SAN DIEGO (KGTV) -- A San Diego family is hoping to make their way home from Mexico on Thursday after having to ride out Hurricane Delta at the hotel where they were staying. Victor Lopez is a local restaurant owner of El Pollo Grill. Lopez's family traveled to Playa Del Carmen, Mexico last week. As Hurricane Delta was approaching, they booked a flight to leave the region, but their flight was canceled as they were heading to the airport. As the hurricane was approaching, the family was moved to a hotel ballroom where they spent the night as the hurricane passed. Lopez says there were no windows in the ballroom so they could only hear the heavy rain and strong winds. Lopez admits that the ballroom was crowded and there was some concern of COVID-19, but he said the hotel staff was disinfecting constantly and everyone was wearing masks. The hurricane did little damage to the resort in Playa Del Carmen, but just 45 minutes away in Cancun's hotel zone, debris and palm fronds were scattered all over the streets. Lopez and his family are hoping to return to San Diego on Thursday afternoon. Hurricane Delta is expected to make landfall in Louisiana on Friday afternoon. 1188

SAN DIEGO (KGTV) - A La Jolla homeowner is facing millions of dollars in damage to his property after massive amounts of water flooded into his house Tuesday.Didier Jantz, the general contractor for the homeowner, said the owner wasn’t home when the water began flooding in. Crews doing work on the home on Encelia Drive noticed the water start coming in around 3 p.m.Crews say the water came from a neighborhood property, though it's unclear what ruptured and released the water. The city told 10News they sent a crew to turn off the water at a residence due to some type of leak, though it's unclear where the leak was and what caused it.“There are Asian Persian rugs everywhere, there’s a lot of personal damage, we got water in the walls, we got water in the ceilings, we got water coming through the ceiling lights,” Jantz said. 842

SAN DIEGO (KGTV) - A man accused of causing a flood which some tenants confused for a terrorist attack faced a judge Wednesday to enter his not guilty plea.A Deputy District Attorney argued that Francisco Morales is a danger to the community."He poses a great threat to the community as there are over 200 individuals, citizens in the community of Little Italy who cannot go home; they have essentially lost everything," she said.The judge agreed, and raised Morales' bail from 0,000 to ,000,000. Morales faces 45 counts of felony vandalism and 5 counts of assault intended to cause great bodily injury.Several residents were forced to flee from their Little Italy apartment complex Monday morning after police said Morales opened pipes and used a fire hose to flood all eight floors of the building.Water from the hose and pipes made its way down to all floors, including the basement, according to authorities. Multiple witnesses said some residents were waist- or shoulder-deep in water as they tried to leave."It was like a waterfall coming down on you of water," tenant Ryan Lange said. "When I came down to the bottom floor there were people crying, we're trapped, we're trapped we can't get out!"Some residents said Morales sprayed them with fire hoses as they evacuated the building.Officers located Morales in the lobby and arrested him on suspicion of vandalism."It seemed like somebody was trying to kill everybody in there," Lange said the pain hasn't lessened over the past two days. "I feel like it's unlive-able; it smells like musty and moldy, looks like they're going to have to redo all the carpets and the drywall."Lange lives in one of the 45 units destroyed by the flood. He said he estimates his losses around ,000, not including his car.10News learned more than 200 people and their pets were displaced from the 100-unit complex.The building was being evaluated for any potential structure damage. SAN DIEGO (KGTV) - A program through the County's office of Child Welfare Services is making sure every kid in the foster program gets to celebrate this holiday season.The "Home for the Holidays" program pairs kids in the foster shelters with families for a holiday, so they don't have to spend the holiday alone."This is a great opportunity for families to kind of try it out and see what it's like to work with our youth," says Kimberly Giardina, the Director of Child Welfare Services.Right now, San Diego County has about 140 kids in the foster program that need a foster family. While this program doesn't give them a long-term solution, it helps the kids through a difficult season."People open their homes," says Giardina. "They see that our youth are just like every other kid in the neighborhood."Nanci Weinstein, who has fostered three kids through the county and adopted one, says it's an experience that's invaluable for both the kids and the families."I can't imagine what that might feel like for a child," she says. "Every moment is precious because this child is in a situation where they need someone to take care of them."Families interested in participating in the Home for the Holidays program need to complete a background check, home safety inspection, training and orientation. SAN DIEGO (KGTV) -- A new law in New Jersey could have an impact on San Diegans who claim they were sexually abused in the Boy Scouts.Attorneys with the law firm PCVA say they plan to bring new cases under New Jersey's new statute of limitations and window when the new law goes into effect on December 1, 2019.They say the new law will allow survivors in California and other states to file suit against the Boy Scouts for any abuse that occurred during the 30 years that that organization was based in New Jersey."We intend to hold the Boy Scouts accountable under this new Jersey law because the organization knew for decades while its headquarters was based in New Jersey, that thousands of scout leaders had used their position to groom and sexually abuse children," said attorney Michael Pfau. 10News asked San Diego attorney Andrew Van Arsdale how the new law makes it possible for alleged survivors outside of New Jersey to file a legal claim in that state."Their theory is New Jersey was home to this corporate entity for a period of 25 years so during that period of 25 years no matter where that abuse occurred in the country the corporate entity existed in New Jersey, we can sue that corporate entity in new jersey," he said.Van Arsdale is one of the lawyers involved in the group "Abused in Scouting." The group came together after hearing the Boy Scouts were potentially filing for bankruptcy. They began a campaign telling victims that they no longer have to be in hiding."By going to the states or areas where these defendants are incorporated that's a way to get at them," Van Arsdale said. "If these guys out of Seattle are correct and New Jersey was the home of the organization for a period of time they should be able to get them. The same way we're using Washington D.C. to file 1,100 of our lawsuits."Lawmakers in California are attempting to pass a similar version of New Jersey's new law. Assembly Bill 218 was introduced earlier this year by San Diego Assemblymember Lorena Gonzalez.According to the online text, "This bill would expand the definition of childhood sexual abuse, which would instead be referred to as childhood sexual assault. This bill would increase the time limit for commencing an action for recovery of damages suffered as a result of childhood sexual assault to 22 years from the date the plaintiff attains the age of majority or within 5 years of the date the plaintiff discovers or reasonably should have discovered that the psychological injury or illness occurring after the age of majority was caused by sexual assault, whichever is later. This bill would also provide for the recovery of up to treble damages against certain defendants in these actions, and would revive time-lapsed claims in certain circumstances."On Tuesday Gonzalez sent a series of tweets regarding the bill writing, "A moment on our #AB218 easing the statue of limitations for survivors of childhood sexual abuse: I know that school districts are worried that they may be sued. And that will cost public education in the state. I can't say that won't happen. If they covered up the abuse they will be held liable. And they should be. That's the only way we will stop the pattern of abuse that institutions have been covering up for decades. Inaction by sports clubs, schools, churches, Boy Scouts, boys & girls clubs have allowed perpetrators to continue to create new victims. This has to stop. It's time we take child sexual abuse seriously.
