(KGTV) -- A strong warning from the mother of a La Jolla teenager injured in a deadly car crash on the way to Coachella.10News spoke with Eva Cerciello at the hospital where her daughter is recovering. Doctors have taken out her feeding tube and she is now awake.Sadly, her cousin was killed in the crash while the driver walked away with minor injuries. Cerciello says she’s been relying on prayers and positive thinking for strength.As more San Diegans head to Indio for weekend two of the Coachella music festival,Cerciello has a harsh warning that they shouldn’t put themselves in danger.She nearly lost her daughter last week. “She's like a miracle,” Cerciello said. Manuela Cerciello-Rahbari, 16, suffered severe brain damage when the BMW she was in with her cousin and a friend who was driving veered off the road.They slammed into two trees on I-10, 40 miles away from the festival. “Their main goal was to be there at 7 a.m.,” Cerciello said.They left around 3 a.m., but never made it. “The driver fell asleep while driving. They were both asleep, my niece and my daughter,” she said.Cerciello says she even called to warn them. “If you're tired, you need to stop. You don't keep on going,” she said. “You can’t challenge your body.”Their car was part of a caravan with friends and Cerciello feels peer pressure played a deadly role. “I know the kids were texting ‘speed up, speed up’ because we have all the messages.” Now, she's passing along her own message to other parents and their children.“Parents, they think ‘Don't drink. Don't drive. Don't do drugs…and everything will be fine.’ No, not everything will be fine,” Cerciello said.To be clear.. no drugs or alcohol were involved the crash, but she just wants people to see the reality of poor-decision making-- and says be smart.“You will never have the same life again. Never. Never. Because even if physically you are ok, psychologically you will never be the same.”While Cerciello knows her daughter's future is unclear... “I need to be strong. If I'm not strong, who's gonna be strong?”She doesn't want anyone else to experience her pain. "[If] I can help even one person, I’m good with that.” It’s is an eerily familiar situation for Cerciello.Four and half years ago, her son, Carlo, was also in a major accident and suffered brain damage.He is still in physical therapy today.In the meantime, the family has set up a GoFundMe page to help pay for medical expenses as well as research for brain injuries. (KGTV) -- DoorDash announced Thursday that the information of 4.9 million users was affected by a data breach. The company said in a blog post that 4.9 million consumers, Dashers and merchants who joined before April 5, 2018 were affected. According to DoorDash, profile information including names, email addresses, delivery addresses, order history, phone numbers and hashed, salted passwords were accessed during the breach. The company says the last four digits of payment cards and bank accounts were also compromised for some consumers, delivery workers and merchants, but full credit card and banking information was not accessed. For 100,000 Dashers, driver’s license numbers were also accessed, the company said. DoorDash says it’s in the process of notifying those affected. The company says a third party accessed the data on May 4, 2019 and that it only became aware of the hack earlier in September. Get more information here. 947

(KGTV) — A federal judge has denied Stone Brewing's request for a preliminary injunction in its lawsuit against MillerCoors over its Keystone Light product cans.Stone's motion to dismiss MillerCoors' counterclaims were also denied. The injunction would have prevented MillerCoors from using the rebranded cans during trial, according to IP and craft beer attorney Brendan Palfrey. More court documents can be read on Palfrey's Twitter page.Stone Brewing filed the suit against MillerCoors in February 2018, after the beer maker rebranded its Keystone Light products to feature "Stone" on a separate line in bold fashion.RELATED: San Diego's Stone Brewing sues MillerCoors over Keystone cans: 'We will not stand for this'While Stone lost out on the injunction, the judge did say Stone's trademark infringement case is “moderately strong." The judge added that the court agreed with Stone, "especially considering the marks incontestability, [Stone] is entitled to the strong protection afforded to suggestive marks."The case will likely now move to trial.Following the ruling, Stone's cofounder Greg Koch issued a statement, saying the court confirmed their case against MillerCoors.“This is a very big deal. The Court’s order confirms what we knew: that MillerCoors should be ashamed of what they have been doing. All along this has been a clear-cut infringement case, and now we can focus our resources on proving the significant damages done to the good name of Stone Brewing," Koch said.Stone CEO Dominic Engels added, "We are pleased that the Court recognized the validity of Stone’s infringement claims. MillerCoors has made hundreds of millions of dollars from rebranding Keystone in a way that infringes on our trademark. (KGTV) - KGTV and Team10 have launched the Transparency Project to allow the public to view case files from San Diego County over the past 10 years where officer involved shootings and law enforcement misconduct cases were investigated. For many of these cases, the officers were cleared of wrongdoing. Others resulted in officers being reprimanded, fired or even charged criminally --- but all of these cases resulted in community reactions. Transparency Project Database: Search officer-involved shootings, law enforcement misconduct casesThese case files were released after Senate Bill 1421 went into effect on January 1, 2019. It requires California law enforcement agencies to make internal reports for officer-involved shootings and major uses of force, officer dishonesty and confirmed cases of sexual assault available to the public. You can view the cases that have been released by the police agencies here. The project includes a searchable database, where you can find cases by the name of the officer involved, the name of the victim/suspect, the department and much more.
