SAN DIEGO (KGTV) — A San Diego-area man and his grandmother filed a federal lawsuit against two San Diego County Sheriff's Deputies.The lawsuit alleges deputies responded to the wrong address and pulled a then-17-year-old out of his apartment. "I've never experienced something like that," said Cesar Jaramillo.Jaramillo says last October he was watching TV on the couch when he heard a knock at the door. He says deputies asked if someone from the residence called 911.According to his lawsuit, "Cesar informed defendants the call was not from his residence. When defendants asked Cesar if there was a young black female in the apartment, Cesar said 'No,' and informed defendants that they were at the wrong apartment building. Cesar knew who defendants were referencing and knew they lived in the other building. Cesar informed the deputies over half-a-dozen times that defendants were at the wrong building."Jaramillo tells 10News he complied with everything the deputies asked but felt like they didn't believe him."That's when I started closing the wide door, that's when he just reached in and grabbed my hand," Jaramillo said.The lawsuit claims, "Without warrant or probable cause, both defendants unreasonably lured Cesar to unlock and open the door, then entered into Plaintiff's residence and forcibly pulled Cesar by the forearms into submission, leaving instant bruises on both arms."Jaramillo's grandmother was in the back of the house at the time and said she woke up to the commotion."I saw my grandson laying on the ground, in handcuffs and I went crazy, and I said, what is happening," said Teodora Villalobos.According to the lawsuit, "Due to unreasonable seizure and force used on her grandson Cesar, as well as defendants' indifferent attitude, Teodora began having heart complications on scene."Jaramillo's lawsuit alleges negligence, battery, and unreasonable search and seizure, among other things.10News reached out to the San Diego County Sheriff's Department for comment, but a spokesperson they can't comment on pending litigation. 2066

SAN DIEGO (KGTV) - Amid fears of post-election unrest, parishioners at San Diego's oldest church are meeting the possibility of violence with prayer.It's the morning of the election and Peggy Stolberg is hoping to cast a vote for peace — through prayer."It always seems like prayers are the answers to many things," said Stolberg.Stolberg spent part of her morning in the sanctuary of the Mission San Diego de Alcala, her church for the last 35 years."I pray for the unity of our country. I'm also here to pray for non-violent situations after the results come out," said Stolberg.Peggy is one of many — a few at a time — expected to show up by the end of the day, says Father Bill Springer."A little bit of anxiety," said Father Springer.Father Springer believes this was the first-ever all-day prayer vigil for election peace in the history of the 251-year-old mission."We just felt there was a threat of violence around the election, because of the divisiveness of our society and previous violence in the streets," said Father Springer.Father Springer says to combat that, he's calling upon the power of prayer."Aside from the efficacy of the prayer itself, it also alerts people and puts on their mind that this is something people should be concerned about ... and spread to their neighbors and others that they should have a spirit of peacefulness and spirit of respect for others," said Father Springer. 1419

SAN DIEGO (KGTV) - A Serra Mesa family expecting nearly ,000 in stimulus funds in April is still waiting.Mark Perry, who is married with four children, says his family was expecting a big stimulus check. Both he and his wife still have their jobs, but the check will come in handy."Really looking forward to getting the check. I was looking at a check coming fairly quickly, a direct deposit coming of 00," said Perry.Quickly, because Perry had the same bank account for the last 18 years, his IRS refund received via direct deposit every year, including one in April. Taxpayers like Perry should have received their checks during the week of April 13th, a week which came and went for Perry."Halfway through May, I realized something is really up here," said Perry.That's when Perry started logging onto the IRS 'Check My Payment' link, over and over. Hundreds of times."I probably tried a dozen times just last night. The result is always the same," said Perry.That result was this."Got an error message. Either can't verify or don't qualify. None of those things are correct," said Perry.Perry says when he called the number designated by the IRS for 'Economic Impact Payment' questions, he got nowhere."You end up in the same loop, back in the same place where you started from. There's no one you can actually speak to," said Perry.He's written politicians, and every day, he logs onto the IRS site. And he's not alone."I know of two other people in the exact same position I am. I'm frustrated mostly with the IRS website platform, which seems broken to me," said Perry.According to the IRS, 159 million Americans have received their stimulus payments with paper checks still being mailed out in June.An IRS spokesperson told 10news they are asking for patience from the public and continue to working on getting "up to speed" with the online platform. SAN DIEGO (KGTV) - A San Diego pastor is reflecting Wednesday on his special personal connection with Reverend Billy Graham, who passed away at his home in North Carolina from natural causes at the age of 99.Early in his career in 1949, Graham delivered a sermon at the Forest Home Christian Camp in the San Bernardino Mountains.  Bob Botsford's father ran the camp. Nearly two decades later during one of Graham's return visits to the camp - an excited, 5-year-old Bob interrupted his sermon."I remember yelling out 'Hi Billy!' And he yelled back, 'Hi Bobby,'" said Botsford.By then, Graham had become a family friend."I recall bigger-than-life charisma.  He was the most gentle soul and most humble man I've ever met in my life.  He was bold yet caring," said Botsford.Botsford says Graham inspired him to become a pastor at age 24."His invitation was for a personal relationship with Jesus Christ and that's what I longed for," said Botsford.Later, it was Botsford who flew to a revival in Kentucky to personally invite Graham to return to San Diego. His last revival was in San Diego almost 30 years before. "He said, 'Let's see if we can make that happen," said Botsford.It did.  In May 2003, a record-breaking crowd packed Qualcomm Stadium to hear him speak."It was electric and just filled with hope," said Botsford.After the event, there was a surprise in the mail.  Botsford received a bible from Graham in the mail, which included a message: "Bob Botsford. God Bless You and Keep You.  Amen.  Billy Graham.""Definitely one of my most treasured possessions," said Botsford.A decade and a half later, he must say goodbye to his friend."I'm sad for the world because we lost the greatest communicator of the gospel, but I'm happy for heaven because Billy is finally home," said Botsford.Botsford is also remembering a legacy.  At Qualcomm Stadium that day, his own son met Graham."I saw my son's eyes light up," said Botsford.The meeting inspired his son, who is now a youth pastor at Botsford's church, Horizon Christian Fellowship in Rancho Santa Fe."Third generation. Thrills my heart ... The message is going to outlive the messenger," said Botsford. 2219

  

SAN DIEGO (KGTV) -- A two-car collision killed at least one person in San Ysidro early Friday morning.According to the California Highway Patrol, the crash happened around 5:15 a.m. when a red car got off state Route 905 at the Caliente Avenue exit, then hit a sign before crashing into a black SUV.The SUV spun around and landed in a nearby ditch. That driver was taken to the hospital with unknown injuries. The driver of the red vehicle died at the scene.The cause of the crash is unclear. Caliente Avenue was closed for a few hours while CHP investigated. 567
