(KGTV) — A federal judge has denied Stone Brewing's request for a preliminary injunction in its lawsuit against MillerCoors over its Keystone Light product cans.Stone's motion to dismiss MillerCoors' counterclaims were also denied. The injunction would have prevented MillerCoors from using the rebranded cans during trial, according to IP and craft beer attorney Brendan Palfrey. More court documents can be read on Palfrey's Twitter page.Stone Brewing filed the suit against MillerCoors in February 2018, after the beer maker rebranded its Keystone Light products to feature "Stone" on a separate line in bold fashion.RELATED: San Diego's Stone Brewing sues MillerCoors over Keystone cans: 'We will not stand for this'While Stone lost out on the injunction, the judge did say Stone's trademark infringement case is “moderately strong." The judge added that the court agreed with Stone, "especially considering the marks incontestability, [Stone] is entitled to the strong protection afforded to suggestive marks."The case will likely now move to trial.Following the ruling, Stone's cofounder Greg Koch issued a statement, saying the court confirmed their case against MillerCoors.“This is a very big deal. The Court’s order confirms what we knew: that MillerCoors should be ashamed of what they have been doing. All along this has been a clear-cut infringement case, and now we can focus our resources on proving the significant damages done to the good name of Stone Brewing," Koch said.Stone CEO Dominic Engels added, "We are pleased that the Court recognized the validity of Stone’s infringement claims. MillerCoors has made hundreds of millions of dollars from rebranding Keystone in a way that infringes on our trademark. (KGTV) — A family forced to flee Paradise, Calif., because of the Camp Fire finally returned home after nearly a month this week to find their faithful canine had survived and guarding their charred property.Andrea Gaylord was evacuated on Nov. 8 but only allowed back to her property Wednesday, according to group K9 Paw Print Rescue. Her property had burned in the fire. During the evacuation, Gaylord was unable to get to her dog, Madison, before the flames had spread through the town and forced her out, according to the rescue group.Animal rescuer, Shayla Sullivan, responded to Gaylord's request to check on Madison, first spotting the Anatolian shepherd just days after the fire began. Madison, however, kept his distance, according to Sullivan, who was already in the area searching for other lost pets.Sullivan decided to leave food and water regularly at the property for Madison until Gaylord was able to return, the animal group wrote.As Gaylord pulled up Wednesday, there sat Madison — being a very good boy."He had stayed to protect what was left of his home, and never gave up on his people! I’m so happy I’m crying as I write this! He didn’t give up through the storms or the fire! A long [sp] month it must have been for him!" Sullivan wrote on Facebook. 1280

(CNN) -- Two Disney employees were arrested in a child pornography sting orchestrated by the Polk County Sheriff's Office in Florida.They were among 17 men nabbed in an undercover sting operation, according to a press release from the agency.Brett Kinney, 40, of Lake Alfred, Florida, told investigators he was a guest experience manager at Disney World, according to the release. Kinney was arrested and charged with one count of promotion of child pornography and 24 counts of possession of child pornography-enhanced, the release said.A Disney spokesperson told CNN by phone that Kinney was no longer employed with the company following his arrest in the sting.In the release, the sheriff's office alleges that Kinney would search online for images of boys from toddlers to 10 years old. He was caught during a peer- to -peer investigation of alleged child pornography.When confronted by investigators, Kinney told them that he had an addiction to child pornography and had been viewing it for 22 years, according to the release.A second Disney employee, Donald Durr Jr., was also arrested by the Polk County Sheriff's Office. Durr, 52, of Davenport, Florida, told investigators he was a custodial worker at Walt Disney Resorts. He was arrested and charged with eight counts of possession of child pornography and one count of promotion of sexual performance by a child.Durr is on unpaid leave, a Disney spokesperson told CNN.Investigators discovered an electronic tablet with three images of child pornography and a DVD created by Durr nine years ago showing explicit images of a child, the sheriff's press release said.Durr described himself during an interview with detectives as "a pervert, but not a monster," according to the release.CNN has reached out to both men for responses to the charges they face but has not yet heard back. (KGTV) – Federal investigators are continuing to look into the backgrounds and motives of the El Paso and Dayton shooting suspects to determine if the shootings were instances of hate crime that may have been inspired by the Poway synagogue shooting.<br /><br />The El Paso shooter was taken into custody after killing at least 20 at a Walmart store on Aug. 3. Investigators said the 21-year-old suspect pulled the trigger just 20 minutes after posting a racist manifesto.<br /> <br />Hours later, police in Dayton shot and killed a man who opened fire at a downtown entertainment district. Multiple people, including the gunman’s sister, died at the hands of the gunman.<br /> <br />Sociologist Dr. Pete Simi studies political extremism and violence at Chapman University. Pretty young."<br /><br />Simi also said the young, tech-savvy generation connects with like-minded people on anonymous online forums like 8chan.<br /> <br />In his manifesto published on 8Chan, the El Paso shooter posted: "In general, I support the Christchurch shooter and his manifesto. This attack is a response to the Hispanic invasion of Texas."<br /><br />Earlier this year, the suspect in the Poway synagogue shooting shared a similar message on 8chan in which he also praised the work of the New Zealand mosque shooter.<br /><br />"In some cases, they talk about is how you could've been more active, or you could've killed more people if they had done X-Y-Z," Simi said. "Or they're discussing the relative merits of this type of violence and pros and cons. It's really a cesspool environment."<br /><br />At this point, the Dayton suspect's motive has not been confirmed. But he too is a young, lone-acting shooter who wore body armor. FBI investigators are now digging into his digital background to find answers.<br /><br />"What may connect them though is there may be some kind of copycat aspect to it," Simi said.<br /><br />In light of the mass shootings, Frederick Brennan, the founder of 8chan, demanded the site be shut down.<br /><br />He said he created the website in 2013 as a free speech forum, but relinquished ownership in 2015. 2826

  

(KGTV) - A NASA astronaut with a special tie to San Diego is preparing for her trip to the International Space Station. Wednesday morning, 10News Anchor Jim Patton spoke to Dr. Jessica Meir, who earned her Doctorate in Marine Biology at the Scripps Institution of Oceanography. She’ll be taking her first space flight as part of the next crew going to the ISS. "There is definitely a Scripps Institution of Oceanography flag as well as some other items from San Diego," said Astronaut Jessica Meir, speaking from Star City, Russia, where she's been training for the past year and half. She'll be applying her scientific skills to a myriad of experiments some 250 miles above the earth. "We will be on board for about six months,” said Meir. “That's the average length of a space station mission these days. And we will be conducting all kinds of scientific investigations, ranging from how our blood vessels and arteries are actually thickening and stiffening in response to the spaceflight environment. And how it affects all of our physiological systems." Meir says the research is part of the quest to send humans to Mars. Much of the work is at the leading edge of science but some is as practical as your kitchen. "Do we have a progress for trash?" Meir can be seen asking a fellow crew member as they train on a mock-up of the space station. "Where do you think we're keeping trash right now?" While very down to earth, Meir says all the training is very necessary. "When we have anything that breaks, like a toilet or need to change a light bulb, we can't call a plumber or electrician. We have to do all that stuff ourselves as well." Of course, all of this amid a little background fact: it requires the guts to blast-off from the comforts of Earth into the ultimate hostile environment of space. "How do you have the courage inside to do something like that,” asked Patton. "I think the biggest answer is the amazing training here on the ground," answered Meir. "The teams in Houston, all over NASA, and here in Russia as well. They prepare us for any situation." Jessica Meir and her crew are scheduled to take off from Russia on Sept. 25. They'll reach the ISS six hours after lift-off. 2207
