Peter Sean Brown was born in Philadelphia. He'd only spent a day in Jamaica once on a cruise.But even though he repeatedly told authorities in Monroe County, Florida, that he was a US citizen, according to a federal lawsuit filed Monday, they held him in custody and threatened that he was headed to a Jamaican prison, citing a request from Immigration and Customs and Enforcement.Now, more than seven months after he allegedly ended up in an ICE detention center, Brown, 50, is suing the Monroe County sheriff, alleging he was illegally detained.Monroe County Sheriff's Office spokesman Adam Linhardt and ICE spokeswoman Dani Bennett declined to comment, saying their agencies don't comment on pending litigation.The complaint filed by a coalition of immigrant rights groups Monday in US District Court for the Southern District of Miami details Brown's allegations about his April 2018 detention and its aftermath."Despite his repeated protests to multiple jail officers, his offer to produce proof, and the jail's own records, the Sheriff's Office held Mr. Brown so that ICE could deport him to Jamaica -- a country where he has never lived and knows no one," the lawsuit says.Brown was detained in early April 2018 after turning himself in for a probation violation, the lawsuit says.After his detention, authorities allegedly sent information about him to ICE, and in response the agency issued what's known as a detainer request, paperwork that asks local law enforcement agencies to hold a person for up to 48 hours beyond when they would otherwise be released so that ICE agents can pick them up.As a result, the lawsuit alleges, Brown was illegally held in detention and eventually transferred from the local jail to the Krome immigrant detention center in Miami.He was released from ICE custody after a friend sent a copy of his birth certificate to ICE, according to the suit."After confirming that Mr. Brown was a US citizen, ICE hastily arranged for his release from Krome. Before he left, they confiscated all the documents they had given him regarding his impending deportation," the lawsuit says.If his friend hadn't been able to provide a copy of his birth certificate to ICE, Brown would have been deported, the complaint alleges."It's shocking and not right that somebody can lose their human rights and have all dignity stripped away simply because someone delivers a piece of paper or signs a form," Brown said in a statement released by the American Civil Liberties Union, one of the organizations representing him.Attorneys representing Brown argue that the case highlights flaws in ICE's detainer system and shows why local authorities shouldn't do the agency's bidding."Peter's frightening story should make sheriffs and police chiefs think twice before agreeing to hold people for ICE," wrote Spencer Amdur, a staff attorney for the ACLU's Immigrants' Rights Project.Attorney Jonathan N. Soleimani said in a statement that the sheriff's "practice of blindly effectuating ICE detainer requests -- even where there is clear evidence undermining their basis -- resulted in a violation of Mr. Brown's constitutional rights."ICE has said it issues detainer requests to local law enforcement agencies to protect public safety and carry out its mission.But the practice is controversial. Advocates for sanctuary cities, local jurisdictions that don't cooperate with ICE when it comes to immigration enforcement, accuse the agency of targeting people who don't pose public safety threats.Brown isn't the only US citizen who's been detained by ICE.An investigation by the Los Angeles Times earlier this year found that ICE had released more than 1,400 people from custody since 2012 after investigating citizenship claims.Matthew Albence, a top ICE official, told the newspaper that the agency takes any assertions that a detained individual may be a US citizen very seriously.ICE updates records when errors are found, Albence said in a statement to the Times, and agents arrest only those they have probable cause to suspect are eligible for deportation.In a video released by the ACLU, Brown explained one reason behind his lawsuit."I would never have expected in a million years that this would happen, and I can tell you it's not a good feeling. And with policies like this in order and people implementing them like that, it was only going to continue," he said. "There has to be a stop at some point, before it becomes all of us." 4487

PHOENIX — An Arizona ICU nurse does not mince words when detailing what work and life are like during the COVID-19 pandemic. Tough shifts and a potential surge that he fears will only get worse."As soon as I park, I have very low expectations these days," said Eddy De La Torre, a nurse at a Phoenix-area hospital. "It sucks to say that but it's just bad all around."De La Torre said staffing continues to be one of the biggest challenges given the increase in patients."The biggest issue is surrounding staffing," he said. "Staffing in a sense that with the amount of patients that are in the hospital, we're finding it harder and harder to find ways to provide each patient a nurse in the safest manner possible."He also described seeing extremely sick patients, and a staff that is feeling the effects of working on the front lines for months."We're exhausted, man," he said. "We're exhausted."As ICU beds become a scarce resource around the state, De La Torre told ABC15 those beds are in low supply at this hospital. As of Wednesday, the Arizona Department of Health Service's dashboard there were 9% of ICU beds available."It's very few," he said. "And it's smaller and smaller every day."Also on Wednesday, ASU Biodesign Institute Executive Director Dr. Joshua LaBaer said a peak of the current surge may not come until late January or early February."I hope they're wrong," De La Torre said. "If that is the case, then we're going to be in for a rude awakening because that's going to be bad because right now it's horrible."He also told KNXV-TV that fellow staff members are stretched thin and working to handle the uptick in patients."I wish I can tell you that I've been able to talk to a COVID patient," he said. "The last few times I've worked on that unit all my patients have been intubated and the majority of the patients in the ICU are intubated and really sick."He also talked about the ripple effect the surge has across the hospital."Oftentimes we get told, especially in our staffing meetings, that we have A, B and C patients waiting for rooms," he said. "They can be waiting for a couple hours."In the ICU, with visitor restrictions in place, De La Torre noted the mental toll this takes on front-line workers and the patients, both COVID and non-COVID, with family support left to come only via an iPad."The tears are back," he said. PALA MESA, CA (KGTV) -- 10News is now digging deeper in the history of violations issued to the company that operated the bus that was involved in this rainy Saturday's deadly crash on I-15 just south of Pala Mesa. “One life lost is too many,” says Chris Turner with the Commercial Vehicle Safety Alliance. We spoke to him over FaceTime on Monday. The bus was operated by Executive Lines Inc., based in El Monte. According to the federal administration that oversees bus inspections, the company's fleet has had no crashes over the past two years, until now. However, they have had 26 maintenance violations, reportedly. After a November 2019 inspection, the same bus that was involved in this weekend's crash was reportedly issued two violations related to windshield wipers and spare fuses. Turner says violations like those should’ve been fixed right away. “Those need to be remedied before the vehicle is dispatched again,” he adds.10News spoke to attorney Nathan Morris about a separate major bus crash that happened last September in Utah, injuring 22 tourists. He's representing seven of the victims. “[I’m representing] three of those who were killed in the crash and their families as well as four others who were injured to various degrees,” he adds.Morris says bus passengers can look online for a snapshot of a company's safety. “They have a right as passengers of that bus to make sure that the driver and the companies and anybody else are held accountable for keeping the rules,” he says.“You enter the company's USDOT number and it will tell you whether or not they’re a safe company,” says Turner of researching bus companies online. A USDOT number is issued by the Department of Transportation. If you can’t find it on a company’s website, Turner says you can make a phone call. He adds, “One of the things they should readily give you when asked is the USDOT number and if not, that's immediately a red flag. Why won't you provide the number that just lets me check to make sure you're safe?”10News contacted Executive Lines Inc. on Monday to ask if there was anyone who could speak about the crash. The Department of Defense commissioned a 6-month long study using a United aircraft to learn more about the risk of COVID-19 exposure while flying.Mannequins were used to simulate coughing with a mask on and off. Sensors were placed in seats all over the plane to detect particles.It found after 300 tests both in the air and on the ground that when someone is wearing a mask, only .003% of particles made their way into another passenger's breathing zone, virtually 0%. Almost all particles are filtered out of the plane's cabin within 6 minutes.Last week, separate research by the International Air Transport Association found 44 published cases of potential in-flight transmission.
