at a building under construction at 14th and Island. SDFD dispatchers received the request for assistance at about 9:50 Tuesday morning. Two construction workers were on a window washing lift when the lift stopped functioning and the workers were not able to move the lift. USAR 2, engines 2 and 4 and trucks 1 and 11 along with medic 10 responded. The technical rescue team went to the roof and set up the rope system. They lowered down to the construction crew outside the 42nd floor and were able to remove a window on the 43rd floor. The 43rd floor window served as the extraction point. The first construction worker was rescued at 10:52 and the second at 11:01 a.m. The firefighters are now in the process of retrieving their rescue equipment. No injuries. SAN DIEGO (KGTV) — Wherever a Topgolf is built in San Diego, it's bound to tee-up some criticism.But as it stands, a potential East Harbor Island location facing golfers toward the downtown skyline may not end up being an option.The Board of Port Commissioners decided to delay a decision earlier this month on entering an exclusive negotiation agreement with Topgolf.RELATED: Gaslamp Quarter thoroughfare may become a promenadeThe Port directed staff to begin mapping out an agreement with Topgolf late last year. East Harbor Island was floated as a potential location at the time. But an agreed upon location must be chosen first before the negotiation starts.During the Feb. 11 meeting, commissioners were presented a study on developing the Harbor Island site and how Topgolf could work into that plan. Three diagrams showed the site's possibilities, with or without Topgolf:A "phase one" diagram included a potential Topgolf plus a 400-space parking lot and 500-room hotel and parking structure on the east side of the island. The "phase two" rendering kept Topgolf and the east-end hotel, but added a hotel development to the facility's west side that could have a shared parking structure with Topgolf.The final diagram depicted three hotel developments on the East Harbor Island land, without Topgolf. All the diagrams were meant to be illustrative of potential ideas of the site, not an official plan.
