SAN DIEGO (KGTV) -- Once election results start to come in, some of the races could be so close to call that they could lead to legal battles in court. Eugene Volokh, a constitutional law professor at UCLA, explained that it is likely some races could be so close that we won't know the results for a few days, maybe even weeks. When it comes to the presidential race, Volokh said that if the results are a landslide, the likelihood of legal challenges are close to none. If it's a tight race, Volokh said we could see litigation in states where it is just too close to call. Recounts are also possible, but the professor said that it wouldn't be a national recount; instead, it would only focus on the states that have tight races. Across the country, there have already been some legal battles. In Houston, a federal judge refused to invalidate nearly 127,000 drive-thru mail-in ballots following a lawsuit filed by a group of Republicans. In Nevada, a judge rejected another GOP lawsuit aiming to stop early voting over signature-matching software and observers when votes are being counted. SAN DIEGO (KGTV) — Police have identified the man stabbed to death in a Pacific Beach bathroom this week.San Diego Police said officers were called on Sunday to a public restroom at 700 Grand Ave. to reports of a man who had been stabbed. Nearby lifeguards and firefighters were the first to arrive and started providing first aid to the man.Police said the victim, 39-year-old Michael Wagley, had puncture wounds to his upper torso and was taken to a nearby hospital, but died of his injuries. Police said Wagley was new to the San Diego area and had no established residence.RELATED: Man fatally stabbed in Pacific Beach bathroom, San Diego police sayAfter police arrived to the scene, several witnesses reported the suspect fled after the stabbing. A man matching the suspect description, later identified as 33-year-old Martin Alvarez, was detained in the area and later arrested for murder.Police are still investigating the events that led up to the stabbing and a possible motive. SAN DIEGO (KGTV) - President Trump's call for some teachers to be armed is sparking local debate.Linda bought her first handgun three years ago for personal protection. She's a local music teacher at elementary, middle and high schools who applauds the President's idea. "It's a good idea because we're going against violence people doing violent things. I can't protect all 30 of my students with pencils, erasers and rulers," said Linda.RELATED: Trump pushing to 'finally do something' on gunsEric Heins, President of the California Teachers Association, is in town for the state Democratic convention and says schools should not be a war zone. "To try and militarize a student campus by introducing more guns is insane. SAN DIEGO (KGTV) - Police are searching for a mystery shooter that appears to using moving vehicles for target practice on a road in La Jolla.On Thursday just past 10 p.m. on La Jolla Parkway, Judy Chance was in her minivan running errands. It happened about a quarter mile from the fire station."Bang, bang, bang, bang. Basically all at once," said Chance.Her minivan was under attack."Enough to caused me to jerk back. When I looked, I saw circles in my windshield, like target practice," said Chance.On the windshield were at least six circles. Whatever caused them cracked but didn't puncture the glass."I was shocked. I was scared but had to regain composure as I was driving," said Chance.Chance pulled over and called police, feeling frightened, but grateful."Luckily I was going slow. I could have gone off the road. Glad my side window was closed," said Chance.Chance was not the only victim. Just minutes prior, in the same location, a couple driving a Mercedes says they heard a loud blast and saw a flash, before their windshield was pelted with shots. Some eight circles were found on their windshield. Was it a BB or pellet gun? One gun expert told 10news the flash and grouping may point to a shotgun, possibly loaded with birdshot. Chance says there were no vehicles around them, so the shooter may have been standing on the side of the road.Detectives say they don't have any suspect description.
