NEW YORK -- A suspended NYPD officer is now facing criminal charges after using an apparent chokehold during a now-viral arrest in Queens last Sunday.Officer David Afanador has been charged with attempted aggravated strangulation and strangulation in the second degree, Queens District Attorney Melinda Katz said Thursday.The 39-year-old cop, who has a history of complaints against him, was arrested and booked at his own Queens precinct just after 9 a.m. Thursday, according to police.If convicted, Afanador faces up to seven years in prison, the DA's office said.DA Katz acknowledged that body-camera footage shows the officers being cursed at and badgered before the incident. "Everyday, however, police officers find themselves in circumstances that require them to exercise restraint and are charged with de-escalating potentially volatile conflicts," the district attorney said."Even under the most difficult of circumstances...this kind of action is exactly the kind of police conduct that the NYPD has banned and our State Legislature criminalized," Katz added.Afanador was suspended without pay Monday, just a day after being caught on video pinning 35-year-old Ricky Bellevue to the ground and apparently putting him in a banned chokehold in the confrontation on the Rockaway Beach boardwalk.Mayor Bill de Blasio said at the time it was the fastest he'd ever seen the NYPD discipline an officer.The NYPD released the body-cam video of the arrest almost immediately after bystander video of the incident went viral.Prosecutors opened the investigation into Afanador’s actions Monday, saying at the time "there must be zero tolerance for police misconduct."Afanador was acquitted in a prior case stemming from allegations he pistol-whipped a Bronx teenage suspect and broke two teeth in 2014.The officer has had eight Civilian Complaint Review Board complaints filed against him, including use of excessive force and denying medical attention, since he joined the force in 2005.The use of excessive force by police has sparked weeks of protests and rallies in New York City and nationwide.The outcries for police reform prompted Commissioner Shea to shake up leadership at the NYPD. On Wednesday, Brooklyn North Chief Jeffrey Maddrey was announced as the new head of the NYPD's Community Affairs Bureau, and a mandate to wipe the slate clean, Shea said.This story was originally published by Mark Sundstrom and Katie Corrado at WPIX. 2450

NEW YORK (AP) — A judge has rejected a .5 million proposed bail package for Jeffrey Epstein's former girlfriend, saying her incarceration is necessary to ensure she faces trial on charges she recruited teenage girls for Epstein to sexually abuse. U.S. District Judge Alison J. Nathan rejected the proposed bail for Ghislaine Maxwell on Monday. According to The Associated Press, Maxwell and her husband, who has never been publically identified, offered their entire wealth - .5 million - plus millions more of friends and family's assets to secure her bail.But she did not immediately release an opinion explaining her reasoning. Maxwell was arrested in early July. She has remained at a federal lockup in Brooklyn ever since Nathan said there were no bail conditions that would ensure she would not flee. “For substantially the same reasons as the Court determined that detention was warranted in the initial bail hearing, the Court again concludes that no conditions of release can reasonably assure the Defendant’s appearance at future proceedings,” Nathan wrote Monday in the order.Nathan added that the government met its burden of persuasion that Maxwell poses as a flight risk.“In reaching that conclusion, the Court considers the nature and circumstances of the offenses charged, the weight of the evidence against the Defendant, the history and characteristics of the Defendant, and the nature and seriousness of the danger that the Defendant’s release would pose,” Nathan added.Epstein killed himself in August 2019 at a Manhattan federal jail as he awaited a sex trafficking trial. 1607

  

New research from AAA shows too many senior citizen drivers are not having conversations about when they should stop driving.AAA says that by the year 2030, 1 in 5 drivers will be over the age of 65, which is why the company is urging people to have conversations with their older family members sooner rather than later.According to the study, 83 percent of older drivers report never having a conversation with family or a doctor about their safe driving ability.  The report states that those who do only do so after being involved in a crash or other driving incidents.AAA recommends having conversations with seniors before you start seeing red flags.Here are things to keep in mind when beginning a dialogue with your loved one:Start early and talk often. Make sure you stay positive, and make sure they know the focus is on their own safety.Avoid generalizations about older drivers’ abilities.Have a one-on-one conversation. Doing it with the entire family can make a driver feel alienated.Stick to facts. Focus on a medical condition or medication that might make driving unsafe, and don’t assume their driving should be stopped altogether.Plan together. Let the driver play an active role in planning for their “driving retirement.”In 2016, more than 200,000 senior drivers were injured in traffic crashes. AAA says by starting the conversation early, we can all help to make sure our own loved ones don’t become a statistic.  1464
