SAN DIEGO (KGTV) - San Diego County leaders have stressed education over enforcement regarding the rules and laws surrounding the coronavirus, but there are laws in place to help stop the spread."There is civil liability and criminal liability," says Professor Joanna Sax from the California Western School of Law.Sax says many of the laws rely on a standard called "reasonable care" to determine liability."As long as you are taking precautions reasonably, then it's unlikely that you'll be held negligent. That would be the legal term," Sax says.For businesses, that means following the rules like posting a safe reopening plan and sticking to it to keep customers safe. It can also mean providing PPE and hand sanitizer for employees.But for businesses that aren't using "reasonable care," San Diego officials have shown the ability and willingness to use the laws to force compliance.One of the most prominent cases over the last few months involves Boulevard Fitness in University Heights. According to the city, that gym stayed open for indoor workouts for 45 days, violating the county's rules. City Attorney Mara Elliott threatened Boulevard Fitness with a ,500 fine for each day, citing "unfair business practices."The gym closed after receiving Elliott's letter and has since reopened while obeying county guidelines for capacity and distancing.Sax says those kinds of laws work for extreme cases, but may not apply for smaller violations."If businesses are not behaving reasonably and they are behaving recklessly, and they have no plans, and they're letting people in, maybe they should face liability," Sax says. "Those aren't the businesses that should be open to the public. They're doing a disservice to the rest of the community."As for individuals infecting other people, the California Health and Safety Code has strict standards.According to Section 120290, five things all need to happen for someone to be guilty of "intentional transmission."The Code says: 1988

Wednesday’s meeting was the first step in the budget for the year. 10News spoke with Barbara Bry just before the meeting. “All nine of us have submitted our budget priorities. What’s interesting is there’s a lot of consensus among all of us as to how much the city should be allocating its funding," Bry said.The latest 10News-Union-Tribune polls shows the top issue as homelessness. It’s one of the issues Bry says will receive major support in next yea’s budget. Wednesday, the budget committee reviewed and adopted a set of funding priorities for what will be a priority for funding in the next fiscal year. The committee’s list is alphabetical at this point, so the issues aren’t ranked by importance. The list does, however, reflect what our poll uncovered: climate action, homelessness, parks and recreation facilities, public safety and sidewalk and street repairs are all important issues. As for our poll, homelessness and affordable housing came out on top at 21 and 20 percent respectively. SAN DIEGO (KGTV) — Residents in Ocean Beach are taking their concerns over what they say is a dangerous intersection to the OB Planning Board.Isaac Darby, Vice President of the OB Neighborhood Watch, says the intersection in question is Saratoga Ave. and Ebers St., situated near a children’s park and blocks away from Ocean Beach Elementary.The OB Neighborhood Watch group wants to see a four-way stop sign at the intersection. “People kind of pick up momentum seeing that the stop sign on Santa Monica is the last one all the way before the stoplight at Voltaire, so it’s kind of the last stop before you just can bonsai out of town,” said Darby.In addition to speeding, he says large trucks are often parked on the street causing blind spots. Darby says the intersection is most dangerous during the morning and evening commutes, for both drivers and pedestrians.Darby’s initial application to the city for a four-way stop sign was denied; he was told it didn’t meet city requirements. Now he and other residents are taking their concerns to the OB Planning Board in hopes of building a stronger case.The OB Planning Board Chair says the board can request a traffic study. Once it's complete, the city will review it and make a recommendation. “My plea is do something proactive before we have to be reactive and someone gets hurt or worse,” said Darby. “A lot of the little accidents and fender benders aren’t reported.”Darby says the community is only growing and that they hope to get ahead of problems. 1518

Elliott has heard complaints from neighbors and has filed a civil enforcement action to shut down a short-term vacation rental property in La Jolla that has been dubbed a "COVID party mansion."The complaint alleges that defendants are maintaining a public nuisance and engaging in unfair competition, including false advertising at the La Jolla Farms rental property located at 9660 Black Gold Rd. According to city officials, the rental property continues to operate in violation of state and county COVID-19 public health orders.According to a press release, Elliott is seeking civil penalties and a permanent injunction against property owners Mousa Hussain Mushkor and Zahra Ali Kasim, property manager Nital Meshkoor, and Steven S. Barbarich, who leased the property from Mushkor and subleased it as a short-term rental.City officials said the oceanfront mansion has been the subject of at least 30 calls to the San Diego Police Department. Officers have spent more than 173 hours at the property to investigate nuisance activity. Most of the incidents involved raucous parties, some of which had up to 300 attendees.Elliott said about a dozen of the party complaints came during the COVID-19 pandemic, while public health orders prohibited large gatherings.According to the press release, concerns about the property were brought to the City Attorney’s Office by San Diego police and by neighbors who reported that the situation was "becoming more pronounced as the COVID-19 pandemic progressed." “Shutting down dangerous party houses protects the public health by preventing COVID super-spreader events and other illegal behavior,” Elliott said. “It’s unfortunate that San Diego does not have short term rental regulations in place. Relief for this neighborhood would have come much sooner. Instead we must rely on time-intensive prosecutions at significant taxpayer expense.”According to the press release, gunfire was reported to police during a party in May of 2019. Officers arrived and found a large party in progress. Partygoers questioned by police admitted gunshots were fired during a fight that had occurred earlier. Police found shell casings outside the property and a neighbor found an additional casing the next day and turned it over to police. The City Attorney's Office assembled evidence from investigations by SDPD, the Code Enforcement Division of the City’s Development Services Department, the County Health & Human Services Department, and the City Fire Marshal. Elliott hopes the action makes the owners clean up the property and relieves neighbors. 2644
