SAN DIEGO (KGTV) — The San Diego Symphony has overcome the last major obstacle to a permanent home along San Diego's waterfront.The Port of San Diego's Board of Commissioners has granted a 15-year lease for the Symphony's Bayside Performance Park project. The project will see the construction of a seashell-shaped concert venue at Embarcadero Marina Park South, as well as various improvements to the surrounding park.The lease also includes four options allowing the Symphony to extend their lease up to 50 years.The San Diego Symphony will invest a minimum of million toward those improvements, including 66 new restrooms, expansion of the current promenade, and improvements to the park's existing basketball courts and exercise equipment.RELATED: Margaritaville Island Resort coming to San Diego“We’re confident concert-goers will love the improved access and state-of-the art stage and sound system, and bayfront visitors will love the new and improved park,” said Board Chairman Garry Bonelli.The Symphony could begin construction of the venue as soon as September. It wasn't immediately clear when the venue would open.A permanent concert venue for the symphony has been on the organization's wish list for years now. Since 2004, the Symphony has had to assemble and disassemble its temporary venue for its Bayside Summer Nights concert series. The permanent concert stage will also provide four free public events each year."Our hope is that it will become a coastal destination for everyone, and an iconic landmark for the region and its coastline," said Martha Gilmer, San Diego Symphony CEO.The park's landscape will also change, with the Symphony adding a sloped lawn with temporary seating open to the public during non-event hours. SAN DIEGO (KGTV) -- The retrial began Thursday for Constantino Banda Acosta, the man prosecutors say was drunk and angry from a fight when he caused a hit-and-run crash that severely injured a 6-year-old returning from a family trip to Disneyland. The jury was deadlocked Thursday on whether or not Banda was even at the wheel. Throughout the trial, Banda sat quietly in the courtroom and could be seen smiling at the jury as attorneys laid out their case.The central question in the retrial is whether Banda or an employee of his construction company, Jorge Adame Ariza, was the one driving.RELATED: Verdict reached in trial for driver accused in hit-and-run crash that injured boyAriza was captured in security footage driving the truck from a restaurant where the two men were drinking.Ariza claims he turned the wheel over to Banda before the accident happened, which severely injured 6-year-old Lennox Lake of San Ysidro. Authorities say Banda had also been deported at least 17 times before the crash.Prosecution in the case say the two men were heatedly searching for a man who beat up Banda. Lake’s father says the young boy is expected to testify in the trial later Thursday.Lake is still receiving extensive treatments for his injuries.RELATED: Jury deadlocked in case against driver accused in San Ysidro hit-and-run?Banda was speeding west on Camino de La Plaza around 11:30 p.m. on May 6 when he reportedly ran a stop sign at Dairy Mart Road and crashed his pickup into a Honda Accord carrying the Lake family. In September of 2017, a jury found Banda guilty of misdemeanor charges of driving without a license, battery and vandalism. The jury was hung, however, on felony charges of hit and run causing death or permanent injury, DUI causing injury and driving with immeasurable blood alcohol causing injury.  1866

SAN DIEGO (KGTV) - This year Comic-Con celebrates its 50th anniversary. Only five people have attended the convention every single year. One of them is noted author and television writer Mark Evanier.Evanier began writing comic books when he was a teenager in the 1960's, including the comics featuring characters like Mickey Mouse and Bugs Bunny. His mentor was comic book legend Jack Kirby, who created or co-created many of the genre's most famous characters, such as Captain America, the X-Men, and the Incredible Hulk. It was Kirby who first told Evanier that a group of fans in San Diego were planning a comic convention at the El Cortez Hotel."I thought it was a great idea," Evanier told 10News in an interview from his office in Los Angeles. "I had no idea it would get as large as it did. I thought maybe we'll have 400, 500 people there."While Evanier thought it would be a niche convention, even in its early days Kirby saw the potential. "He said this a long time ago when this was a nutty idea to say. He said Comic-Con is going to take over the city of San Diego each year," Evanier recalled.Early supporters of the convention included Marvel creator Stan Lee and science fiction author Ray Bradbury. Comic-Con moved into the San Diego Convention Center in 1991, soon expanding to take over the ballrooms at the surrounding hotels.Evanier has had a big role at the convention over the 50 years. He is a frequent moderator of panels and a guest of honor at many events. He believes the convention will remain in San Diego for the long term (Comic-Con International recently signed an extention through 2024). This is despite the fact that Comic-Con is facing growing competition for the biggest stars and events. Other conventions have launched in cities across the country, and some companies, including Disney, have created their own events. "Yes, there are conventions that are trying to be bigger or wish they could be Comic-Con," Evanier said. "Those are all commercially run. The Comic-Con we go to in San Diego is a non-profit organization."Evanier is scheduled to moderate more than a dozen panels during this year's anniversary convention. 2171

SAN DIEGO (KGTV) - The San Diego Police Department is looking for four instruments that were stolen from the San Diego Junior Theatre over the weekend.Junior Theater Executive Director James Saban said two guitars and two bass guitars were taken sometime Friday night or Saturday morning.They are described as a white Fender Stratocaster with a checkered strap, a red Epiphone archtop guitar, a seafoam and white Fender bass guitar and a cream Fender Mustang bass guitar.“It was my prized possession, my baby,” said Oliver Davis of his Fender Stratocaster. “So finding out it was stolen was a bummer.”Davis plays the guitar on stage as part of his character. After discovering it was missing Saturday morning, he said he and the other musicians had to rush to find replacements so they could perform their matinee.“Everyone was getting loaned instruments,” he said.The theater has filed a police report but the instruments have not yet been found.Anyone with information can call the San Diego Police Department at 619-531-2000. 1036
