SAN DIEGO (KGTV) - A family wants the Governor of California to keep the man who murdered three San Diego State professors behind bars. Frederick Davidson was sent to prison in 1997 for three consecutive life sentences without parole after he gunned down his three engineering professors Chen Liang, Preston Lowry, and Constantinos Lyrintzis.The San Diego County District Attorney’s Office recently notified the victims’ families that Davidson applied for executive clemency.“Just asking for clemency?  Out of what?  On what grounds?” asked a distraught Esther Alonso, Lyrintzis’ sister-in-law.  Lyrintzis was married to her sister, Deana Alonso, and the couple had a young daughter.A District Attorney’s Office spokesman said the DA’s office already filed a letter opposing Davidson’s request.Alonso told 10News she could not believe Davidson would request clemency.  Alonso said the family agreed to not seek the death penalty in 1997 if Davidson agreed to plead guilty and go to prison for life without parole.“How can they tell them 20 years later that the deaths of their husbands and their fathers…that this guy has more rights than they do?” asked Alonso, a professor at Southwestern College. “I don’t understand a system where that is even possible.”Alonso created a Change.org petition directed at Governor Jerry Brown asking him to deny Davidson’s request.The DA’s spokesman said their office opposed more than 50 clemency requests last year and none of those requests were granted.  The spokesman added there is no deadline for Governor Brown to respond or send it to a hearing. 1627

SAN DIEGO (CNS) - Two men who took part in a fatal Pacific Beach home invasion that resulted in the shotgun slaying of a resident were sentenced Friday to state prison terms.Carlos Yslas, 25, and Pedro Ramirez, 28, were sentenced Friday for their roles in the death of 44-year-old MarcAnthony Mendivil, who was shot in a home in the 2300 block of Wilbur Avenue on Dec. 29, 2018.Mendivil was living at the home of another defendant, Paul Charles Weinberger, 51, at the time of his death and was killed in what court documents describe as a forcible eviction gone wrong.Yslas, who was the gunman in the incident, was sentenced to 27 years in state prison, based on his plea to a voluntary manslaughter charge. Deputy District Attorney Flavio Nominati said Yslas was released from prison on a residential burglary conviction about a week prior to the shooting.RELATED: Three men plead guilty to Pacific Beach shotgun slayingRamirez was sentenced to eight years in prison on Friday, while co- defendant Freddy Sosa, 38, was sentenced last year to eight years in prison. Weinberger was sentenced to three years earlier this week.Sosa pleaded guilty to voluntary manslaughter, while Weinberger pleaded to an assault with a firearm charge.According to court documents, Sosa had previously lived at the home, but was kicked out by Weinberger following a dispute. Mendivil then moved in, but soon after, Weinberger contacted Sosa asking him for help in removing Mendivil from the home for unspecified reasons, investigators were told.Weinberger told police he was drugged on the night of Mendivil's killing and forced to withdraw cash from his bank to pay Yslas and Ramirez, who were brought in to assist in forcibly removing Mendivil from the home, court documents state.However, in the process of forcing Mendivil out, Yslas shot Mendivil twice. According to defense attorney Kristen Haden, Yslas believed the victim was reaching for a weapon, which later turned out to be a knife beneath his mattress.Officers found Mendivil suffering from a gunshot wound when they responded to a 1:47 a.m. call of a possible shooting, San Diego police Lt. Matt Dobbs said. He died at a hospital about 45 minutes later, Dobbs said.Weinberger and Sosa were arrested the day of the killing, while Yslas and Ramirez were already in custody on unrelated charges when they were re- arrested and charged last February for their roles in the homicide. 2430

SAN DIEGO (CNS) - Thunderstorms are occurring Wednesday throughout San Diego County in the midst of a heat wave.Coastal areas, the inland valleys, the deserts and the mountains will all have a chance of thunderstorms this afternoon, according to the National Weather Service.A high pressure system hanging over the Four Corners region is causing our heat wave while monsoonal moisture from Mexico is generating precipitation. Some light rain could accompany thunderstorms Wednesday before heavier showers are expected on Thursday, Martin said.A chance of thunderstorms will continue through Friday evening in the mountains and through Thursday evening in the deserts, while the thunderstorm activity is expected to clear out of coastal and inland valley areas by Wednesday night.Check your 10News Pinpoint Weather forecastThe chance of measurable precipitation has been set at 20 percent Wednesday for the inland valleys, coastal areas and the deserts, according to the NWS. SAN DIEGO (KGTV and CNS) - Trial started Monday for the Yuma, Arizona police officer accused of raping a woman during a visit to San Diego.Jared Elkins, 34, is charged with eight felony counts of rape for the alleged incident in September 2017.The 23-year-old woman’s mother called 911 to report a crime at a home on Marlborough Street in Kensington. Elkins, who is related to the alleged victim by marriage, was staying at her home.Elkins, the alleged victim, and two other family members went to dinner then watched a movie while drinking beer and wine at the home before the alleged assault occurred, according to prior court testimony.RELATED: Arizona police officer charged with raping San Diego womanThe alleged victim testified during a preliminary hearing in April that Elkins physically forced her to participate in sex acts despite her pleas for him to stop. The two other family members were asleep in the house so small "you can hear someone breathing in the next room," the woman testified.During the alleged assault, the woman said she asked Elkins what would happen if she cried out for help. "He said, ‘I would kill you,"' the woman testified. After the incident, the woman said she found another family member in the house and they called police.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Besides forcible rape, Elkins is charged with rape of an intoxicated person, forcible digital penetration, two counts each of forcible oral copulation and oral copulation of an intoxicated person, forcible sexual penetration and sexual penetration of an intoxicated person.Elkins -- a seven-year veteran of the Yuma Police Department who later resigned -- faces 14 years in prison if convicted, according to Deputy District Attorney Lisa Fox. 1834
