(AP) — The wife of a man who was struck and killed by a Metrolink train in Southern California says investigators told her he pushed her out of the way.The Orange County Register reports Saturday that Jacqueline Gibson, of Lake Elsinore, said she was vacationing with her 71-year-old husband Ernest Gibson Monday when they crossed the tracks to return to their Dana Point campground.She says he suddenly told her to run. She found herself on the other side moments later as the train came through.Once it passed, she found her husband's body.She says investigators told her video from the train showed her husband pushing her out of the way.Metrolink officials say the area was restricted. Gibson says there were no signs indicating to keep out. 772

DENVER, Colo. — On Wednesday, a Boulder man released videos of his July 29 arrest, and said he's ready to take action against the Denver Police Department for "savagely" beating him. He also claims an officer sexually assaulted him with a baton.Michael Jacobs, a self-described student activist, was arrested on July 29 during a "Stop the Sweep" homeless protest at Lincoln Park, across from the Colorado State Capitol.He says he was rattling a fence at Lincoln Park to get an officer's attention and says he was taken down by officers."I was grabbed from behind, it felt like it was from my neck, no warning, no 'you're under arrest,'" Jacobs said.It's important to stress that little is known about what led up to the takedown. Video shows people shaking a fence at the park and then the takedown.In the video, you see an officer run towards Jacobs and then several officers holding him down. You can briefly see an officer use his baton against Jacobs in the recording."One of the officers took his baton, lifted it in the air and forcefully shoved it into my a**," Jacobs said.A probable cause statement released by the Denver Police Department claims Jacobs was part of a group trying to push down a gate at Lincoln Park and adds that they managed to bring it down and get inside.But in the video, Jacobs is outside of the fence.The police report states Jacobs violently resisted arrest and even grabbed an officer's pepper ball gun. It's a claim Jacobs and his attorney, Dr. Matt Greife, dispute."That could not be further from the truth," Jacobs said."To say that he attempted to disarm a police officer of their pepper gun or pepper ball gun, that's nonsense, he was on the ground way too fast," Dr. Greife said.According to Dr. Greife, it's been challenging to obtain vital evidence they should be granted to prepare for a lawsuit and a civil claim they plan to file."We should know what the police reports say. We should know what the body cams tell us," Dr. Greife said.Denver police say they launched an internal investigation and added that it would be inappropriate to comment further.Medical records provided by Jacobs' attorney to KMGH show a doctor couldn't conclusively identify sexual abuse from the incident.Jacobs is facing a felony charge of attempting to disarm a police officer. DENVER — Dozens of states filed an anti-trust lawsuit against Google on Thursday, alleging that the search giant has an illegal monopoly over the online search market that hurts consumers and advertisers.This lawsuit was announced just one day after Texas and nine other states filed their lawsuit against Google alleging anticompetitive practices in the advertising technology industry.The Thursday lawsuit was announced by Colorado Attorney General Phil Weiser and was filed in federal court in Washington, D.C. by states represented by bipartisan attorneys general.The lawsuit was joined by the attorneys general of 35 states as well as the District of Columbia, Guam and Puerto Rico.The latest suit mirrors an anti-trust case brought by the Justice Department and 11 states earlier this fall that claimed Google uses anticompetitive agreements to get dominant position for Google Search on smartphones, according to CNN.The latest case goes further, also alleging Google moved to block or move down search results from certain other engines.The case is the third antitrust salvo to slam Google during the past two months as the Department of Justice and attorneys general from across the U.S. weigh in with their different variations on how they believe the company is abusing its immense power. 1307

DEL MAR, Calif. (KGTV) - A woman was struck and killed by a Coaster train during rush hour Wednesday.The Coaster came to a stop at 111 11th Street in Del Mar. Deputies from the Sheriff's North Coastal Transit Enforcement Unit arrived at the scene around 5 p.m. Deputies say the northbound Coaster Train was traveling around 48 mph when it struck the woman, killing both she and her dog as they attempted to cross the tracks. Both the woman and the dog died at the scene. Anyone with information about this case is asked to call the Sheriff's Department's non-emergency line at (858) 565-5200. 620
