LARGO, Fla. — The family of Linus Phillip, a man killed by a Largo Police officer in Florida on Friday, is accusing detectives of using the dead man's finger to gain access to his cell phone.On Friday, police approached Phillip's car at a WaWa gas station in Clearwater. Police said the vehicle he was driving had illegally tinted windows. While standing near Phillip's car, the officers claim they smelled the odor of marijuana coming from the vehicle. Police claim Phillip tried to drive away and use his car as a deadly weapon. One officer, Matthew Steiner, says he was dragged by the car when he tried to open the door and feared for his life.Phillip was shot and killed by police. He did not have a gun in his possession. Steiner, a seven year veteran with no disciplinary action against him, was injured during the incident but is OK.Phillip's family is demanding surveillance video from the incident at the WaWa gas station in Clearwater where he was killed. Police claim the encounter was not caught on video, only officers giving Phillip CPR.The family lawyer, John Trevena was surprised."There was no denial of the video to the family so this is the first I've heard of that," said Trevena.The family also claims that detectives used Phillip's lifeless finger to access his phone at the Sylvan Abbey Funeral Home."So they are allowed to pull him out of the refrigerator and use a dead mans finger to get to his phone. Its disgusting," said Armstrong.Police did not comment on the allegations, citing that there is a still an active investigation into the case.Phillip's mother, Martha Hicks started crying during an interview on Wednesday."They killed him after his 30th birthday. Oh god, he turned 30 on March 11," Hicks said. "It's too much too much we just want to know what happened."The couple has two children together. Their young daughter lost her battle with leukemia last year.Their son, Isaac is 16 months old."My son is no longer going to go have a father, or to make his dad proud. He's not here anymore because of this and the police are slandering his name like some awful person," said Armstrong. "We are fighting to find out what happened." 2240

(KGTV)-- Hundreds of strangers came together Sunday morning to clean up the aftermath of Saturday night's La Mesa riots.There is a sense of love and support Sunday morning in downtown La Mesa. Strangers worked collaboratively to reverse the effects of what transpired Saturday. What began as a peaceful demonstration quickly turned into a violent protest. By early afternoon, people were blocking Interstate 8 and taking out their frustrations on SWAT Bearcat vehicles.The pandemonium continued into the night. Police deployed tear gas, protesters set cars and local shops on fire. Looters took advantage of the chaos."[It was] just a crazy scene," La Mesa property owner Tony Gaipa said. He said he was one of the lucky ones. "If you're in front of your building, they kind of left you alone, but the building next door didn't have anybody, and they would just pop the glass," Gaipa said. 10News met John Douglas as he was cleaning up in front of his wife's workplace-- an engineering firm that is now burned to the ground. "I saw signs last night like 'Racism Sucks' and 'Black Lives Matter.' Well, what about the black lives that got affected by this?"As an African American man, he understands people wanting justice, after seeing so much of the opposite. But he says what happened Saturday is not the answer."We can't do stuff like this. This is not helping. It's just wrong," Douglas said. He and hundreds of others spent hours sweeping the asphalt, painting over the graffiti, and drilling over broken walls to repair their beloved downtown. "I've heard nothing but positive things from everyone today," Douglas said. "Couple of bad comments from people driving by, but that's one bad seed. If that doesn't spread, there is no cancer. LA MESA (KGTV)— Meteorologists are predicting a wet Christmas week in San Diego. 10News revisited residents at the San Diego RV Resort in La Mesa that dealt with a Thanksgiving flood to see if they are prepared for the next set of thunderstorms. Taylor Jaime showed 10News around the RV resort. "She [My mother] was cooking a turkey at my sister's house for Thanksgiving," Jaime remembered. She said she never got to enjoy that turkey after her home got washed away. Jaime and her family live at the San Diego RV Resort full-time. On Thanksgiving day, heavy rains inundated the ravine that runs parallel to the resort. "So the water started coming over this [the wall]," Jaime motioned. The retaining wall collapsed and the water came up waist-high, destroying two of her cars, their 40-foot trailer and everything inside. Unfortunately, their the new RV was insured at the time of the storm. "The water was so nasty. There was crab, there was fish in the trailer," Jaime remembered. According to the Federal Emergency Management Agency (FEMA), the RV resort is right in the middle of a heavy flood zone. The resort staff told 10News they just finished rebuilding the wall Saturday. In the last month, Jaime said she saw Caltrans and California Conservation Corps workers clean up some of the debris, but she fears another collapse. "The water won't be able to go through. It'll get stuck down there, like last time," pointing at the west end of the resort lot.With heavy rains forecasted during Christmas week, some of Jaime's neighbors have already lined sandbags along their lots. Lucky for Jaime and her family, they have a spare trailer, albeit an older and smaller one. They parked it away from the ravine and closer to the entrance gate. Six people and several small animals are now crammed inside the trailer. They didn't skimp on holiday decorations, though."We are still in the spirit," Jaime said. "It's not going to bring us down. We are still a family. We still have each other. And that's what matters the most."10News reached out to San Diego RV Resort's parent company for comment to see if they are making other preparations ahead of the storm.
