SAN DIEGO (KGTV) - A former Border Patrol agent was sentenced Wednesday for trying to smuggle drugs across the U.S.-Mexico border while on duty in 2016.Noe Lopez, 37, of Chula Vista, was sentenced to 70 months in prison for attempting to smuggle methamphetamine and cocaine in exchange for cash. He pled guilty to the charges in June 2017.Investigators say the former Border Patrol agent agreed to pick up backpacks containing the drugs from the north side of the border while on duty. Undercover DEA agents used substances resembling drugs in the backpack drops.RELATED: Border Patrol agent arrested in North San Diego County on drug , weapons chargesIn a conversation with an undercover agent, Lopez discussed the area known as "Goat Canyon" as a preferred location, according to investigators, saying "Honestly, the thing is that there aren’t—there aren’t any cameras. Nothing, nothing, nothing."At times, investigators said Lopez switched shifts with another agent to be in a preferred area for a drop.Lopez would load the backpacks in his Border Patrol vehicle and deliver what he thought were narcotics after work in exchange for thousands of dollars, according to the charges.RELATED: Border Patrol agent found not guilty on murder charges, hung jury on two lesser charges"This is a fitting sentence for a law enforcement agent who, instead of policing drug traffickers, joined them," U.S. Attorney Adam Braverman said in a release. "Noe Lopez will pay a high price for betraying his fellow agents and his badge."Lopez was arrested on Dec. 14, 2016, after undercover agents moved in after setting up another backpack drop with the purported drugs."Noe Lopez violated the trust of the public and the law enforcement community he betrayed," Rodney Scott, San Diego Sector Chief Patrol Agent, said. "Noe Lopez is the anomaly; he does not represent the professionalism, honor and distinction that Border Patrol agents exhibit everyday safeguarding our nation.” 2012

SAN DIEGO (KGTV and CNS) -- Opening statements will likely begin Thursday morning in the retrial of Kellen Winslow II, who is charged with raping a woman in Encinitas and an unconscious teen in Scripps Ranch in 2003. Winslow was previously convicted of raping a homeless woman and exposing himself to two others. After a week of deliberations, the Vista jury found Winslow guilty of raping a woman in Encinitas and exposing himself to two others, but deadlocked on eight other charges. Those charges included rape and kidnapping in connection with two other women. SAN DIEGO (KGTV) -- A developer is proposing to build 1,200 housing units over the now-shuttered Carmel Mountain Ranch Country Club golf course.New Urban West is planning what's called "The Trails at Carmel Mountain Ranch." The plans, submitted to the city, call for 1,200 multifamily homes - a mix of for sale, and for rent - plus 111-acres of open space, including six miles of trails. The 164-acre project would make 10 percent of its rental units available for low-income households at 65 percent of the median income. "The plan features affordable and market rate housing for young families, working professionals, and seniors in very close proximity to thousands of jobs and a major transit center," said a statement from Jonathan Frankel, a vice president at New Urban West.Carmel Mountain Ranch golf course closed in 2018, amid a series of golf courses shutting down due to skyrocketing water rates. The course has since been fenced off, and is dominated by weeds and overgrowth. Now, a group of residents called Carmel Mountain United is raising concerns over the development in the golf-centric neighborhood. The neighborhood has several golf-cart crossing warning signs and its streets are named after famous courses.Troy Daum, who heads the group, says many people bought in the neighborhood because of the golf course. Now, his group is raising concerns that the development could increase traffic and make it more difficult to evacuate quickly in the event of a wildfire. Daum said New Urban West has ignored those calls and should instead focus on redeveloping area retail centers into mixed-use housing. "I don't think there's compromise with 1,200 homes," Daum said. "There's just not room in the community to handle that."Frankel says the project comes after neighborhood workshops and online surveys. A release from New Urban West notes upwards of 1,600 units could have been built on the property. The project is currently undergoing environmental review and will go through public hearings once that is complete. 2042

SAN DIEGO (KGTV) — A Good Samaritan discovered a cat and her 11 kittens inside a downtown dumpster San Diego recently. The San Diego Humane Society said it's now caring for the cat and her kittens, which is a rare size for any litter.“A healthy litter this size is incredibly uncommon and certainly not something we see every day in the nursery,” said Jackie Noble, SDHS kitten nursery manager.RELATED: East County woman loses hundreds of dollars in pet scamThe Good Samaritan told SDHS it didn't appear the cat was dumped there and may have been using the dumpster as a safe place to hide and care for her kittens.SDHS said the animals are all in good health. The animals will remain there until the kittens are ready to be put up for adoption and the mother is spayed."As cute as the kittens are, a litter this large highlights the importance of spaying and neutering. It is critical for the community to work together to spay and neuter community cats," the humane society says.Cats can become pregnant every three months, so it's possible for one cat to have more than 200 kittens in her lifetime, SDHS says. For more information on SDHS' programs for community cats, click here. 1189

SAN DIEGO (CNS) - Two San Diego City Council members called Wednesday on California Attorney General Xavier Becerra and District Attorney Summer Stephan to investigate San Diego City Attorney Mara Elliott's possible role in an alleged child sexual abuse cover-up at the San Diego Junior Theatre.Council members Scott Sherman and Vivian Moreno sent a jointly written letter to Becerra and Stephan imploring them to investigate allegations made by attorney Matt Valenti that Elliott improperly shared information on the case with then-Junior Theatre Board member Gil Cabrera, who Valenti claims tried to silence the case's whistleblowers."We are writing to respectfully request your respective offices' review and consideration for appropriate action, as the authority to investigate these complaints falls under the jurisdiction of your departments," their letter states. "We believe a timely resolution to the matter is in the best interest of all parties."RELATED: San Diego Junior Theatre teacher convicted of sex with underage studentHilary Nemchik, spokeswoman for the city attorney's office, suggested Valenti's allegations against Elliott are a political attack intended to benefit his lawyer, Cory Briggs, who filed paperwork last month signaling his intent to run against her for city attorney."Mr. Valenti has repackaged allegations he sent to the City Council, the District Attorney and the Attorney General more than two years ago," Nemchik said in an emailed statement. "If any law enforcement agency thinks further review of the Junior Theatre is warranted, we support that decision."In 2017, shortly before former Junior Theatre teacher Eric von Metzke pleaded guilty to unlawful sexual intercourse with a minor, Valenti sent an email summary to Elliott, Becerra and Stephan outlining his claims that Cabrera tampered with the investigation into sexual abuse allegations at the theater.Elliott, Valenti alleges, sent that email to Cabrera, disclosing sensitive information in the process. Elliott has maintained that Valenti made no effort to keep the email summary private or confidential by publishing it online. 2136
