VISTA, Calif. (KGTV) -- A Vista judge has dropped two charges against Gerardo Martinez Sr., a father arrested last week by San Diego County Sheriff's deputies. Martinez Sr. was facing two charges, felony resisting arrest, and lynching of an officer. The video surfaced last week. Martinez Sr. and his son, Gerardo Martinez Jr., arrested by five deputies. The family says the deputies used excessive force and that the two men were compliant and already in handcuffs. On Monday, the family demanded the department release body cam video and conduct an independent investigation. They also want to see the deputies involved prosecuted. The sheriff's department says they were called for a domestic dispute and that Martinez Jr. was armed with a knife. Deputies were also called to the home in late April for another incident involving Martinez Jr. The family's legal team did not address any questions about what lead up to the video but said Martinez Jr. has an issue with mental illness. They plan on filing civil lawsuits at the end of the week. The deputies in the video are on administrative duty as the investigation continues.   1186

WASHINGTON — U.S. long-term mortgage rates fell this week, reaching record lows for the 13th time this year amid fresh signs of weakness in the pandemic-ravaged economy. Mortgage buyer Freddie Mac reported that the average rate on the 30-year benchmark loan declined to 2.72% from 2.84% last week. The average rate on the 15-year fixed-rate mortgage fell to 2.28% from 2.34%. The low rates in 2020 have spurred demand in the housing market. The National Associated of Realtors says housing offers for single-family homes have increased for six consecutive months. They are now at their highest level since 2007, according to the Census Bureau. Existing home sales in October 2020 were 26.6 percent higher than the number of sales in October 2019. The median sale price, nationwide, has also increased; it is now 3,000, roughly 16 percent more in 2020 than this time last year.The NAR has warned that the dwindling number of available housing units is down to only a few months supply. Fresh signs emerged this week that the resurgent coronavirus outbreak is likely slowing the economy and forcing more companies to cut jobs. (KGTV) - Several schools in the Vista Unified School District are returning back to virtual learning for two weeks after positive COVID-19 cases were identified.The district reopened for in-person learning at normal capacity, also known as Vista Classic, on October 20th. According to the district’s website, 17 cases have been reported since October 20th.District Superintendent, Dr. Matt Doyle, said Vista Classic and Vista Virtual were designed to work together so that there is the flexibility to move back and forth.Mission Vista High School, Vista High School, Madison Middle School, Roosevelt Middle School, and Rancho Minerva Middle School are also back to Vista Virtual due to positive cases.A class of 28 students and one teacher at T.H.E. Learning Academy Elementary school is also under quarantine after one positive case was reported.Last week the school unanimously approved a plan that would close down some middle and high schools for two weeks when positive cases are reported.The closures would happen if one school has two or more positive cases at the whole time, the entire school would switch back to Vista Virtual for two weeks. If three secondary schools have one positive case each, all three will return to Vista Virtual for two weeks.“I think two is tough; that doesn’t give us a lot of confidence that it won’t close down again,” said Dolly Goulart, a parent of a Mission Vista High School student who has been back to virtual learning.“I do appreciate that they’re doing trying to get classic families back in. They gave families a choice over the summer.”Goulart said her son’s transition back to Vista Virtual went smoothly.“From my perspective, it seemed perfectly seamless. He did fine pivoting back,” said Goulart. “He’s about a week into his two-week virtual pivot.”“We meet regularly with representatives from the S.D. Health and Human Services Department to discuss our health and safety measures and make adjustments as appropriate,” said Dr. Doyle in an email to A.B.C. 10News.Doyle said in just weeks, a high volume COVID-19 testing center would open in Vista Unified.Before school reopened, the district notified parents that they couldn’t guarantee that students would be six feet apart in class.The district’s website stated, “It is important to note that while many health and safety precautions are in place for the Vista Classic learning model, all classrooms will have the normal amount of students enrolled. This means that while we will be following social distancing procedures, student seating arrangements will be less than six feet apart.”There have been mixed reactions to the reopening plan from teachers and parents; some like Goulart are happy with the plan, while others call for revisions.“Why are we allowing kids not to social distance within our classrooms?” asked Keri Avila, the Vista Teachers Association president. “When we talk about keeping businesses open, when we talk about returning to some sort of normal, this takes that all away.”Avila said, in some cases, students are in crowded classrooms without enough safety measures in place.She’s calling on the district to make changes to the current reopening plan so that schools can remain open.“We hope to work with our district to create a system to keep our schools open, not one that keeps pivoting back to virtual,” said Avila.Two positive COVID-19 cases have also been reported at Alta Vista High School, but ABC 10News has not been able to confirm if the school has closed down. 3527

VISTA, Calif. (KGTV) - Kellen Winslow Jr. affirmed his innocence to 10News Thursday as he appeared in court to face a third charge of rape.The son of a Chargers legend, Winslow pleaded not guilty to the alleged rape a 17-year old girl in 2003.  10News was able to capture a few words with Winslow as he walked to his car in the parking lot outside court. When reporter Jim Patton asked about the new rape charge, Winslow responded it would all come out in court. Then asked if he was innocent of the other allegations of raping two women in Encinitas, Winslow said, "I'm advised by my lawyer to not speak on much. But yes, I am innocent." The new charge involves a woman who was 17 years old at the time. Winslow was 19. She claims he raped her while she was unconscious. Winslow Jr.'s attorney has previously said their relationship was consensual.  Thursday, the defense repeated a request for the woman's psychological history.Thursday's court hearing lasted no more than 15 minutes as attorneys debated whether this new case should be tried along with the other two rape allegations. Winslow Jr.'s attorneys argued the new charge could prejudice the other two.The judge allowed the cases to remain joined for now for efficiency but said the trial judge would make the ultimate decision.  Winslow is currently free on a million bond, while required to wear a GPS monitoring bracelet. His trial date was set for March 19th, 2019. 1507

Tim Kaine on Sunday said President Donald Trump continuing to blame Democrats for the lack of permanent protections for young undocumented immigrants is a break with reality."He is either lying or he is completely delusional," Kaine said on CNN's "State of the Union."Trump on Friday said Democrats were responsible for there being no permanent fix on the Deferred Action for Childhood Arrivals program, claiming, "The Democrats fought us, they just fought every single inch of the way. They did not want DACA in this bill."Kaine noted that then-President Barack Obama established the program, which has protected undocumented immigrants brought to the US as children from deportation, and that it is Trump who moved to end it."One person can save DACA," Kaine said. "If President Trump believes in DACA, all he has to do is retract his executive order from September where he broke a promise to Dreamers and said he was going to end the program."Trump has repeatedly railed against Democrats on DACA, with his comments on Friday coming as the latest such statement in a string of developments on the immigration program.Kaine said on Sunday that lawmakers would continue efforts to reach some kind of permanent shield for DACA recipients, but argued that without a consensus from the Republicans, a solution would require returning his party to power."We're going to keep looking for a solution, but the key is we do not have the support of the White House, we don't have the support of Republicans," Kaine said.
