SAN DIEGO (KGTV) -- A Bankers Hill woman may be forced to tear down part of her historic home to make way for a city park with an AIDS memorial.Otherwise, she faces thousands of dollars in daily fines from the city. Jennifer Hasso has owned the 1924 Tudor-style home since 1998. She says she's invested millions to restore it to its glory. The city even designated it as historic. The house sits at the end of 2nd Avenue in Bankers Hill. Right behind it, a nearly one-acre site on Olive Street the city is eyeing for a community park with an AIDS memorial. The park would also include fitness and seating areas, walkways and an overlook deck. County property maps show the city owns the land immediately north of Hasso's home, which has no setback from its property line. In fact, Hasso's bay window and chimney extend over that property line, and her entire backyard extend is across that line. 904

SAN DIEGO (KGTV) - A federal judge has ordered the San Diego Police Department to stop citing people for living in their vehicles.The decision comes after a lawsuit was filed against the city by a group of homeless people and their advocates.On Tuesday, United States District Judge Anthony Battaglia agreed with the plaintiff’s argument that the city’s municipal code was too vague in defining what constitutes habitation of a vehicle.Tristia Bauman, an attorney with the National Law Center on Homelessness & Poverty which helped work on the case told 10News, “we are very happy and pleased that the judge understood what we were arguing.”However, that was only one half of the lawsuit. The other half targeted the city’s municipal ordinance that outlaws RV parking from 2-6a.m. Known as the Nighttime RV Ordinance, or Oversized Vehicle Ordinance (OVO), the judge denied the request to enjoin it, saying the same argument did not apply.In the decision, Battaglia wrote “while the court sympathies that this Ordinance leaves Plaintiffs with nowhere to park between these hours and is decidedly unfair, the law is not ambiguous, unclear or vague in any way.”A spokesperson for city attorney Mara Elliot declined to comment beyond saying they “will review the ruling and advise our client.”An early neutral evaluation conference had been scheduled for Thursday with all the parties. SAN DIEGO (KGTV) — A new cancer treatment is now available at the Scripps MD Anderson Cancer Center.This week 31-year-old William Apodaca became the first patient in San Diego County to receive the unique form of targeted cancer therapy. Apodaca was diagnosed with a rare form of cancer three years ago when doctors found neuroendocrine tumors in his pancreas.Neuroendocrine tumors are formed in hormone-making cells. They can grow in spots like your pancreas, stomach, and intestines. “It's a rare tumor that patients can live decades with and the hope is to improve quality of life by minimizing their need for more toxic chronic therapies,” said Dr. Marin Xavier, a Medical Oncologist at Scripps MD Anderson Cancer Center. RELATED: FDA approves two cancer treatments after expedited reviews“It was just devastating,” remembers Apodaca, who is also a nurse. After chemotherapy and other cancer-fighting therapies, Apodaca was finally able to try the new treatment, Lutathera, after it was FDA-approved earlier this year. Lutathera uses radioactively charged proteins to seek and attack cancer cells from the inside out. It is administered in four doses, which are given approximately every other month until they are finished. Apodaca had been traveling to Los Angeles for the treatments but was able to complete his final one in San Diego. He now has more energy and looks forward to going back to work, traveling, and getting married.“This medication is pretty much giving me a second chance at life,” said Apodaca. “Picking up the pieces of where my life was.”The drug works for two to five years, depending on how aggressive the tumors are. Patients who respond well can get retreated.Fifteen local patients have already signed up to get the new treatment and more are expected to come from other cities. SAN DIEGO (KGTV) - A former San Diego Unified School District student and football player is suing the district.The lawsuit filed by Jason Srouy alleges he was never informed of the potential financial and legal risks of participating and playing an organized sport if a lawsuit were to be filed alleging any negligent or other claims against the student-athlete.In 2018 Srouy and the school district were sued by a referee. The referee was injured during a 2015 game and claimed it was done on purpose. He alleged Srouy had a history of unsportsmanlike conduct known and encouraged by the coaching staff.At the time Srouy told 10News he was playing wide receiver during the game, tasked with blocking the opposing cornerback. During the block, he says the opposing player fell onto the back of the referee's legs, injuring the official.In a previous interview, Srouy said after learning of the lawsuit a school official led his family to believe the district would help him; however that was not the case. “It wasn’t on purpose, it was an accident, I didn’t mean to hurt anybody," said Srouy.Srouy’s attorney tells Team 10 he was eventually dropped from the lawsuit but not before racking incurring more than 5,000 in costs and fees.A spokesperson for the district says they can’t comment on pending litigation. 1323
