Dramatic moments in a San Bernardino courtroom today as a prosecutor slammed a sledgehammer onto a table. He was simulating what he says is how a Fallbrook family of four was murdered in 2010. Charles Merritt is accused of killing his business partner, Joseph McStay, his wife Summer and their two young sons Giani and Joe Jr. The prosecution says Merritt was being sidelined from the business and owed thousands of dollars to McStay. The defense countered in their closing arguments that the prosecution focused on trying Merritt’s character and not the actual facts of the murder. The defense told jurors the circumstantial case produced no evidence tying their client to the family’s violent deaths. The prosecution told jurors they didn’t have to prove how, where or when the murders took place, only that Merritt committed them. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.In 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 1758
EL CAJON (CNS) - A 49-year-old man was seriously injured after being struck by a vehicle in El Cajon Saturday.The pedestrian was hit crossing the road by a Toyota pickup in the 400 block of Jamacha Road around 6:25 p.m. Paramedics found him unconscious but breathing with serious head and leg wounds, authorities said.El Cajon police say the driver remained at the scene and isn't believed to have been under the influence of drugs or alcohol.Sgt. Steve Paz of the El Cajon Police Department said Jamacha would be closed between Lexington and Sunnyland avenues until around 11:30 p.m., and reminded pedestrians and motorists to always be aware."Only cross the street at designated, controlled intersections, and wear bright or light-colored clothing for visibility," he said, addressing people out and about at night on foot. "For those driving vehicles during hours of darkness, please pay extra attention to the roadway and be aware of pedestrians that may be crossing." 980
Dick's Sporting Goods, the nation's largest sporting goods retailer, will stop selling assault-style weapons like the one used in the Parkland, Florida, high school shooting.The company said it will also raise the minimum age for all gun sales to 21. Dick's will not sell high-capacity magazines that allow shooters to fire far more rounds than traditional weapons without reloading, as well as other accessories used with weapons similar to the AR-15.The Parkland shooter, Nikolas Cruz, bought a gun at Dick's. EL CAJON, Calif. (KGTV) - El Cajon Police released a surveillance photo Friday in an effort to find the driver responsible for a deadly hit-and-run crash. Investigators said a newer silver four-door sedan ran down the unidentified victim in the intersection of East Chase and Lincoln Ave. about 6:30 p.m. on Wednesday, Nov. 6. A witness started CPR on the 58-year-old man but he died of his injuries after he was transported to Sharp Memorial Hospital. EL CAJON, Calif. - The grieving mother of an accused thief filed a lawsuit Thursday against the homeowner who shot and killed her son.The civil suit identifies the homeowner as Michael Poe, and it stems from an incident in the early morning hours of March 11. Police say the homeowner woke up to the sound of glass breaking. He went outside and found someone breaking into his work truck. His mother Monika Anderson said her son had a drug problem but was doing his best to stay sober.“He was on Suboxone, a drug to stay sober, and someone had stolen his Suboxone,” Anderson said. “Although it's really hard for me to imagine my son at 31 years of age would just start stealing, but I think he was just desperate for drugs and in a lot of pain. I don’t think he deserved to die over that.”Police are investigating the incident and no criminal charges have been filed. Anderson’s attorney, Dan Gilleon, said that investigation should not affect their civil lawsuit.“The bottom line is Joe shouldn't have died and at a minimum it's because this guy didn’t act reasonably,” Gilleon said. “This is not the Wild West. If you decide to play that gunslinger role, then you’re going to end up losing everything you own.”The lawsuit does not specify an amount.“It’s like a mother’s worst nightmare,” Anderson said in tears. “I told Joe, time and time again how much he meant to me.”Scripps station KGTV in San Diego has tried to make contact with Poe several times since the shooting happened, but have not heard back. 1759
