SAN FRANCISCO (AP) — An appeals court has rejected a former Stanford University swimmer's bid for a new trial and upheld his sexual assault conviction.The three-judge panel of the 6th District Court of Appeal ruled unanimously Wednesday that Brock Turner received a fair trial.A San Jose jury in 2016 convicted Turner of sexually assaulting a young, intoxicated woman outside an on-campus fraternity party.Judge Aaron Persky rejected a prosecutor's demand for a lengthy prison term and instead sentenced him to six months in jail. Turner appealed the conviction, arguing he didn't receive a fair trial.Persky's sentence sparked nationwide outrage by those who felt it too lenient. But now, 95,000 San Diegans receiving Supplemental Security Income, or SSI, will be able to apply for the CalFresh program (food stamps). “Individuals receiving SSI receives no more than 0 a month,” says Amanda Schultz Brocheo, with the San Diego Hunger Coalition. “For the majority, of SSI recipients, this all the money they have.”In San Diego, 1 in 11 older adults don’t have enough food to eat. “In some cases, we’ve heard of SSI recipients that will pull out a calendar and circle the days they are going to choose not to eat.”The San Diego Hunger Coalition says they are happy about the expansion but say the amount per day the is less than a day. “We determined that here in San Diego County the average CalFresh allotment is .07 a day.” This week also marks CalFresh Challenge Week. The organization encourages San Diegans to try living off a day for food. It’s meant to bring awareness to the food insecurities around the county. “We know that the CalFresh program is our strongest tool to for fighting hunger and also recognize that the current allotment is fairly small,” says Brocheo. “It makes it fairly difficult for people to live on that amount. The city wants to add housing and retail to the area to help meet new goals for housing, transportation and climate change.To do that, they're looking to add density to the neighborhood.The website identifies eight areas of Clairemont that could be redeveloped. It asks users to make changes to at least three areas while adding 5,000 new homes. At least 40% of the houses need to be near the trolley.To help, it offers basic renderings of what different development could look like in each neighborhood."We wanted to try to find something that allowed people to get into the weeds if they wanted to," says Tait Galloway, the Program Manager who helped design the website. "But, this still allows them to do it within 15-20 minutes."The website will be available until March 14th. After that, the answers will be collected and used as the city devises the new Clairemont Community Plan. They hope to present it by the end of 2020.City leaders hope this will become a template for other neighborhoods and a way to get more people involved in the process. (KGTV) - A new California law could let convicted killers out of prison, and San Diego County's district attorney said her office will fight it on a case-by-case basis.Senate Bill 1437 passed the state Legislature last year and went into effect on January 1. It narrows the definition of murder so that only people who are involved in a killing can be charged with that crime.Before the law, accomplices in a killing could also have been charged with murder."It may let murderers go free, because of how far it goes," said San Diego County District Attorney Summer Stephan.Stephan said her office will challenge some re-sentencing hearings based on the new law, although she said they don't know how many there will be.One possible case involves Kurese Bell, who He as convicted of murder in 2016 for his role in the robbery of a North Park marijuana dispensary.During the robbery, Bell and another man, Marlon Thomas, got into a shootout with a security guard at the dispensary. The guard shot and killed Thomas.The DA's office argued that Bell should face murder charges because his actions in the robbery led to the shootout and, ultimately, Thomas' death.Bell is currently serving a 65-year-to-life sentence.Stephan said criminals need to be held accountable for the crimes they commit and cause."It's really important that each offender is held culpable at the right level," she said. "That's what justice is about."Supporters of the new law say it is a vital part of California's efforts at criminal justice reform. They say the old law unfairly targeted young minorities.On its website, the group Restore California says the new law makes sentencing in California more "equitable." SAN DiEGO (KGTV) - Police deployed tasers to arrest a man following a road rage outburst that got out of control Wednesday evening.Police identified the man as 33-year-old Jason Berard. He was driving a silver SUV that backed into a white pickup truck near Park Boulevard and Howard Avenue in the University Heights neighborhood.  According to the driver of the pickup, they pulled over into a Chevron. The driver of the pickup truck thought they were going to exchange insurance information, but instead, Berard was confrontational.  According to witnesses, Berard punched the other driver before ripping away the man’s cell phone and throwing it on the ground, smashing it.A gas station employee called the police.  After police responded and made contact, police say Berard assaulted an officer. That’s when another officer came to help and fell to the ground during the struggle.Police say Berard took off on foot and got about a block down Howard Avenue but was taken down after an officer using their taser.Berard could be facing battery charges on an officer as well as resisting arrest. 1122
