SAN DIEGO (CNS) - The San Diego Air & Space Museum will hold an induction ceremony for its Air & Space Hall of Fame 2019 class Saturday, which includes Amazon and Blue Origin founder Jeff Bezos.In addition to Bezos, the 2019 class includes former Lockheed Martin Corporation Chairman Vance Coffman, MedAire founder Joan Sullivan Garrett, Apollo 12 command module pilot Dick Gordon, D-Day Pathfinder pilot Lt. Col. David Hamilton, Boeing Company aerodynamicist and aerospace engineer Robert Liebeck and Robert Gilliland, the first man to fly the SR-71 Blackbird.The museum launched the International Air & Space Hall of Fame in 1963 to honor pilots, inventors, engineers, space explorers and more who have made important contributions in the fields of Earth and space flight. SAN DIEGO (CNS) - San Diego County students' performance on standardized tests in English and math mostly held steady from the previous year, according to scores released Wednesday by the California Department of Education.The performance of San Diego County students on the California Assessment of Student Performance and Progress tests generally surpassed that of students statewide, according to the department. The CAASPP tests were administered in the spring to more than 3 million students across the state in grades 3-8 and 11. In San Diego County, 26.45% of the more than 250,000 students who took the tests exceeded the state standard in English, up slightly from 25.79 percent the previous year. According to the state, 30.1% met the standard, down slightly from 30.46% last year; 20.89% ``nearly'' met the standard, down slightly from 20.93% last year; and 22.55% failed to meet it, down from 22.82% the previous year. In math, 23.45% exceeded the standard, 21.6% met it, 24.84% nearly met it and 30.12% failed to meet it. The percentages from the previous year were 22.52%, 21.76%, 25.37% and 30.36%, respectively. Statewide, 22.23% exceeded the standard in English, while 28.64% met it, 22.4% nearly met it and 26.73% failed to meet it. In math, 19.69% exceeded the standard, 20.04% met it, 25.41% nearly met it and 34.86% failed to meet it. The statewide scores were all also moderately improved from the previous year. State Superintendent of Public Instruction Tony Thurmond acknowledged the overall improvement, but said he was concerned that gains were less consistent in later grades of 7, 8 and 11, while performance continues to lag among some students of color. ``Disparities between students of color and their white and Asian peers continue from year to year and demonstrate the importance of our priority initiative of closing the achievement gap,'' Thurmond said in a statement. ``Education equity should mean equity for all students and right now, we are not there. SAN DIEGO (CNS) - San Diego Police Chief David Nisleit Tuesday promised a thorough investigation into allegations that one of his officers uploaded a social media post mocking a roadside memorial for a robbery suspect fatally shot three months ago by that lawman and a patrol partner.SDPD Officer Jonathon Lucas was immediately suspended without pay after the online image seemingly belittling the death of 25-year-old Leonardo Hurtado Ibarra appeared on Instagram last week, Nisleit told reporters during a mid-afternoon briefing at downtown police headquarters."I am shocked and disturbed by the reports of this officer's conduct," the chief said about the post, in which emojis of laughing and tearfully wailing faces were superimposed over a photo of the makeshift tribute to Ibarra at the site where he was shot."The officer's alleged actions fall short of the high standards I and our community have for the San Diego Police Department," Nisleit said.Late on the afternoon of June 27, Lucas and Officer Tevar Zaki opened fire on Ibarra, a suspect in a recent robbery, when he allegedly pulled a revolver from his waistband and pointed it at them as they approached him in the 1200 block of Sixth Avenue in the Core-Columbia district.Ibarra succumbed to his gunshot wounds in a hospital two days later.The shooting prompted demonstrations by protesters alleging a culture of excessive use of force and racial bias on the part of the San Diego Police Department.While condemning the antagonistic online posting Tuesday afternoon, the police chief offered a message to Ibarra's survivors."I want to apologize to the Ibarra family," Nisleit said. SAN DIEGO (CNS) - The city of San Diego obtained a preliminary injunction Tuesday against grocery delivery company Instacart, in the wake of a judge's ruling that the company misclassified its employees as independent contractors.San Diego County Superior Court Judge Timothy Taylor's ruling stems from a lawsuit brought by San Diego City Attorney Mara Elliott, who alleged Instacart was evading providing its "shoppers" with worker protections like minimum wage and overtime pay by classifying them as independent contractors rather than employees.In the ruling, which was issued Feb. 18, but not formally served to the parties until this week, Taylor agreed with the City Attorney's Office's assertion that Instacart would not be able to show its workers should be classified as independent contractors.RELATED: San Diego Instacart shoppers upset over service’s pay changesThe judge cited a state Supreme Court ruling in the case of Dynamex Operations West Inc. v Superior Court, which outlines an "ABC" test for determining whether a worker is an employee, a classification that applies if the person performs a core function of the business, is not free from its control, or is not engaged in an independently established trade, occupation or business.Taylor wrote that Instacart would likely be unable to satisfy any of the test's three conditions.The judge also wrote that the city's litigation against Instacart was in line with other recent, related decisions, including the recent passage of AB 5, which gives greater labor protections to workers classified as employees."The policy of California is unapologetically pro-employee (in the several senses of that word). Dynamex is explicitly in line with this policy," Taylor wrote. "While there is room for debate on the wisdom of this policy, and while other states have chosen another course, it is noteworthy that all three branches of California have no spoken on this issue."The Supreme Court announced Dynamex two years ago. The decision gave rise to a long debate in the legal press and in the legislature. The legislature passed AB 5 last fall. The governor signed it. To put it in the vernacular, the handwriting is on the wall."Instacart plans to appeal the decision, which the company said would not affect its operations in San Diego, due to a temporary stay of enforcement during the appeals process."We disagree with the judge's decision to grant a preliminary injunction against Instacart in San Diego," Instacart said in an emailed statement. "We're in compliance with the law and will continue to defend ourselves in this litigation. We are appealing this decision in an effort to protect shoppers, customers and retail partners. The court has temporarily stayed the enforcement of the injunction and we will be taking steps to keep that stay in place during the appeals process so that Instacart's service will not be disrupted in San Diego."Elliott's office touted the ruling as a victory for worker protections."This landmark ruling makes clear that Instacart employees have been misclassified as independent contractors, resulting in their being denied worker protections in which they are entitled by state law.
