MESA, Ariz. -- An Arizona "Dreamer," business owner and soon-to-be father was detained by ICE agents after serving time for a DUI charge in Mesa. His pregnant wife is due any day now and is hoping an online petition will help convince a judge to let her husband out on bond so he can see the birth of their daughter.Justine Dachel and Misael Trujillo met at Jewel's Bakery and Cafe in Phoenix, which they now own and run together. They got married in December."Our restaurant would fail if he wasn't able to be here," said Dachel.Trujillo is a "Dreamer." His parents brought him to the United States when he was a child, and until recently, he was a DACA recipient protected from deportation. The Deferred Action for Childhood Arrival program allows undocumented immigrants brought as children to live and work in the U.S.In 2018, Mesa police reports show Trujillo was charged with "DUI- impaired in the slightest degree" for marijuana. Trujillo tried to fight the charge for more than a year and finally took a plea deal, thinking he'd be able to choose a jail in California and avoid deportation. However, because of COVID-19 restrictions, Trujillo had to serve in Mesa, and ICE agents were notified. He was taken into custody on June 29.According to an ICE spokesperson, Trujillo remains in ICE custody while he awaits a hearing with an immigration judge with the Department of Justice’s Executive Office for Immigration Review.The spokesperson also gave KNXV this statement for background on the process:"ICE lodges detainers on individuals who have been arrested on criminal charges and who ICE has probable cause to believe are removable aliens. The detainer asks the other law enforcement agency to notify ICE in advance of release and to maintain custody of the alien for a brief period of time so that ICE can take custody of that person in a safe and secure setting upon release from that agency’s custody."Dachel said Trujillo was sober when he was driving, but blood tests showed he had traces of marijuana in his system. Still, she said that shouldn't be enough to remove someone from the only home they've ever known."Yes, pay the fines, do the community service, do the work they need to do, but if they are not a harm to society, and they make a mistake--we all make mistakes," said Dachel. "It's just not fair."Dachel is an American citizen. She is 39 weeks pregnant with their baby girl they've named Beni."Because of corona, he's actually the only one allowed in the room with me. So if he doesn't come home, then I'll be by myself," she said.Ezequiel Hernandez is an immigration attorney in Phoenix. He's not representing Trujillo. He said Trujillo will have to go through the deportation proceedings, and the first step will be to get him out on bond. He said a judge will take several factors into consideration."The fact that he's been here for 20 years, the fact that he's married to a U.S. citizen, the fact that he's about to have a baby, the fact that it has been his only crime, the fact that he has a business, he was in the DACA program. He has a lot of equities, but that one single issue puts him as a priority because of this administration's priorities, he is a criminal alien and has to go through this process," explained Hernandez.Hernandez said the current administration is a lot tougher when it comes to bonds and people who've been convicted."They have hardened since the Obama administration to now....where most of the judges will not issue a bond with a DUI, in my opinion," said Hernandez.Because of COVID-19, Hernandez said many hearings have been suspended, so it's unclear when Trujillo will have his bond hearing.Dachel said she just wants him at her daughter's birth. She started a petition on change.org in support of her husband. As of Friday evening, it had nearly 15,000 signatures."Kind of just tell the judge how many people, how much he's needed in this community, and how many know and love him and how wrong this is that this is happening to us," said Dachel.Dachel said her doctors will wait as late as next Friday to induce her, but she could have her baby any day due to complications she's been having."I know how much he wants to be there, but he just said that I need to do whatever is good for her," said Dachel about her daughter's birth.Hernandez said bond or no bond, it will be a costly and timely fight to get Trujillo legal status, and it's very likely he'll have to leave to Mexico during the proceedings."This is another reminder of why the immigration system has to be reformed, and particularly the DACA population-- obviously they're very fragile in terms of what they could go through, and this is one of those situations," said Hernandez.This story was originally published by Claudia Rupcich at KNXV. 4788

(AP) — Two Tennessee men are accused of raping a 9-month-old girl and filming the attack.News outlets report 19-year-old Isiah Dequan Hayes and 22-year-old Daireus Jumare Ice were indicted by a grand jury Tuesday on charges including especially aggravated sexual exploitation of a minor.A Shelby County District Attorney General's office release says the men were reported to police in 2016 when the girl's mother found footage of the attack. She was able to identify the men from the video.The release says investigators determined Hayes was in the video and Ice filmed it. Hayes also was indicted on a charge of aggravated rape of a child. Many businesses across the country have been working to safely reopen their offices. From disinfecting desks to implementing social distancing guidelines, some employers are learning it still might not be enough to bring people back to their desks."There are people who have fears of returning back to work due to safety concerns. Maybe they might be at a higher risk due to a compromised immune system or someone else within their family so they have some concerns about returning. Some employees don’t want to return-- and some employees want to continue to work from home when they were able to do it during this period of COVID," says Amber Clayton, the Knowledge Center Director at the Society for Human Resource Management.Clayton says some reasons for an employee refusing to come back to the office are protected under law. For example, if the employee, or someone the employee lives with, has underlying health conditions that would make them at higher risk for being affected by COVID-19, or they're unable to return due to childcare reasons. Employment lawyers like Ruthie Goodboe agree, citing OSHA and the National Labor Relations Act."An analysis needs to be done by the employer to determine, ‘Am I able to separate that employee if they’re unwilling to return to work, am I required to do or take certain steps’ and then if I do that and they still don’t come to work, do I have a right to separate them," said Goodboe, an employment lawyer with Ogletree, Deakins, Nash Smoak & Stewart.Employers must also make sure they're following regulations under the Americans with Disabilities Act and Family Medical Leave Act."If employers are following guidance from the CDC and from OSHA and limiting their exposure in the workplace, that should be satisfactory. However, there may be times that someone may be infected in the workplace and that employer may be held liable depending on the situation," Clayton said.But for those employees who simply have a general fear of COVID and despite any accommodations the business is taking, still don't feel comfortable coming back to work, it may be a breaking point."There's no federal or state laws that I’m aware of that requires an employer to provide leave based on someone’s fear that they may contract some type of disease whether it’s COVID-19 or something else. But employers should, through their policies and practices, determine what they’ve done in the past and ensure they’re being consistent and fair in their policies," says Clayton.Perhaps the biggest key for employers and employees in getting through this is communication."Stay calm, take a breath and make sure you’re communicating well with your employees to get all of the information. Do you understand what all of their concerns are? Because once their concerns are understood, it may be easy to resolve," says Goodboe.Employees and employers could ultimately find a mutually agreeable working situation to keep everyone comfortable and healthy at work. 2994

  

Many public school districts across the country are choosing to do remote, online learning once school starts back up in the fall. But where does this leave some of the crucial support staff like school nurses and librarians?While some districts are furloughing or laying off staff, others are getting creative."There’s a variety of tasks we can do even though we’re not physically on campus and on site," says Jane Banks, the director of health services at Fresno Unified School District in California.Banks is deploying the district's 67 full-time school nurses and nearly 50 licensed vocational nurses to act as contact tracers during the pandemic."A lot of the work can be done virtually and we actually do it over the phone. Most of the time, I spend a lot of time on the phone with families and staff and so I can see it being the same in the fall," says Banks.Fresno Unified says its librarians will also be working remotely this fall, supporting schools' digital libraries, checking out textbooks for at-home use, distributing computers and WIFI hotspots to families, creating high quality digital resources for students and teachers and so much more.For support staff like librarians and nurses, it's a job they're not used to doing remotely but they're finding there is still so much to do to support students while they're not on campuses."We're trying to do our best in ensuring that we're trying to keep as much staff as we can. Now is the time where we need our school nurses, where we need our health staff," says Banks.Laurie Combe, the president of the National Association of School Nurses, says districts are in a tough spot this fall. Educators are dealing with rising costs to keep students and staff safe amid the COVID-19 pandemic, all during state budget cuts. Some districts are being put in a tight financial situation."I have heard for some layoffs and I've heard of some furloughs. So, there's a big difference there," says Combe.Combe adds that school nurses have been crucial in assisting districts through the pandemic since the spring and they'll continue to do so in the fall."They've been essential to the planning and preparation and emergency preparedness of school districts," says Combe.Combe hopes districts will be innovative in the ways they can use school nurses. Fresno Unified is hoping to maximize nursing services this fall."There's a lot of things they can do off-site. Things like connecting with parents and families, especially we have nurses who are connecting with students who may fall into those high risk categories and ensuring they are safe during this time," says Banks.Fresno Unified will also be testing out something brand new this fall: Telehealth with school nurses."Right now, it's the limitations with access and just kind of bridging that gap. Especially with our families that might not be able to drive somewhere and get services that they need," says Banks.The district is just in the planning phase right now but they hope that even with school campuses physically shut down this fall, that school nurses will still be able to connect and treat families remotely. 3141
