NOBLESVILLE, Ind. — The man in charge of the FBI in Indianapolis said a school shooting at Noblesville Middle School West earlier this year could have been prevented.According to FBI Special Agent in Charge Grant Mendenhall, most school shootings are preventable, including the shooting at Noblesville. NEW YORK CITY — Police are looking for a man they say assaulted a New York City bus driver who asked him to put on a mask before boarding the Manhattan bus.According to the NYPD, the unidentified man attempted to get on the northbound New York City Transit Authority (MTA) bus near Madison Avenue and East 29th Street around 2:30 a.m. Monday without a mandatory face covering.The bus driver, 62, stopped the man, telling him he had to put on a mask to ride the bus, police said.According to authorities, the man punched the bus driver in the face before fleeing the bus in an unknown direction.The victim suffered pain and swelling and was taken to a nearby hospital for treatment, police said.Face coverings or masks are required on all MTA buses, subways and trains as the city continues to battle the coronavirus pandemic.The NYPD has released the above surveillance images of the man for whom they're searching.This story was originally published by Mark Sundstrom and Rebecca Solomon on WPIX in New York City. 1022

NEW YORK — Jean Kennedy Smith, the youngest sister and last surviving sibling of President John F. Kennedy, died at 92, her daughter confirmed to the New York Times. Smith died Wednesday at her Manhattan home, her daughter Kym told the Times. Smith served as ambassador to Ireland for five years under President Bill Clinton. She also founded an arts education program that supports artists with physical or mental disabilities. Next week, the U.S. House and Senate will take up police reform bills.The House will address qualified immunity on a national level. It's a doctrine implemented by the U.S. Supreme Court that makes it difficult to sue police, even if one's constitutional rights are violated.The doctrine protects officers who can defend their actions because they didn't know their conduct was unconstitutional. That's because it wasn't “clearly established” in a prior court ruling.In practice, courts have dismissed civil rights lawsuits because there wasn't a previous case in the same location with the same circumstances. So, there's also no precedent for future cases. That's why the doctrine is criticized as a "catch 22."“That kind of ‘does this officer get the benefit of the doubt?’ type of inquiry gives judges just lots of room based on their interpretation, their view of whether this seems like a bad case or not, and it means that the judge is taking cases away from the jury based on their own views of the facts,” said Brandon Garrett, professor of law at Duke University.“The way to truly understand it is to look at in the context, as a lot of people are suddenly looking at it when police uses force, and particularly when it's deadly force,” said Aderson Francois, professor of law at Georgetown UniversityThe officers involved in a wrongful death lawsuit in Washington D.C. are expected to claim qualified immunity. In 2018, Marqueese Alston was shot and killed by police while running away. The court will only look at it from the perspective of police and if they reasonably feared for their lives.“What the court will not do is to ask did my client, a 22-year-old black man in DC have a reasonable fear for the police that caused him to run away in the first place,” said Francois.It's important to point out that officers do not personally foot the bill in these cases.“It's about the municipality, the county, the city,” said Garrett. “They're the ones who are paying. They're the ones who should be held accountable. After all, if this officer was poorly trained or didn't have the right support from colleagues, it's not the officer's fault necessarily.”Qualified immunity makes it so the constitutional issue is never addressed. Even if the doctrine disappears, it's still difficult to win a constitutional claim. 2335

NEWMAN, Calif. (KGTV and AP) - Newman Police Chief Randy Richardson had tears in his eyes Thursday as he talked about the grief in his department over the loss of Corporal Ronil Singh. Singh, 33, was shot early Wednesday morning, a few minutes after radioing that he was pulling over a gray pickup truck that had no license plate in Newman, a town of about 10,000 people some 100 miles southeast of San Francisco. He died at a hospital. Singh was one of 12 Newman Police officers. “My department is hurting,” said Richardson at a morning news conference. “We’re not an agency; we’re a family.” Watch the news conference:The Stanislaus County Sheriff’s Department took over the investigation from Newman Police, releasing surveillance photos of a man seen at a convenience store just before Singh’s murder. Officials pleaded for information about the attacker's identity from the public, and the California Highway Patrol sent an alert to smartphones Wednesday asking drivers to keep an eye out for the pickup truck. A truck believed to have been the one stopped by Singh was later found in a garage in a mobile home park about 4 miles from the shooting, where law enforcement officers were serving a search warrant, The Modesto Bee reported. "He loved camping, loved hunting, loved fishing, loved his family." On his Facebook page, Ronil Singh posted pictures on Christmas Eve from a deep-sea fishing trip that produced a big haul of crabs and fish. His profile picture shows him smiling as he stands at a patrol car with his K9 partner, Sam — the same photograph of the officer released by the Sheriff's Department. “He will never see his son walk,” Chief Richardson said. Outgoing California Gov. Jerry Brown offered condolences to Singh's family and said flags at the Capitol would fly at half-staff in his honor. "Our hearts are with the entire community of Newman and law enforcement officers across the state who risk their lives every day to protect and serve the people of California," Brown said.
