SAN DIEGO (CNS) - The wife of an active-duty Marine stationed at Camp Pendleton is due in court Thursday on charges of sexually abusing a 15-year-old foreign exchange student who was living with her family on the base.Nicole Marie Wilson, 22, is accused of engaging in sex acts with the unidentified teen on Sept. 20 against his wishes, according to court documents.A detention hearing is scheduled Thursday morning for Wilson, who pleaded not guilty Tuesday to a single count of sexual abuse of a minor in San Diego federal court.Court documents allege Wilson sat next to the boy on the living room couch and asked him to promise that he wouldn't tell her husband, no matter "whatever happens tonight."After their initial encounter made him uncomfortable, the boy told investigators he went to sleep and awoke to Wilson touching him, then performing oral sex on him. She asked him twice whether she should continue, and one time he said, "No," yet she continued anyway, then later had sexual intercourse with him, according to the criminal complaint.She later "apologized" to him "and acknowledged" that it was not consensual, the documents allege.Wilson allegedly told Naval Criminal Investigative Service investigators she had been drinking on Sept. 20 and "blacked out" while watching television with the boy, but denied anything sexual occurred. But a search of her cell phone revealed WhatsApp messages between herself and the teen that confirmed the sexual encounter, court documents allege.It was not clear how long the teen had been living with the family, nor what country he traveled from as part of the foreign exchange program. 1648

SAN DIEGO (KGTV and CNS) -- A San Diego County deputy facing charges that he groped 13 women was arrested again Thursday on five new charges, including forcible oral copulation.Richard Fischer, 32, is being held on million bail and is scheduled to be arraigned Friday morning in a Vista courtroom.Fischer faces more than 10 years if convicted on the new charges, according to the District Attorney. SAN DIEGO (KGTV) - A heartbroken local woman says her brother was killed in a Phoenix park while trying to 'protect his friends.'"He was infamous for making people laugh. He had a heart bigger than his being," said Amy Clark, Isaac Clark's sister. Last month, Isaac Clark, 23, moved from San Diego to Phoenix to be closer to his 4-year-old son. He had a job lined up doing event setup. Last Wednesday, Clark found himself in a park around 1 a.m. His sister Amy says he was checking on two friends, who had been evicted and were living in a car.Police say he heard a vehicle being vandalized, and headed toward the sound before realizing it was his friends' car. That is when the suspects approached Clark, sparking a fight. Clark was stabbed multiple times. He would die at the hospital."I feel like he died a hero. He tried to do the right thing. He was trying to protect his friends," said a tearful Amy Clark.Three people were arrested. Police say Maurice James, 24, and Eldon Sandoval, 18 are facing second-degree murder charges. A third person, Chantel Ben, 21, faces hindering prosecution chargers."They took my one-and-only sibling. They took my one-and-only baby brother from me," she said.An emotional vigil was held at that park a night after the incident. Clark's sister is haunted by their conversation about the violence in the world right before he left San Diego. "We were saying we just need to be more kind, more empathetic," she said.A grieving sister says that kindness was nowhere to be found In that park, early that morning."We need to get justice because he now has a 4-year-old son who has to live without him," she said.A GoFundMe campaign has been set up to help with funeral expenses and to set up a fund for his son. 1753

SAN DIEGO (KGTV) -- A 26-year-old was hospitalized late Saturday night after being struck by an SUV while riding his motorcycle.Police say the man was crossing an intersection at 5th Avenue and Ash Street around 9:41 when 82-year-old Herbert Green ran a red light and hit the 26-year-old.The rider flew off the bike when police say he hit a parked car with his head. He was taken to the hospital with life-threatening injuries. Officers were able to catch up to and arrest Green several blocks away from the scene of the crash. 545

SAN DIEGO (CNS) - Three San Diego County sheriff's deputies were justified in fatally shooting an Alpine man who charged at them with a knife in his hand last fall, according to a report released Wednesday by the District Attorney's Office.Daniel Ayala, 31, was shot 10 times outside his apartment in the 2600 block of Alpine Boulevard last Nov. 12.Sgt. Chris Katra, Cpl. Sean McGillicuddy and Deputy Kevin Nulton responded to that address around 2:50 p.m. following reports that a man was screaming, talking about killing himself and others, and throwing items, according to a letter prepared by District Attorney Summer Stephan and addressed to San Diego County Sheriff Bill Gore.Body camera footage from two of the lawmen was also released by the D.A.'s office.RELATED: Man who was fatally shot by deputies in Alpine identifiedAs the deputies approached the front door of Ayala's unit and knocked, announcing ``Sheriff's Department'' three times, Ayala opened the door, said ``What's up!'' and jabbed a knife twice through his metal screen door, the body-worn camera footage shows.The deputies backed up from the door as Nulton alerted the others by saying ``Knife, knife, knife.''Ayala then opened the screen door and advanced towards the lawmen, who opened fire, striking him mostly in the upper body, according to Stephan's letter.Ayala died at the scene. His 5-year-old son was inside the apartment during the entire encounter, but was physically unharmed, according to the district attorney.Toxicology results showed Ayala had methamphetamine, heroin, cannabis and alcohol in his system.Stephan's letter concludes that the deputies ``were in a confined space when Ayala advanced on them quickly with a knife in his hand.'' The letter also notes Ayala's previously reported statements about killing people.``The deputies had no other option available to them as they Ayala could stab them immediately and seriously injure or kill them,'' the letter reads.Katra has been employed by the San Diego Sheriff's Department for 18 years, McGillicuddy for 12 years and Nulton for 10 years. 2096
