SAN DIEGO (KGTV) — San Diego County officials warn we may officially drop into the dreaded, most restrictive, purple tier next week due to the rising COVID-19 case rate.“This is not a rollback, this is a devastation,” said Jon Weber, co-owner of Cowboy Star Restaurant and Butcher Shop in the East Village. “The same metrics that work in smaller counties don’t necessarily work in larger counties.”Under the state’s purple tier, restaurants would have to close indoor dining and move outside. Right now, in the red tier, they’re allowed to operate inside at 25% capacity.“We’re on 10th Avenue, we don’t have any space to put any outdoor seating, we’re on a busy street,” said Weber, who got through the first shutdown with PPP money, which is now gone.“If we close, we may never open again,” he said. “The idea of laying off 50 employees right before the holidays is pretty hard.”Other restaurants able to operate outside worry rain and cold weather will keep customers from dining outdoors.“There’s going to be challenges with cold weather, some of this stuff is just out of our control,” said Cesar Vallin, the managing partner at Cloak & Petal. “If you stay open, now you’re opened illegally, now you open yourself up to lawsuits from staff, ABC can come in and take your liquor license.”Like Weber, Vallin also worries about layoffs when moving from the red to the purple tier.“It’s not a light switch, I have to lay everybody off properly and then bring people back on, and not everybody comes back,” said Vallin. “There’s no support from the government, they’re still asking us for employment taxes, they’re still asking us for sales taxes; It’s a major letdown.”Under the red tier, gyms and fitness centers can operate inside at 10% capacity.Scott Lutwak, the founder and CEO of FIT Athletic Club, said that capacity is already a difficulty at his five locations across the county.“We’re mortified at the concept of moving into that purple tier, which represents us at zero capacity, being closed 100 percent,” said Lutwak.“We’ve been conducting classes outside regardless of weather, but now it gets dark earlier,” he said. “In our facilities, we have millions of dollars’ worth of really extensive equipment that can’t be brought outside because as soon as you bring it outside with saltwater air, you can’t bring it back inside.”He said right now he does not plan on shutting down inside or moving equipment outside.“As long as I feel like I can provide a safe environment for my employees and safe environment for my members, which we have proven we’re able to do so, I think we have every intention on keeping our doors open until we’re forced to do otherwise.”Lutwak said he believes his centers are essential, and therefore should be able to remain open.“We’re providing rehabilitation services, we consider our facilities as essential, and we have sent some letters out to each of the mayors in the cities where we’re conducting business,” he said he has yet to hear back.Besides restaurants and fitness centers, houses of worship, movie theaters, museums, zoos, and aquariums would also have to end indoor operations.San Diego County will find out next week if we have officially moved back into the purple tier. 3240

SAN DIEGO (KGTV) — San Diego County schools are one step closer to bringing students back to campus. If we get off the state’s watchlist Friday, kids would be allowed back in-person in as soon as two weeks.But, some districts tell ABC 10News they would still need more time.Supervisor Nathan Fletcher hinted at a victory for the county Thursday afternoon.“Yesterday we were below the state guidance, today we’re below the state guidance,” said Fletcher. “Tomorrow if we’re below the state guidance that will remove us from the state monitoring list.”RELATED: San Diego County case rate under watch list threshold for second straight dayThose metrics are based on having fewer than 100 cases per 100,000 residents over two weeks. If we can stay off the watch list for 14 days in a row after being removed from the state's list, students will be allowed back on school campuses.But, that doesn’t mean it will happen right away.“All of us have been watching those numbers,” said Theresa Kemper, Superintendent at Grossmont Union High School District. “When it finally went under 100, there’s a celebration because we look forward to getting kids back.”RELATED: Private school in Spring Valley to reopen with in-person learningKemper says they plan to give parents and teachers a two-week notice before they would return in-person.“Classrooms are already ready to go, but it’s all the other services we provide,” said Kemper. “Are the buses ready to go? Food service?”For Cajon Valley Union Schools, the district says they successfully welcomed 6,000 students to 27 of their campuses for summer programs. Social distancing and mask requirements were in place. They tell us over the six-week period they did not have a single case of COVID-19.Superintendent David Miyashiro says even if the county can welcome students back, they would still need time to prepare.“To say we’d be able to open right away, I don’t feel comfortable with that,” said Miyashiro. “The short answer is as soon as possible starting with our most vulnerable students.”San Diego Unified says they’re using their own criteria that goes beyond the state standards. It calls for rigorous contact tracing before they’ll reopen in-person.Escondido Union High School District starts a fully virtual school year on Aug. 25. SAN DIEGO (KGTV) - San Diego County Crime Stoppers and police investigators announced Tuesday a reward to find a woman suspected of identity theft and using fraudulent credit cards at Walmart. The woman opened two separate credit card accounts at the Murphy Canyon and Grossmont Center stores Dec. 18, according to the San Diego Police Department’s Economic Crimes Unit. The woman bought ,500 worth of items at each store. Police said the woman also tried to open fraudulent credit accounts at a Marshalls and Target store in Kearny Mesa, but was unsuccessful. The woman later went to a Chase Bank and took nearly ,000 in cash from the bank account of a victim whose identity she stole, police said. The victim’s credit monitoring service notified her of the fraudulent activity. Investigators believe the suspect is using a fake identification card using the victim’s basic information. The victim doesn’t know how the woman obtained her personal data, police said. The suspect, who is white and in her mid 20s to late 30s, was wearing a dark-colored wig while at the bank. She also wore glasses with dark-colored frames. Anyone with information about the woman is asked to call Crime Stoppers at 888-580-8477. 1223

SAN DIEGO (KGTV) - San Diego and National City Police detained three people and sought a fourth Friday at a South Bay home where a neighbor said shots were fired.The incident started Friday about 5 p.m. at Alpha and 47th streets in National City. A woman who lives near the home told 10News she heard gunfire. A 10News crew on the scene saw a man and woman leave the home with their hands raised. Police said three people were detained for questioning. Officers were searching for a fourth person in relation to the incident.There were no reports of injuries. 10News is monitoring breaking developments. 611

SAN DIEGO (KGTV) - San Diego is hoping to stamp out a portion of city litter with newly installed cigarette butts receptacles along San Diego Bay.The Port of San Diego installed 31 of the cigarette butt receptacles in partnership with TerraCycle, which developed the disposal stands.Staff from the Port's General Services Department will be in charge of emptying the receptacles and shipping the used cigarette butts to TerraCycle, who in turn will process them to be used in recycled products.RELATED: San Diego County residents still disposing of more waste than other Californians"Reducing litter is a critical step in protecting San Diego Bay, our precious natural resource.
