SAN DIEGO, Calif. (KGTV) - As restaurants learn to adapt and overcome in the era of new closures and regulations, not all are able to make it over the hurdle. Multiple San Diego staples have announced permanent closures, including The Balboa in Bankers Hill and Cafe on Park near Hillcrest.Andy Haenfler said he opened Cafe on Park 25 years ago and has devoted his life to this business.“I opened Thanksgiving weekend in 1995 to a line down the block and thought 'oh my goodness what have I done,'” said Haenfler.He said this past March, they closed their doors, thinking it was temporary, but they were never able to open them again.“We had just gotten a shipment of ,000 worth of product in so we gave it to the staff, the staff took it home and gave it away to their neighbors,” he said.Haenfler said he had hoped to stay open a few more years then retire and sell his restaurant to employees, but that goal is no longer possible. His message to the community now is to support local businesses so this doesn’t happen again.“It’s us little one-owner, one-shop places that the community really need to support,” he said.Nearby restaurant The Balboa has a similar fate. Owner Tom Logsdon said the business started years ago with him cooking at home then it grew into what it is known for now: a community spot with good burgers. “The type of business we had is really built around dining in, it’s built around community coming together,” said Logsdon.He said he did try to reopen, but the takeout burgers weren’t able to save the business the way regular customers who sit and have multiple drinks would.“Without people hanging out and having some drinks, it just wasn’t working,” he said.Logsdon said he’s permanently closing his Bankers Hill location but has a second location in Chula Vista, so he’ll be consolidating the business and focusing his effort on the one spot.“I’ve spent about a third of my life in that building. I’ve got a big attachment to the neighborhood and the community there but after three months of just losing money like crazy, the reality was we just couldn’t keep that going,” said Logsdon.Both Logsdon and Haenfler said this is the necessary decision right now, but once the industry recovers, they hope to reopen more restaurants and continue with their careers. 2304

SAN DIEGO (KGTV) Sewage contaminated water is keeping swimmers out of the ocean in Imperial Beach. Late Tuesday afternoon, The County of San Diego Department of Environmental Health extended an existing water contact closure to include all of Imperial Beach. The original closure was issued on June 27th for the Tijuana Slough National Wildlife Refuge shoreline. According to the county, sewage-contaminated runoff in the Tijuana River has been entering the Tijuana Estuary. Eric Syverson is a life long resident of Imperial Beach. He keeps a close eye on what's happening in the Tijuana River Valley. "It was dry on Saturday, not dry on Sunday. Monday, we wondered what was going on and now, Tuesday, there was quite a bit of flow this morning and it just smelled horrible and it’s green,” said Syverson. The water was pooling under the bridge on the north side of Dairy Mart Road. "At six a.m. this morning, probably double the volume that’s flowing right now and the air was twice as bad, you couldn’t breath under this bridge this morning," said Syverson. According to a San Diego inspector with the International Boundary and Water Commission, there was transboundary flow Monday night into Tuesday morning from a ruptured potable water line. The IBWC estimates 300,000 gallons of treated and untreated wastewater flowed into the U.S. Initially, the IBWC said the figure was much higher; roughly two million gallons. The number was revised after the inspector determined their gauging station was not accurately recording the flows. Members of Citizens Against Sewage are skeptical. "I’m looking at the gauge data from the river gauge from IBWC's information. We put values on those numbers that they provide, and it’s over seven milllion gallons,” said Lance Rodgers, Co-Founder of Citizens Against Sewage. This is just the latest in a series of sewage spills that have closed South County beaches."There were flows on the second, there were flows on the 30th, the 28th, 24, 23, 20, 19 it’s been a bad month,” said Syverson. Syverson said it's the same problem with no solutions from either side of the border. "I mean, why should we even have to think about it. It's July 9th, we should be at the beach right now, going "God, look at how gorgeous this area is," not standing in a horrible valley wondering how to solve a problem that’s existed for my entire lifetime," said Syverson. SAN DIEGO (KGTV)- It was a battle over workers rights at a rally downtown Thursday. Assemblywoman Lorena Gonzalez directly addressing the group against her proposed Assembly Bill. Assembly Bill 5 would affect any independent contractor including Uber and Lyft drivers, yoga teachers even hairdressers. The group at Thursday’s rally was made up mostly of adult entertainers. “I’ve been doing fine I like the freedom to educate myself and if someone’s going to stop me from that I want to do something about that and voice my opinion," one woman told 10News. The bill would make many independent contractors full time employees, forcing employers to provide overtime, health care and sick leave. Assemblywoman Gonzalez rebutted the group today. "There’s nothing in the law that says an employee has to work from 9 to 6. Any employer can tell you to work two hours, one hour, any hours you choose. There’s nothing in the law that says an employer can’t be flexible.”Some say they don’t want it because they prefer the flexibility and freedom to decide hours that comes with independent contracting. 1104

SAN DIEGO (KGTV)- San Diego County barely avoided falling back into the purple tier of the state’s reopening system, staying in the red for now.The color-coded tier system has been difficult for many business owners to deal with as they wonder if they will face more restrictions in the coming weeks.“We are working with the state to share our concerns and thoughts about the metrics they are using to put our county in the different tiers,” said Greg Cox, San Diego County Supervisor. "The reality is we remain at risk of being moved to the more restrictive tier in the future if we don’t do those things that we know we need to do.”Dr. Wilma Wooten, the county’s public health officer, said she and other health officers across the state have been pushing for the state to improve its metrics system to go beyond case rate and positivity rate.She would like to see three things happen.“If counties are maintaining hospitalizations and hospital capacities to somehow get credit for that, and also get credit for contact tracing,” she said.Wooten said the county should also get credit for providing access to COVID-19 testing in vulnerable communities hit the hardest.“San Diego has done an excellent job to date of getting access to testing in those communities that are hit the hardest,” she said.On Tuesday, the County Board of Supervisors passed a motion in a 4 to 1 vote to send a letter to the state backing Wooten’s effort in revising the reopening criteria.Wooten is urging members of the public to continue wearing a facial covering, washing hands, avoiding large gatherings, and staying home when sick, especially as flu season is on the way.“We do not have a vaccine for COVID-19, but we have a vaccine for the flu,” she said. “Getting the flu vaccine is the most important step in preventing the flu.” 1822

SAN FRANCISCO (AP) — California has joined nearly two dozen states and municipalities in suing the federal government to stop a new rule that lets health care clinicians decline to provide abortions and other services that conflict with their moral or religious beliefs.California's Attorney General Xavier Becerra filed a lawsuit Tuesday in San Francisco that calls the rule unlawful, reckless and contradictory to laws that seek to protect patients from discrimination and ensure access to care.It says the new rule effectively authorizes discrimination and could curb access to health care for LGBTQ Californians, among others.A similar lawsuit filed in New York federal court on Tuesday was brought by 23 states and municipalities.The city of San Francisco sued over the regulation on May 2, hours after President Trump announced it. 845
