Jurors have found Border Patrol Agent Lonnie Swartz not guilty on the Second Degree Murder charge of shooting through the border fence and killing 16-year-old Jose Antonio Elena Rodriguez.Jurors could not come to an agreement on a verdict on the two lesser charges, voluntary manslaughter and involuntary manslaughter.If they wish, prosecutors can retry Swartz on the lesser charges only.Friday jurors told Federal Judge Raner Collins they could not agree on a verdict.  The judge told them to continue deliberating. They could choose to convict Swartz on lesser charges of Voluntary Manslaughter or Involuntary Manslaughter.Swartz testified he was protecting himself and other officers from rocks thrown over the border fence by people on the Mexican side trying to interfere with efforts to arrests smugglers who were trying to climb over the fence and into Mexico.In closing statements to the jury, prosecutors said in his two years as a Border Patrol Agent, Swartz had rocks thrown at him six or seven times, and each time had responded by using less lethal weapons. Border Patrol may use items like guns that shoot an irritating pepper.But the night of October 10, 2012, Swartz had been on duty at the DeConcini Port of Entry.  He had only his gun and used it to fire 16 rounds through the fence. Ten shots hit the 16-year-old Mexican teen.Prosecutors say the threat against Swartz and other officers was not severe enough to justify deadly force and that they could have easily removed any threat by taking cover.They say other agents took cover but Swartz was fed up with rockings, wanted to send a message, and did it by calmly walking to the border fence, taking careful aim, and firing 16 shots into Mexico.Defense attorney Sean Chapman told the jury rocks are enough of a danger to justify deadly force and that there is no evidence to conclude Swartz fired out of anger over rock attacks. LA JOLLA (CNS) - Two passengers riding in a speeding car died today when the vehicle hit a palm tree on Girard Avenue, police said.The crash happened at 3:16 a.m. when the driver of a Nissan Altima was speeding westbound on 1000 Torrey Pines Road, said Officer Dino Delimitros of the San Diego Police Department.The 26-year-old man driving the Altima made a left turn onto 7500 Girard Ave., lost control of the vehicle and crashed into a palm tree, the officer said.Two male passengers, ages 19 and 21, received major injuries and died at the scene, Delimitros said.The injured driver was taken to a hospital and will be held on suspicion of driving under the influence, the officer said. 696

KANSAS CITY, Missouri — Jeff Henry, one of the men charged in the death of 10-year-old Caleb Schwab at Schlitterbahn water park, did not appear with his attorney in court Thursday, Dec. 13.His attorney stated Henry is at an inpatient facility in Houston, Texas. He asked the judge to stay his bench warrant until Jan. 24, 2019 when Henry returns for his other case.The attorney said Henry, a co-owner of Schlitterbahn, will begin an intensive outpatient program while in Houston. Henry is accused of allegedly arranging for a human trafficker to bring a woman to him at a hotel room in July 2018, a day after he was in court for the Schlitterbahn case.Part of the payment to the trafficker included passes to the water park, documents say.The state told the judge they were fine with the suggestion from Henry's attorney to stay his bench warrant since they have been in touch with authorities there and they say they have had no issues with Henry.Henry has a ,000 cash and surety bond and is under house arrest.Schwab died Aug. 6, 2016 from a neck injury sustained while he was on the 17-story Verrückt water slide with two other park goers. KANSAS CITY, Mo. — A woman is recovering after being shot in the leg by a man she’d been out with Wednesday night.She was shot on the Plaza, but the Kansas City Police Department said the incident began in another part of town. They said a man and the victim were in his car when he started firing his gun from the car.The woman got out and ran to her car, which was parked on the Plaza.Police said the man drove by and shot her through her car door.She was taken to the hospital. The gunman left the scene and went to his home in Lee’s Summit, where local police arrested him and took him to the KCPD jail.KPCD said it’s unclear why the suspect began shooting in the first place.The woman was shot right outside The Granfalloon. 752
