SAN DIEGO (CNS) - A day after District Attorney Summer Stephen criticized the San Diego Police Department for employing incomplete testing of DNA evidence in some unsolved rape cases, Chief David Nisleit Wednesday announced that his agency would thoroughly analyze all such materials from now on.On Tuesday, Stephen told Voice of San Diego -- which revealed the contested investigative policy last week in an in-depth investigative story -- that the SDPD should not have performed incomplete examinations of dozens of rape kits while working through a decades-long backlog of open sex-assault cases."I don't think that that's the right thing to do," the district attorney told VOSD.Wednesday afternoon, the police chief announced that he had reached the same decision."We recognize the community has high expectations for us," Nisleit said in a prepared statement. "We also hold ourselves to the highest of standards. In order to meet these expectations, we will be working with a private laboratory to ensure all 1,700 historical kits are tested."When a sexual assault is reported to law enforcement, nurses collect swabs from different parts of a victim's body in search of the perpetrator's genetic material, and file away the DNA samples for testing in the future.Six months ago, San Diego police began testing only a single swab from dozens of previously untested kits, as opposed to the full set of a half- dozen available in each case, VOSD reported. The procedure was reserved for situations in which the district attorney had declined to prosecute, or when a warrant already had been issued for a suspect's arrest.That practice is officially a thing of the past, according to Nisleit."Moving forward, the department will test every single kit using a six-swab method," he said.According to SDPD officials, about 40 rape kits had been tested in the abbreviated manner. Though the department defended the procedure as appropriate in the relatively rare selected cases, an SDPD crime-lab analyst who spoke on condition of anonymity told Voice of San Diego there was another motivation."The reason given was, `We just need to check the box,"' the department staffer said. "There was no scientific reason given, not that `This would be more effective.' There was no indication that this was anything other than a political policy decision."The department canceled the policy in August, a day after Voice of San Diego first asked about it, according to the nonprofit news agency.Stephen said the District Attorney's Office had not approved of -- or even known about -- the investigative shortcuts being employed by the SDPD on some of the old rape kits it was reviewing."We assume that the testing will be done by proper standards," she told VOSD. "We don't get into the technical (aspects), because that's not our area. We trust that forensic experts will make those decisions correctly ... . Mistakes happen, but the key is to not get stuck on ego, to correct and to move forward so we can serve this community."Last year, the District Attorney's Office formalized an agreement with the San Diego County Sheriff's Department and 11 other police departments in the county -- all but the SDPD -- to clear the region's backlog of rape kits by forwarding them to outside laboratories for testing.Declining to join the effort, the SDPD instead opted to create an internal group to tackle the task. SAN DIEGO — Democratic Congressman Mike Levin has opened a commanding 20-point lead over Republican challenger Brian Maryott in coastal North County's 49th district, according to a new scientific poll.The ABC-10News Union-Tribune poll shows Levin leading Maryott 56 percent to 36 percent, with the remainder undecided. It's an increase over the 49 percent to 37 percent lead Levin had over Maryott in a prior poll taken in mid-September. The district stretches from Del Mar into parts of southern Orange County."It's all over but the shouting," said political analyst John Dadian, who said the district has become increasingly democratic over the last 15 years. "It was getting bluer gradually, and now, the last election cycle and I believe this one, we're going to see the fruit come to bear."Levin won the 49th District seat in 2018 after Republican Darrell Issa decided not to seek re-election after nearly two decades. Issa is now running for Congress in east county's 50th District, which leans Republican. "We've seen a lot of the communities that have shifted to more in the democratic party since 2016 are these more suburban, well-educated communities like many of the communities in California's 49th," said Stephen Goggin, a lecturer in the political science department at San Diego State University. The poll of 514 likely voters shows Levin getting the support of 68 percent of independents, with Maryott, a San Juan Capistrano councilman, getting just 15 percent of them. Both are getting the bulk of their backing from their own parties. (AP) — A lawsuit filed by the Satanic Temple alleges an advertising company unfairly refused to display billboards promoting a ritual offered by the group to help people bypass abortion rules in some states. The group, based in Salem, Massachusetts, announced Wednesday that it sued Lamar Advertising in Arkansas state court for alleged religious discrimination. The Louisiana-based company did not immediately respond to a request for comment. The Satanic Temple says Lamar refused to display eight billboards in Arkansas and Indiana promoting what the group calls its “religious abortion ritual.” The Satanic Temple describes the ritual as a “sacramental act that confirms the right of bodily autonomy.”By performing the ritual, the group says, people can claim a religious exemption from mandatory waiting periods, counseling, ultrasounds and other measures that some states require before an abortion can be performed.The group says it submitted five designs to Lamar to be displayed near crisis pregnancy centers. In one of the images, a bowl of cake batter is shown with the text, “not a cake,” next to an image of a sperm and egg with the text “not a baby.” It’s accompanied by text saying, “Our religious abortion ritual averts many state restrictions.”Lamar rejected the billboards and said their content was “misleading and offensive,” according to the suit. SAN DIEGO (CNS) - A 19-year-old man was behind bars Friday on suspicion of fatally shooting an acquaintance at a San Ysidro motel.Customs officers who recognized Jonathan Orduno of Chula Vista from a be-on-the-lookout bulletin took him into custody at the San Ysidro Point of Entry on Thursday night in connection with the death last week of 22-year-old Adrian Torres-Garcia, according to San Diego police.A housekeeper found Torres-Garcia dead in a rented room at a motel in the 100 block of Calle Primera shortly before noon March 18, homicide Lt. Matt Dobbs said.
